JonSeattle reacted to SusieQQQ in USCIS agent Verbally Denied my AOS at Interview
I’m sorry, this is why there is so much skepticism here about lawyers.
By the way: my understanding of why you got to interview is this: (1) i130 was approved because the basis of the petition was valid - that’s all they look for (2) now I stand corrected on this but on my understanding lockbox can only reject i485 for a technical factor (wrong fee, not signed, outdated form etc), and a decision to deny a petition or adjustment application can only be made by a qualified immigration official. They could have done that at a later stage without you coming in for interview, but, it sounds to me like the guy wanted to check that your wife had not become a citizen in the interim, which would have allowed you to adjust. In other words, they didn’t want to reject you before being sure there was no alternative. This view is backed up by what you say the guy said yo you at the end. So rather than being angry, maybe rather look at it from the perspective of a guy who was really trying to help you get there.
Hopefully your wife can naturalize relatively quickly and you can file i485 again. Good luck.

Too bad the OP left, I would like to know where he eventually finds people with personal experience of getting married in all but sex prior to arrival on a K-1.

JonSeattle reacted to fezlopez in K-1 expedite request ("national security")
Last year, I was an active duty Soldier, and working directly with COVID-19 infected Soldiers daily but in-non medical capacity (but I was a medic). I had a serious drinking problem (even enrolled in drinking program), and taking anxiety/depression medicine. The stress got to me. I considered submitting a similar request. I asked my immigration attorney for counsel, this is what he advised I submit at the time:
1: Submit letter(s) by supervisor or superior detailing your a)duties, b)impact/value to the mission, c) and their support toward anything to make your mission-critical job easier (ex. having your family here, allowing you to see your doctor, etc.)
2: Submit letter(s) by physician or medical provider detailing your condition, and treatment plan(s)
3: Submit letter by YOU, detailing your job duties, how the stressors/factors hinder your job capabilities and how having your family here will aid you (in any way, ESPECIALLY toward your mission-critical mission & health/mental health as detailed by your physician).
4: Any letters by other peers/coworkers detailing your duties if you wish.
Whatever you do, just try. I kick myself for not doing it now. I had too much pride and thought the gov't wouldn't entertain my request. But I'm better now!
Hope this helps!

JonSeattle reacted to PP31 in AOS Interview scheduled at old address
Here's my timeline :
11/05/2020 - Called USCIS and requested to talk to Tier 2 officer - opened an Service Request
11/06/2020 - Received an email that the request was closed as they couldn't contact me - but they didn't
11/09/2020 - Opened another SR to talk to a Tier 2 officer
11/16/2020 - Tier 2 officer called and said that we need to interview at our home state, but I could take a chance and go to North Carolina. So I requested to reschedule interview at Dallas, TX.
11/16/2020 - Received an email with a Referral ID and that my request was submitted to NBC
11/17/2020 - Received an email - my request to reschedule interview has been forwarded to a scheduling department
11/17/2020 - Received an email with my Case status: Testing and Interview and now it has the status - 'Request to reschedule my appointment was received'
12/31/2020 - Received an email and an status saying 'We cancelled your interview'
12/31/2020 - I-485 updated to ‘Case is ready to be scheduled for an interview’
01/12/2021 - Interview was scheduled (received an email as well)
So in comparison to all other fellow Dallas filers who had their interviews scheduled, I feel that my scheduling of interview was delayed by a month. It isn't a very long wait. I'm sure that I wasn't bumped to the end of the line. It probably took them that long to move my file to Texas with holidays and what not. Hope that was helpful.

JonSeattle got a reaction from JeanneAdil in Immigration officers came to my home but...
Is that really true? He is permitted to stay as long as his AOS is pending. I would expect the next step will be that is application for AOS will be rejected, but then he will have time to appeal. Won't a hearing be needed for a judge to issue the deportation order?

JonSeattle got a reaction from HolaHola in January 2021 - AOS Fillers
We originally filed in early November, but it was returned because I needed to add an I-944 for my K-2, who is 10 years old BTW. So we refiled end of December and got our NOA1 last week. I think it was fast for the second submission because there is a slip of paper they give you to add that seems to move you to the top of the pile.

JonSeattle reacted to Greenbaum in Intent to marry
What you saw in the earlier post, the one with all the attachments is overkill. You need a signed letter from the petitioner and a signed letter from the beneficiary. Beneficiary can send via email their copy. You take the two letters and the original RFE and place all three in the envelope that came with the RFE and send it back to USCIS.
Please, please make copies of everything that you are returning including the envelope and keep said copies for your records. Here is the letter you use to answer the RFE. Be sure to substitute each other's name and address where appropriate.

JonSeattle reacted to DaveAndAnastasia in Circumstances of meeting
You really don't need to include very many details there. "We met in *city/country* in *month year* for *X* days" is sufficient (and then attach documentation of this).

JonSeattle got a reaction from Lipquick in Can I request a SSN card thru SS when I have already requested thru EAD?
I'm not sure, but I think the SSN application would not be pending until the EAD is approved. This page has more useful information:

You don't need an SSN to file your taxes. I haven't done this yet, but it appears that you file a W-7 with your tax return, and that will cause the IRS to assign you an ITIN

JonSeattle got a reaction from Chauncey in Choosing a K-1 Fiance or CR-1 Spouse Visa in 2021
I did a K-1 because it got my fiance out of a bad situation as soon as possible. She was interviewed a couple days before the embassy stopped interviewing, and the situation is very different now for other people. We have encountered no problems yet because of the lack of a SSN, and her not working has been fine for us.

JonSeattle reacted to Mike E in K1 Visa & Church ceremony
Completely agree.
My fiancee wanted a couple engagement parties before we left her country. I was neo-fascist on things like:
* dress. While I wore a business jacket to one party, I refused to wear a tie. The second party was business casual.
* poses the photographer wanted. For example, the photog wanted us to pose with a bouquet of flowers in her hand. That was a hard no.I then painted a picture for her of point of entry in SFO a few weeks later, CBP rifling through her phone, and denying entry. She didn't touch a flower the entire night.
That's me: kill joy.

JonSeattle got a reaction from mushroomspore in How to withdraw a joint aos and request a fraud claim on a removal of conditions
If you file of claim of fraud against him, you are going to be exposing yourself to a lot of risk if he starts lying in his defense. From the information in your post, it could be that he just changes his mind a lot, and he could potentially dig up or even fabricate some communication that casts you as being to blame for that. The best thing is to get him into a position where he abandons his green card and agrees to a divorce. If you feel that you have iron-clad documentation, then see a lawyer about suing for fraud.

JonSeattle got a reaction from mushroomspore in How to withdraw a joint aos and request a fraud claim on a removal of conditions
This is an interesting article citing a lot of precedents: http://www.i-864.net/suing-on-the-i864-affidavit-of-support My point was that when one side starts bringing serious accusations, you can expect that the other side might well respond.
Here is another set of cases where an accusations of immigration fraud were met with counter-claims of abuse or smear campaigns.
https://cis.org/North/Victims-MarriageRelated-Immigration-Fraud-Tell-Their-Stories
In a lot of these cases, it seems that the hopeful immigrants are putting forward a lot of money to make the transaction happen, so apparently they are not always impoverished.
