    So our interview scheduled in the wrong state thrice. The tier 2 officers didn’t help either. So I opened a request with a member of congress from my jurisdiction. They reached out to USCIS. I had to email all the evidences of address changes and the People working at the congressman’s office followed up with dallas field office and NBC too to make sure my file was redirected to the right office. They said that I’ll be contacted by the local field office for the interview and asked me to ignore my scheduled interview at the wrong state. 
     
    Almost a month after I opened that request with the congressman, a local field officer contacted me directly and asked us to come for an interview the next day.

    I was under the impression that we could only apply for ROC 90 days before the expiration of the GC, but I was told at the I-485 interview that we can apply it after our second wedding anniversary. Is that really the case?

    They'll deny it if you file too early: "until today when i received another mail (Decision) from UCIS stating that i applied earlier than the 90 days window. Hence, i'll have to put in a new application with fees again."
     
    Only in the following scenarios can it be filed earlier: https://www.uscis.gov/sites/default/files/document/forms/i-751instr.pdf "Filing with a request that the joint filing requirement be waived or individually filed. You may file Form I-751 without your spouse if they are deceased, you are divorced, or you and/or your conditional resident child were battered or subjected to extreme cruelty. You may file this petition at any time after you are granted conditional resident status and before you are removed from the United States."

    That is incorrect. See 8 CFR § 216.4(a)(1): "Within the 90-day period immediately preceding the second anniversary of the date on which the alien obtained permanent residence, the alien and the alien's spouse who filed the original immigrant visa petition or fiance/fiancee petition through which the alien obtained permanent residence must file a Petition to Remove the Conditions on Residence (Form I-751) with the Service. The petition shall be filed within this time period regardless of the amount of physical presence which the alien has accumulated in the United States. Before Form I-751 may be considered as properly filed, it must be accompanied by the fee required under 8 CFR 106.2 and by documentation as described in paragraph (a)(5) of this section, and it must be properly signed by the alien and the alien's spouse. If the joint petition cannot be filed due to the termination of the marriage through annulment, divorce, or the death of the petitioning spouse, or if the petitioning spouse refuses to join in the filing of the petition, the conditional permanent resident may apply for a waiver of the requirement to file the joint petition in accordance with the provisions of § 216.5 of this part. Upon receipt of a properly filed Form I-751, the alien's conditional permanent resident status shall be extended automatically, if necessary, until such time as the director has adjudicated the petition."

    Very happy for you!! Contacting Congressman definitely helped your case. When I started to read the message i was heartbroken to hear that CIS made a mistake 3 time!! But in the end i am so glad you had a quick interview and instant approval as well. Congratulations!!🎉🎊

    Here's my timeline :
    11/05/2020 - Called USCIS and requested to talk to Tier 2 officer - opened an Service Request 
    11/06/2020 - Received an email that the request was closed as they couldn't contact me - but they didn't
    11/09/2020 - Opened another SR to talk to a Tier 2 officer
    11/16/2020 - Tier 2 officer called and said that we need to interview at our home state, but I could take a chance and go to North Carolina.  So I requested to reschedule interview at Dallas, TX.
    11/16/2020 - Received an email with a Referral ID and that my request was submitted to NBC
    11/17/2020 - Received an email - my request to reschedule interview has been forwarded to a scheduling department
    11/17/2020 - Received an email with my Case status: Testing and Interview and now it has the status - 'Request to reschedule my appointment was received'
    12/31/2020 - Received an email and an status saying 'We cancelled your interview'
    12/31/2020 - I-485 updated to ‘Case is ready to be scheduled for an interview’
    01/12/2021 - Interview was scheduled (received an email as well)
     
    So in comparison to all other fellow Dallas filers who had their interviews scheduled, I feel that my scheduling of interview was delayed by a month. It isn't a very long wait. I'm sure that I wasn't bumped to the end of the line. It probably took them that long to move my file to Texas with holidays and what not. Hope that was helpful.

    We got our interview notice in the mail today which is 7 days from when the status changed to interview scheduled.   Today is 1/23 and the interview is scheduled on 2/23...   one month out. 👏🏻👏🏻👏🏻👏🏻👏🏻👏🏻...   very exciting.

    Hello, i am so sorry i was gone for a while. There were no notifications in my email hence did not notice your question! 

    Dallas CIS is quite professional yet friendly. My interview was at 9:00AM. It took about 15 minutes to pass security after getting in line. After being fingerprinted, we were directed to 2nd floor where there is a waiting lounge. We waited about 1.5 hours to be called. We could use our phones, but kept them in silent mode. When called for interview we turned the phones off. After taking oath, I was asked all yes/no questions in i-485 form, where i met my spouse and if it was arranged or love marriage. Officer asked for 2019 tax returns and said she had everything else on file. We wore masks all through.Towards the end she said that she will review the documents and if anything else is needed we will be notified via mail else we will receive card in 2-3 weeks. Same evening status updated to card production. Our lawyer received the card on Dec 10th. The wait was stressful but   Im glad it’s finally over. 
     
    If you recall my interview status showed that it was cancelled. But there was no issue on that part. That probably was a glitch with online update.
     
