If the petition was sent to the wrong office, USCIS would reroute it to the correct office. You don’t need to refile anything.

I have to agree that counselling might be the way to go here -- and I'm usually the one telling people to leave and get a divorce! If it's really just not getting along, some time-limited talk therapy could help. Therapists are doing sessions by Zoom and other video services now. If it's disagreements and arguments that aren't violent or don't seem like there is any threat or bullying or harm -- just plain old fights -- therapy could be the key.

“Not what I want to hear” is not the same thing as “unhelpful”. Sadly it’s often the case that when it comes to things like immigration overstays, the right advice is often what you don’t want to hear. Pointing out that this conversation has already been held, and that USCIS may not see things your way, is not “rude”. More generally, if you post in forums you don’t get to control who answers. We get a lot of shooting the messenger here. If you feel anything I’ve said contradicts the terms of service, feel free to report it to a moderator.
Geowrian is correct, as soon as there is overstay her visa will be cancelled. People have had their visas cancelled for being on a flight that left late and left past midnight of the day their stay expired. You can hope things improve, or you can file for an extension of stay, which will help if it’s granted and make it worse (potentially longer overstay) if it’s not. JFH has found some useful information for you about flights back.

I would wait it out to see what plays out. If the borders close then us immigration may extend the life of visas because a lot of people are already shut out from entering. So the best option for me would be to give the employer the necessary notice when the time comes. As of now, you can’t get marry before the 90 days because city clerk offices are closed and there is no way to get your marriage license.

Same thing happened to me. Mine was denied July 2019 for failure to submit i864. I did not appeal. I just refilled the whole application In August and now I have my interview scheduled for next month (but that would most likely get rescheduled)

Do what you have to do now at the nvc level. Chances are the consulate would not add the child and you’ll therefore be granted the visa and would have to leave the child behind. You’ve waited long enough and nothing is wrong with waiting a little bit more. You make it sound like the child is holding you back. Shouldn’t have gotten pregnant if you were so anxious to migrate. These things happen.

I just received letters from the USCIS now denying my kids their I-458 because my ex wife who was their petitioner then revoked the petition from last year and revoked the last one for my 8years old this mar 13th. I have just had an extension to my residence status while waiting for my 10 years. Can I reapply for the 3 of them afresh?

It beats me! I’ve noticed that he had a comeback with everything you tell him! Why come here shouting “please help” when everything we tell you, you’re questioning it? Since he knows it all he shouldn’t be here “seeking help” in the first place.

Next time you contact USCIS, i assume your first question will be , “Are you an actual USCIS employee or just someone working for USCIS? Give me an actual officer.”
FYI, the max you can get is the customer service in your case at this time. You are not gonna get a Tier 2 officer for a case that hasn’t even been registered.

It’s no different than any other time. A non-resident or non-citizen needs a B-2 visa or a VWP privilege to visit someone here. That was never guaranteed even before Coronavirus was known. Regrettably people died without relatives able to visit them as they were unable to get a visa. We have seen such cases on this forum.
In a society such as ours, we have to consider the welfare of the entire community over the desires of the individual.

I think OP wants the answer he likes to hear and will question anyone who have good suggestions but not the one he expected.
so here is my response to the OP:
You can do whatever you want, you can send the new package before they send you the rejection letter. So do what you feel doing it.
