    Thank you!

It lasted about 30 minutes total, she asked how we met and how we handled the COVID situation (my k1 appointment got rescheduled 3-4 times), asked when we got married and where, asked us if we have any documents and pictures go give her to prove a bona fide marriage and after that was just the yes and no questions from the application really, all while doing some small talk (we talked about some tv show and about art exhibitions here in LA)

Then she asked if we have any questions, answered a couple I had then said she's going to approve us, what's going to happen after (applying in 2 years for the permanent card), made me sign a document and voila

I was happy to write we sent our package yesterday BUT I just realized we forgot the main cover letter and the payment!!! 😢 So I guess we have to wait for the package to come back...
Should we wait for it to come back or should we send a new package with everything this time ? (going to curse myself for a while on that one...)

Joe you have had all kinds of info swirling around. I’ll add my opinion.
At this time you are not eligible for a SSN because you have no immigration approval that would allow one. Some day you will have EAD, a green card, and citizenship BUT that doesn’t mean you are eligible at this moment for a SSN. Someday doesn’t count. The IRS says “You’re eligible for an SSN if you’re a U.S. citizen or if you’ve been admitted by the United States for permanent residence or U.S. employment.” Until one of those happens you are not eligible for a SSN and can get an ITIN. Those have not happened for you. I would complete a joint tax return as soon as your spouse has all the documents needed. That would maybe be February since documents are supposed to be issued by Jan 31. Then you have two choices. a) Sit on it waiting a bit to see if your EAD is approved. That doesn’t mean you will get a SSN immediately. Social Security offices aren’t allowing walk-ins and just getting the number may have its delays and hassles. b) File immediately with an ITIN application. That too requires some bit of hassle. The process for getting an ITIN is described on the IRS website. https://www.irs.gov/individuals/how-do-i-apply-for-an-itin Because you would have to mail your actual passport off to Austin as ID, the better FREE choice is Option 3, getting a photocopy of your passport ID certified at an IRS office. You will have to make sure it is a Taxpayers Assistance Center (TAC) that offers certifying services. Not all do. Don’t leave it to the last minute or all appointments will be taken. Option 2 is similar but likely has a fee because it will be a private firm who is authorized by the IRS to certify a photocopy of your passport. So when you go to one of these offices bring the following with you present in person:
Your completed tax return with your SSN field left blank A completed Form W-7 (your ITIN application) Your passport ID to be photocopied and certified The TAC (Option 3) or Acceptance Agent (Option 2) will certify a photocopy of your passport then submit everything to the Austin IRS office for you. They process your ITIN, then write it on your tax return and process the return in Austin. You may wait months on a return to be processed. There’s a thread where blokes are discussing it. Thus your refund will be delayed, but at least you filed.

if you decide to wait on a SSN, you can efile and get the refund quickly. You have to hope the EAD gets approved soonish. The hassle will be the Social Security office. There is a forum on getting SSNs.

I prefer the desktop version and that’s what I’m familiar with. TurboTax Deluxe (cheap one) will do all you need. You use TurboTax as one normally does but ignoring the SSN field for yourself. Do all the checks it runs you through, fixing everything except ignore the SSN error it will point out. Then you go to the print area and choose  Print for Filing. That will print only the pages the IRS needs. Printing everything will give you worksheets and all kinds of pages for your records that don’t go to the IRS.  Done. Take that when you go get the passport certified.

If you have more questions about tax filing specifics after the first of the year, that’s a new topic so start a new question in this forum. There will be plenty others asking too.

I just spoke to the IRS here is what needs to happen:

    1) Complete the W-7
    2) Complete your Federal & State tax returns using the number 999-88-9999 in place of a Social Security Number for the person without a SSN#.
    3) Print the tax returns and cross off the 999-88-9999 from the SSN field, do not file your return electronically.
    4) Write "Applying for ITIN: Application Attached" next to the SSN field.
    5) Mail the signed federal return, the completed W-7, and all documentation required by the Form W-7. (however you may choose to take all this information in person to a local IRS office (TAC) for processing). so yes they will file it for you.
    6) If you need to file a state tax return: Mail the signed state return and a copy of the W-7 to your states regular filing address.