    I pray that you all get done with this process soon and relax. But to be honest other than the killing wait time its not bad at all once your interview is scheduled. I had my card within 10days🙏🏽

    EAD/AP Expedite Timeline in detail for whoever has the patience to read:
    01/09/2020 – Made the Expedite request on phone (I-765 – Severe Financial loss and I-131 – Humanitarian grounds)
    01/10/2020 – Case status updated to - We received your request for expedite processing
    01/10/2020 - Received 2 emails requesting to fax additional evidence for I-765 and I-131. Faxed the evidences within 2 hours of getting the emails.
    For I-765 faxed – mortgage statement of Dallas house, HOA agreement that we can’t lease the house, my Charlotte Rental agreement, Car insurance, Phone, Utility, Internet, Electricity bills, and then detailed the expenses of my husband who lives at a different place – his rent, his car loan/insurance, utilities etc., copy of my H1B extension NOA, copy of my W2, copy of the client letter at the company I work which states my responsibilities and the duration of my contract
    For 131 faxed – death certificate of my mother, Excerpt from internet detailing the religious ceremony that’s performed for the first death anniversary of immediate family members
    01/10/2020 – Saw these three updates for both – I-765 and I-131:
    On January 10, 2020, your request to have your case expedited, referral number T1B009XXX2MSC, was completed.
    On January 10, 2020, we sent a response to your request to have your case expedited, referral number T1B009XXXXMSC.
    On January 10, 2020, your request to have your case expedited, referral number T1B009XXXXMSC, was assigned to an officer for response.
    01/14/2020 – reached out to Congresswoman and Senator, requested them to follow up with USCIS regarding my expedite requests
    01/14/2020 – Congresswoman Rep sent a privacy notice (didn’t hear anything from the Senator’s office)
    01/15/2020 – Signed and sent back the privacy notice to Congresswoman Rep
    01/15/2020 - Congresswoman Rep contacted USCIS
    01/22/2020 - I-131 Case status updated to – Request for Additional Information Received. No updates for I-765
    02/03/2020 –Made an Infopass appointment – they asked me to come back a week later with additional documents if I still needed an emergency AP, in case I don’t receive my EAD/AP by then. They also said that it would cost $575 but they’d be able to issue it the same day. (at this point I almost gave up because even if I’d get the emergency AP, if I travelled, I’d lose my H1B status because of my pending extension and I’d lose my job)
    02/03/2020 – Contacted Ombudsman (why not! at this point I had nothing to lose)
    02/03/2020  - Contacted USCIS and requested them to open a Service Request for the expedite requests of both the cases (at this point I was really desperate). Saw this update for both the cases:
    As of February 3, 2020, your general inquiry, referral number OVPXXXXXXXMSC, is currently not assigned for processing.
     02/04/2020 – Received an email from Ombudsman, asking for proof and I emailed them the evidence in an hour
    02/05/2020 – Congresswoman Rep called and asked for documents related to the religious ceremony that I’m supposed to attend. She said that the person from USCIS said that they do not have enough evidence to make a decision. So I sent her some more documents  - Copy of Invitation of the memorial service for my mother, death certificate, Excerpt from internet detailing the religious ceremony that’s performed for the first death anniversary of immediate family members, the invoice of the venue booked for the memorial service
    02/06/2020 – Received email from Ombudsman saying that they reached out to USCIS
    02/06/2020 – Case updates to - New Card is being produced for I-765 and received the email from Congresswoman’s office saying that USCIS approved both my cases and a combo card was going to be issued
    02/07/2020 – Received email from Ombudsman that USCIS issued a decision yesterday 
    02/07/2020 – I-131 and I-765 updated to Case was Approved
    02/10/2020 – I-765 updated to Card was mailed to me
    02/11/2020 – I-765 updated to Card Was Picked Up By The United States Postal Service along with a USPS tracking number
    02/12/2020 – Requested USPS to hold the mail at the Post Office because I didn’t want to risk having any issues. Finally collected my Combo card!!!!!!!!!
     
    God! it was an intense/stressful month!!!!!

    Hello all!! i had my interview today at 9:00 AM and status updated to Card Production just a while ago. Hope this means good news. I pray that your cases move quickly and that you hold your gc’s soon!! Just to recap my PD is Oct 2019.

    Hi, very sorry about that. USCIS is really messy with address updates. But are you not able to travel to Charlotte for interview? I think on approval your GC will be mailed to current address.

    Just got an email saying that an Interview was scheduled. I think that was why I got that message/email earlier this week. Since that’s when they scheduled...
    Waiting to receive the mail.
    anyone else has that update?

    Have been waiting for an interview since February here.
     
    It looks like the Dallas office is interviewing those who filed around September 2019 right now.

    You can compare their filing date to the interview date.
     
    From what I've seen it looks like they're finally starting to reschedule interviews for those who were originally scheduled before quarantine and got their interviews cancelled.

    1. You can let the congressman know that your expedite request has been approved but haven’t received anything. They will follow up with USCIS if they find your case genuine. There are people designated specifically to work on Congressman requests at USCIS. In my case, it helped because the person working at the congresswoman’s office talked to a USCIS rep 20 days after I reached out to them, who followed up with the officer that had my case file and got my EAD approved the next day.
     
    these days with the covid issues I don’t know if they have enough bandwidth to do this.
