    If you want to use new name (using spouses's last name) moving forward, put your new name in all uscis forms, no explanation needed anywhere. Your marriage certificate is the evidence of name change.

    Be sure to tell the Mexican immigration that you are on vacation, not that you are getting married.

    Probably not. I asked about what documents I need in order to get married in the states (I will probably ask here instead) and all answers I got are about how it is illegal and how I should do the K1 visa, becaue that is the only correct thing to do (according to them). It is mildly frustrating, because I know I am right, yet I am getting lectured like a little kid. Anyways, I just wanted to make sure I am not crazy lol. Thank you and have a nice day.

    People often give lazy answers that do not follow the full context.  The issue can come when marrying with the intent to stay and adjust status, rather than leave and pursue a spouse visa.  Often people think the way they did it is the only way, or they were also misinformed about their options.  Your actual intentions are what make the difference here.

    All that said, I would give a generic but truthful answer when asked the purpose of your visit.  Avoid, saying that you are coming for your wedding.  It's also true you'll be visiting friends, doing tourist things, etc.  No sense risking an ignorant officer that makes the wrong assumption about your intentions.

    Depending on the state where you will be married, there are very few requirements.  You can use your passport as ID.  You and your BF will have to apply for a marriage license (used to always be in person - with COVID you'll need to look at that).
     
    Each state will have its own rules around when the marriage can occur in relation to obtaining the license.  For example, here in Washington state, it is a three day wait.

    Marriage requirements are a state issue.   50 states , 50 possibilities.   Just look to the location you plan to marry for that states requirements.  Most is simply a valid ID.

    You can come and get married. You cannot come with the intent to stay.

    It is legal to marry in the USA on the VWP and return home. Remaining after the marriage and adjusting is not. However, there is the question of if you will be successful in doing so. You certainly don't want to lie to immigration officials about your intentions, and there are some that may view you suspiciously or that your intentions are not honest. It is always best that you bring proof of strong ties to returning home to offer as evidence if questioned. People can and do get married in the USA all the time. Have these people never heard of destination or vacation weddings?

    Doing what you are describing is legal.  Staying to adjust status instead of returning home is not.

    you can get married in the US as others have said but dont get into trouble by staying and adjusting status. This forum is correct. you can get married in US

    If it puts your mind at ease... I entered the US using the ESTA and got married myself back in 2017. I also left at the time and started the IR-1 process one year later (while in the US as it made doing the paperwork together easier, once again leaving after). You'll be fine, what you are intending to do is fully legal.

    Thank you. And yes, Im in the Czech republic and the EU/UK travel ban is still on. I am still a little hopeful that itll get lifted before I go as the Mexico trip will be quite expensive for me (I just finished school ... ), but I expect to have to go there in the end.

    You were just lucky.  I and many others here on VJ recommend bringing proof of strong ties to home country as preparation for the worst case scenario.  You never know when you'll meet a strict CBP officer.  Better to have the proof and not need it, than to need it and not have it.
     
    I visited the US multiple times and always through the same POE (SFO).  Most of the time I also breezed through immigration.  But one time, I was taken to secondary inspection.  I'm sure the trigger for it was when I declared my purpose of travel as "visiting my boyfriend".  On another trip, I witnessed a traveler ahead of me on the immigration line being asked for employment documents from their home country.

    Plus put your home address in the Czech Republic.
     
    And make sure you take proof of ties to your country when you are entering ( details of your studies etc), you dont want to get grief over the 2 month stay.

    Yes, he can file while you're in the US.
    The I-130 form includes a section where it asks if the beneficiary is in the US and you must enter all your entry info -I-94 number, expiration date, etc.-

    This is legal. The CBP officer at the border has discretion to admit you or send you back.

    Generally the past 3 years of tax returns are recommend, and most embassies require at least the past year's tax return. Even if you didn't earn enough income that year to meet the poverty level, you can supplement it with bank statements and an employer letter that states your salary and how long you have been with the company in order to prove your support.

    Affidavits of Support aren't petitions to be approved or denied. They are contracts between the sponsor and the government to support you, and they are in effect the moment you become a PR.
     
    She's not required to send tax returns to USCIS if she was not required to file them with the IRS. That's why the instructions are pretty clear and tell you to give them the reason why a tax return wasn't filed. In her case, not enough income to be required to file.
     
    What should matter to the IO is her Current Annual Income, not what it says on her previous taxes (even though they can still check the whole scenario). If her income now is above the poverty line, you guys are good to go and no joint sponsor is required. Send employment letter and paystubs to support that.
     
    I understand that since it's a new job, you might think you need a joint sponsor, which is fine and will eliminate the trouble a misinformed officer can cause. But a joint sponsor in your case is not required.
