    I just want to add a little twist to this, based on my personal experience.  Although USCIS says derivative conditional green card approval must be "on the same day or within 90 days" to be included on the same I-751, in reality it should say "on the same day of within 90 days AFTER."  Somehow, the dependents conditional green cards were approved 1 month BEFORE the parent.  That's really not supposed to be possible, since the derivatives approval is based on the principal's approval, but it happened.  We filed I-751 jointly, and it was rejected, with a letter explaining that the kids GC dates needed to be within 90 days AFTER the parent GC date.  I was NOT happy, having to pay triple the fee for something that isn't even supposed to be possible.

    That cannot be correct as your post says you received your conditional GC in April 2023. That means it will expire in April 2025 not April 2024. You have input the wrong year at least. As for month and day, I cannot answer but the issue date is on your card.

    It's 90 days (which does not usually calculate to 3 months). You may use the online USCIS Early Filing Calculator to find the exact date your 90 day window opens. 
    You'll have to check the issue dates on all of your GCs.
    If they were issued within 90 days of each other you can file jointly on one I751 but you'll have to pay the various separate fees for biometrics depending on their ages.
    Beyond 90 days, they'll be required to file their own I751s.
    Reading the I751 instructions and the webpage where you find the form (all bullets) will be helpful to you.

    Look at forms. See if you have "parents listed".
    Confirm it's the same receipt number.

    ur kids probably will receive their SSN before end of the year. ur husband can only file for 2023 tax return next year anyway and not this year. if i were u i will wait until end of the year before even think about iTIN

    Like i promised I came back to update whenever there is an update. I posted a question here on Sept 1 if its possible to expedite my AP, i followed @Family told me to email and contact a congressman, my husband and I talked to their representative, i contacted the embassy in the Philippines we waited and i upload proofs in my uscis account too, its a long 25 days for us when we started it and today few minutes ago our Request was Approved! We still have long way to go but pretty excited since we have a lot of planning to do before leaving the country. 
     
    My english is really bad but i thank you VJ for guiding me, we still have long way to go.

    Some key points to remember as you consider your options --
    Your fiancee's K1 visa will be valid for 6 months maximum from the date of her medical clearance.  So if she completed her medical end of March, she has until end of September to travel to the US. A K2 visa must be issued within 1 year of the issuance date of the parent's K1 visa.  Extension to 18 months after K1 issuance was previously in place due to COVID, but may still be allowed at the discretion of the consulate. A valid passport is required to submit DS-160 form for K2 visa, but not required for I-130 petition for step-child of a USC. You and your spouse-to-be will need to have a valid marriage certificate to file an I-130 for your step-child. A Filipino minor traveling abroad without either biological parent needs DSWD travel clearance to be able to board the plane. Your options (assuming your fiance will attend her upcoming K1 interview without rescheduling) --
    [K2 option]  Get PH passport for the child.  File DS-160, book K2 interview, book SLEC medical. Your fiancee and her son travel together after her son's K2 visa is issued and before her K1 visa expires. Your fiancee travels to the US ahead of her son.  You two get married.  Your wife files I-485/I-765/I-131.  Your wife requests expedite for her I-131 AP on the basis of her son's K2 travel.  Hopefully your wife gets her AP or GC within 1 year and travels to the PH to accompany her son to the US with his K2 visa.  @BOKURAGAITA was able to do this recently, with a lot of luck and perseverance -- https://www.visajourney.com/forums/topic/790217-expedite-ap-approved/ If your wife does not get her AP or GC on time, ask your wife's relatives in the PH to apply for DSWD travel clearance for her son to be able to travel without her.  You travel to the PH to accompany your step-son to the US with his K2 visa and DSWD clearance. [CR2 option]  Your fiancee travels to the US ahead of her son.  You two get married.  Your wife files I-485/I-765/I-131.  You file I-130 for your step-child.  Get PH passport for the child.  File DS-260 after I-130 is approved.  NVC sends interview schedule after case is DQ.  Re-schedule interview if necessary until your wife has either AP or GC.  Book SLEC medical.  Your wife travels to the PH to accompany her son to the US with his CR2 visa.  Your step-son immediately gains LPR status, no need to file I-485.

    We are panicking since we didn't expect to have an emergency that cost us a lot at the same time of filing their AOS. There are 3 kids that would cost us $3,420 and if the fees increase then this would take us a little bit longer (few months) to file. If this would be our only option (file late) for few months only is there any other forms to submit? Will they handcuff our children? I' will submit a copy of my NOA's and GC and SSN and a letter explaining why we failed to file before 90 days.

    I don't know exactly but as far as I can remember my husband told me the only border near from where we live is the Canadian border like an hour far. My children go to school and only go to the beach and parks on the weekends, so far that's our routine. And thank you, we still have another week to think about it and do the best that we can.

    So instead of $3400, if you choose to delay, you are potentially looking at $8000+ to file their AOS, plus the small chance that if law enforcement wants to see evidence of the kids' legal status in the US, they won't have any.

    @BOKURAGAITA by delaying AOS you can potentially expect:
    - Higher filing fees in the future
    - Legal fees, as this may not be DIY in the future
    - More stress, more wait and uncertainty
     
    So if you can sacrifice something else to file this on time, you probably should

    No, they will not handcuff your children.
     
    Do you  live in an area near a border?   VJ tends to recommend that if people cannot file for some reason, that they should “lay low” to avoid being detained by the border checkpoints.

    They probably won’t… but do you want to take that chance?  Also, the fees are set to DOUBLE so what if you have another emergency? 
    you should not put this off any longer. Make sure you move heaven and earth to make sure your children have the correct documents to live here…

    Don't delay filing the kids' AOS. Borrow from friends, use credit cards, work extra shifts, whatever you need to do to file that package.

    u actually can use marriage certificate as legal document to fill ur AOS application with ur married name. since it's already hapened nothing u can do. either pay $540 or wait till citizenship.

    My wife has used her GC and now US Passport in her married name and her Russian passport in her maiden name for years and it has not been an issue.  You can change it on the GC as @Misscloud stated by filing an I90 and paying the fee.  If you are getting a 2yr GC, you can change it at the I751 stage, or if you plan to naturalize, you can change it then.

    i assume u have 2 years GC. so  90 days before ur expiring date on ur GC u have to file for removal of condition ( i-751)  
    90 days before ur 3 year anniversary of ur GC date... resident since ( not ur married date, thats unrelated) u can apply for citizenship

    It will be based on the date of the GC approval, not the date of marriage.  So if your GC is approved May 1, 2023 (just an example), you can apply for citizenship 3 years less 90 days from that date.  When you get your actual GC, look at the residence since date on it and add three years.

    Yea, I didn’t get any answer from USCIS either than “This is the official letter sent by a field office, follow the mailing instructions in the letter”. When I asked about the “if you are a k1 visa holder, disregard” part they said “Unfortunately I can’t decipher this part for you” and “I don’t know if it means you can ignore the letter”.

    You'll need to apply for EAD at least and be approved before a K2 is eligible for SSN.
    Or GC (apply and be approved).
     
    K2s are not like K1s and aren't eligible upon entry.
