  1. Hi I am needing some help. 
     

    I received an RFIE for my husbands I864 - it is asking for all the same information we had already sent them. 
    and then Also and RFIE for my joint sponsors I864 again asking for the same evidence that was sent in the original packet. 
    it also states that based on the sent documents that our joint sponsor isn’t qualified. She is an American citizen and earns over $70k well over the poverty line. So I’m unsure what they mean by this. 
     

    Also we are now unsure if we need a joint sponsor as my husband earns over the poverty line this year. But hasn’t in his last 3 tax years. (This is why we originally had the joint sponsor as we thought it went by this.) 

    but if we go by this financial year and send his payslips will we not need the joint sponsor?

    We will have already been living in NZ for a year by the time we have applied so we would still be in the same posiion with the income. I have a house in the states and all my family is there so i am sure someone will help sponsor in need be. 

    Also if we got secretly married, dont you need to supply evidence of a wedding and testamonys from friends and family? i dont think this is an option for us anyway.

     

    What i am concerned about is if USCIS find out i am applying for a permanent resident visa in Australia will that affect my spouse's application? They might see it that we dont have intent to stay in the USA?

     

     

  3. Hi Guys, 

    So my partner and I are trying to decide on whats the best visa for us to go for. We are definately thinking the CR1 over the K1 but not liking the time apart. Were currently living in NZ and my visa expires in November. We will get Married this year but not until later on in the year as we want our families to be here for it. So if we apply for the CR1 at the end of the year it will be quite some time we will be spending apart. Then we thought is it possible (my partner is from Aus) if i applied for the partner visa there, that way i can go and live with her, whilst the CR1 is being processed. Has anybody done this or know if this is even possible to both apply for visas in eachothers countries at the same time?

  4. Hey guys,

     

    I (American) am looking for some advice for my partner (Australian) and I to figure out our next steps and what our best option(s) might be for our situation. We are currently lving in New Zealand on working holiday visas and plan to head to the States after our time here is up at the end  of the year. We are planning to get married anyways but are unsure whether we should go the route of the K1 visa or get married before heading back to the States and go for the CR-1. We have done alot of reading and are getting mixed results. Ideally we dont want to be apart for months. 

    Is filing from abroad for both visas possible?

    And what is the current wait times for the CR1

    also with the DCF what do we need to qualify?

     

    any help or advice would be much appreciated.
