My wife is currently in her home country, and our son (a U.S. citizen) is with her. My wife is a permanent resident with a U.S. SSN, but she will not be filing U.S. taxes. She has spent more time with our son in 2024. Long story short, I will be filing as Married Filing Separately (MFS), and since I spent less than six months with my son, I cannot claim him as a dependent on my taxes. However, after doing some research, it seems that I may be able to use Form 8332 to claim him.

Has anyone had a similar experience? Also, is there a way to submit Form 8332 via e-file?

Does my spouse need my written permission to leave the country to go to South Korea? Will the airline/us immigration ask for a written permission? The will fly from California to Korea.

FYI, both my spouse and child are Korean citizens. Also, my child is both a US and Korean citizen.

A month after my wife arrived in the US, she got a letter saying  that USCIS has received her immigrant visa packet. However, they cannot process her packet or produce her permanent resident card until she pays the USCIS Immigrant fee. The total cost is $220. I've never heard/read about this. I thought we already paid all the fees before she was approved for the visa. Did anyone also had to pay the $220 to get the green card? 

I'm unsure whether my wife needs a consent letter to take our son to South Korea. Does she require written consent from me to travel out of the US with our child?

Also, my wife and son have both Korean citizens and will use their Korean passports.

While I was double checking, I read this in page 2 in the ds3053 "Please Print Legibly Using Black Ink Only. If you make an error, complete a new form. Do not correct." 

This is a silly question, but does that mean that I have to write everything down by hand written with Black Ink?

From my research, my wife brings the DS-3053 (also the normal applications to get the passport) to the US embassy in Seoul?

Since my wife and son is in South Korea and I'm the US, how do I get the DS-3053 notarized?

My 6 year old son is in South Korea. His US passport is about to expire. My wife is a Korean national. Is it possible for my son to renew his US passport with me being present in South Korea? Do I need to show up in the US embassy?

My son will enter the US with his US passport. He is a dual national for both Korea and the US. When he enters the US, he will have less than 6 months in his US passport. I know for a fact that he can't be refused entry in the US because he is a US citizen. But my concern is him leaving the US. Can he leave the US with less than 6 months in his passport? Also, he is going back to Korea and he will use his Korean passport to reenter Korea.

My wife's visa has been approved for her CR1 visa. However, she needs to return back to her country after a month in the US. She will come back to the US after a couple of months later, but I'm worried that US immigration or the airline will give her issues because of a return ticket back to her country. If I understood, once she enters the US, she needs to stay in the US and needs permission from US immigration to leave the country because here visa can be revoked. Is this a concern that my wife and I should be careful about?

Is there anyone else who can answer this because it seems like there is no correct answer?

It seems like getting the correct Australian police certificate is all over the place. 

Did anyone here got approved just with the digital certificate?

AFP started giving digital one just one year back coz of that may be coz of that 

The issue we have is that we don't have anyone in Australia that can send it to us. So it seems like we have have to get the digital one accepted.

How did your's got rejected for a second time?

Here is our current situation:

1) My spouse (beneficiary) is a Korean national.

2) She studied/lived in Australia for 11 months.

3) We passed the NVC stage because I wrote a letter with a picture of the instructions stating she doesn't need one because she lived in Australia for 11 months.

4) She lived in Australia in 2002

5) She doesn't have any ties to Australia except some certificates.

6) We are currently residing in South Korea.

Just encase she gets asked for one in the interview for one, we want to be ready. Also, I also read other people who got the Australian Police Certificate had a lot of issues because the NVC didn't accept it even though they followed the instructions.

I have a couple of questions:

1) How does she get the 100 points of identification when she only has a Korean passport? What other documents can I upload that will be accepted?

2) Do I have to click number "33 - Immigration/citizenship"?

3) Can I submit a digital copy?

My mom and her husband was married has been separated (not legally) for 20 years. They din't live together during while separated. 

He now wants a divorce and hired an attorney. In the papers, it says debt be separated equally. Does my mom have to pay half of his debt even though they haven't seen each other for 10-20 years?

Hi, pease I am in a similar situation. Our immigrant interview date was scheduled next month at the US consulate. But we sent an email to the consulate requesting for reschedule. The reason is that my spouse need to  complete her studies before we can move. However my spouse has been recently granted a transfer study place at a University in US. We then contacted the US consulate telling them that qe want to go ahead with our earlier interview appointmentbfor next month, but the Consulate replied you that they haven't received our case file from NVC yet. We are now confused on what do it. Please any advice will be greatly appreciated. Thank you in advance

Do you know that after the interview and your visa has been approved, you have 6 months after the medical checkup to enter the US? This might help you. Also, you can enter the US(any US territory including Guam, Saipan, Puerto Rico) with  the visa and then leave the next day. You then have a year to re-enter back to the US.

My concern with my post is that I might not be in the country

This might be a silly question, but what is the best way to tell NVC to delay until a specific date? The last time I tried to contact NVC, they replied to me 2-3 months later.

We live in South Korea. We submitted our documents to NVC at the end of February, 2023 and was approved before April, 2023. So it took them less than a month to approve.  However, we didn't get the interview date yet. Just incase we have to delay the interview date, is it possible?

I tried looking for the instructions, but I couldn't find anything on what they mean about Photographs.