    Hope this helps

Had a double celebration this week: my wife got her bio appointment scheduled and our K-2 daughter finally got her adjustment application accepted and receipt numbers issued. 🎉 Seems like our daughter will be on an offset schedule from my wife since her part of the application was accepted later, but I would think the two of them would share their priority date.

My biometrics appointment was yesterday. We arrived 10 minutes early and waited outside with the other people who had been given the same slot. At 15 minutes prior, they admit you to the building where they take your details, check your ID, give you a number and then you wait your turn. They did look at my completed Applicant Information Worksheet and gave it back to me to keep. Someone ahead of me hadn't filled theirs in so they were asked to do that.

The process was quick and I received an email update from USCIS a few minutes after. Current status is, Case is being actively reviewed by USCIS. Our records show nothing is outstanding at this time.

Benedicte reacted to Vegas i-751 in AOS taking forever.. no word since 11/6/20
A lot of people who went through AOS always say “hey if I could turn back time” “maybe you should have thought of this”. I went through K1 back in 2018/19 and have absolutely no regrets for me.

You made the decision that you right for you and there’s no need to justify to others. People will always hype about why you didn’t chose the CR1-either to raise awareness for others or just to question why you don’t believe their view points on what is stronger. Doesn’t matter as all that matters is you and the route you chose. You made that decision. You are already in the AOS process so CR1 isn’t relevant.

Just have faith it will work out soon. I’m not a hindsight kinda guy-I mean you’re in the process already. I hope all works out soon. Try expedite with job offers-doesn’t cost nor hurt to try.

Since it's stuck at the lockbox, you could try their email address: lockboxsupport@uscis.dhs.gov

It's not clear to me why they're taking so long to reject it as it's a straightforward rejection. Perhaps they review the entire list of documents to make sure everything else is there as well to make sure they send you complete instructions.

It's not unusual. More than a few people get their first text message notifications over a month after the date of receipt. But with something where they will definitely reject it, you won't get notified at all until you get the package back in the mail. Just the way it works, unfortunately.

Your package is definitely getting returned. Whether to submit a new COMPLETE  package is a tough call. I'd wait a few weeks before you send another just as a precaution.

Benedicte reacted to E&W in Everyone call congressperson and demand K1 be critical
Ok, I didn't want to post, but it seems it needs to be said. I am not trying to diminish anyone's journey or trying to say that we are the only ones that have it hard or have ever had it hard or will ever have it hard. But I have also noticed that in a lot of threads where people are discussing taking action and trying to get political figures to please do something about K1 visas, there is often at least one person coming in saying something along the lines: "I am so glad we did CR1" or "this just proves that K1 is not a good choice" and so on and so forth. And it then has a tendency to turn into a discussion of why CR1 is superior. Or they start to discuss politics and who is the worse politician. And the original intent of the thread is lost. I am not going to tell anyone not to post, but can't you see how such statements are not helpful. Some of us did our research, had very good reasons why we chose the K1 and were willing to live with all the consequences of this. But NONE of us knew Covid would strike, NONE of us knew we will be stuck. And of course people get emotional when they read statements like I listed above. Don't you think we aren't asking ourselves if we were idiots for doing K1, if we made the wrong choice?  Even if we had all the info and did all the research. I know I do.
Again, I am not telling you not to comment, you have a right to, but maybe, just maybe consider if what you want to post will be helpful, or if it's just adding noise or changing the direction of the conversation.

    Voilà ! Interview done! 🤩
Still have to receive the Passport but we are closer than ever to being fully together.

For your info, my husband was able to travel to France from California with : a proper Covid test certificate issued less than 72hours before his flight, copy of my passport, copy of our Livret de Famille.

Benedicte reacted to MattyUKtoUS in US Embassies can now process more visas
I just wish the embassies would announce anything even if it is no or that they are looking into opening and what services.

I think also of us could agree that the lack of information is a real pain in the butt... Months have gone by and still we wait hopeful of any words of hope. Even this news does not really mean anything if the embassy is closed or locked down by the local government. I had not seen my husband in almost 18months and was supposed to get back out there in March - It all got cancelled. I just want to go home.

I am not a religious person but I must admit to quietly praying for news.

Stay strong! We will get though this!
