    The previous COVID proclamations didn't even mention "quarantine." It just said those inside XYZ country/area in the previous 14 days cannot enter if not exempt. They said nothing about the traveler's activities inside the unrestricted country (e.g. Mexico, Serbia, Croatia, Turkey, Hong Kong, Macau, South Korea, etc.).

    Hopefully they stop using that excuse. The proclamations are explicitly only about entry to the US, per the law.

    Yeah, and this is what the lawyers say in an FAQ for people considering to join the lawsuit:

    If the court allows additional plaintiffs to be added to the complaint, new plaintiffs from the proclamation countries can expect to benefit immediately from the injunction. In other words, the government will not be allowed to rely on the proclamations to stop processing or adjudication of their visa applications.
     
    New plaintiffs from non-proclamation countries, on the other hand, are much less likely to benefit from the injunction that is currently in place. They may benefit in the event makes future orders regarding unreasonable delay and they may want to consider filing individual actions. Any of the law firms co-counseling on this case can handle individual cases and you might consider setting up a consultation with one of them to discuss this option.
     
     
    And for those who live in a banned country there's the possibility of being allowed to travel directly to the US IF a national interest exemption would be granted. I wouldn't count on it, though, but you never know...
     
    Also, for those in countries subject to 14 day entry bans, we are arguing that the law that is the basis for that proclamation is not meant to cover the issuance of visas and we also are arguing that the government should create a national interest exemption similar to what they have done for other immediate relative cases.

    You bring up some good points! I think the uncertainty has been the worst part in all of this. And it must be super hard on you and your fiancé to be sooooo close. I wish you luck in whatever path you choose!

    Either way... I wonder if it's any "point" in joining the lawsuit now. I emailed the lawyer and was put on a list to receive more information about it, so me and my fiancé will at least discuss it when we know more. But I'm thinking too that it was mentioned in the news not too long ago that several agencies within the Trump administration were talking about lifting the travel ban for Europe (and maybe Brazil too if I'm not mistaken)... it just feels like such a gamble either way and I don't know what the best thing to do is... 😶

    I have not been assigned an interview date yet as we have not yet mailed the p3 back to the consulate(tomorrow we will!).
     
    I won't comment on should you join or not to avoid rulebreaking, but it's a gamble, yes. With that being said, I personally don't think the travel bans are going to be lifted ANYWHERE prior to Jan 20. The most realistic scenario I'd think is the government processes all non-plaintiffs in "banned" countries as a result of either A) more plaintiffs coming on board B) the US attorney gets through to them that what they are doing is (likely) still illegal. There's going to be another status conference with the judge, but that won't be until after the newyear.
     
    But I hate speculating and we all know how unpredictable these people are.

    Look people, we are all in the same boat....all frustrated, all tired, and all of us want to be reunited with our loved ones. Just stop all the hostility already. Everyone had the option to join the lawsuit. I reached out to the attorneys and they sent the information to join. We read the documents, looked at the cost and talked it out. We decided to save our money and wait it out. Those that are involved in the lawsuit have paid to get their cases heard. Common sense is going to tell you THOSE are the cases that are going to be looked at first as other cases are not in these attorneys hands. With everything else going on in the country right now and the election that is going to make or break this country ahead of us, I'm struggling to find a sense of unity between this unique group of people. My fiancé and I are almost 11 months into our process and haven't seen each other in 9 months. So many of you are even further than that. The entire planet is in a state of crisis, our country is in a state of crisis. Why are y'all throwing punches?!?!

    Its okay. No travel ban for Philippines (however they're not letting tourists into the country) and we're still waiting for the embassy to open back up. So travel ban or not, we're all in the same boat of waiting. It really sucks and i totally understand the frustration. We're over this virus and waiting 😅 
    I think if it wasn't for this virus, mostly everyone in this thread would be married by now. 😕

    Hey guys,
     
    Hope everyone is doing okay.
     
    As far as I can tell, our case arrived to the Bogota Embassy back in April. Since my fiancee (Venezuelan) now lives in Ecuador, I've been trying to send the case to the Embassy in Ecuador for months but kept being told that everything was shut down because of the pandemic. Finally on September 3rd I was able to get in contact with someone regarding the transfer. They told me in normal situations the transfer request may take two months. At the end of September they told me that they requested our case from Bogota but couldn't give us a timeframe as to when it will arrive. I followed up two weeks ago and they said they're still waiting for the case to arrive. I followed up again yesterday and they are still waiting. Our CEAC status has said "Transfer in Progress" for since the end of September. 
     
    Hopefully the case will be received soon but I have no idea if the case has even left the Bogota Embassy. 
     
    Hard to believe it's already been a year since I started preparing to send out the petition. 
     
    Anyway, just wanted to give everyone an update. I know my situation is a bit atypical but hopefully this helps someone.

    K1 here. We got our NOA2 at the end of last year and because of my fiancé’s work and Corona, never had time to schedule the interview. We have been extending the NOA2 twice already this year and were “up for” another extension next week. However, this time the answer from the embassy was different. Maybe it helps someone else who’s also K1 and waiting for the embassy to reopen 😊
     
    This is the reply I got this time:
     
    “NOTE: Per new guidelines, the I-129F petition remains valid and can be re-validated at the time of applicant´s interview. We are unable to provide a specific date for when the U.S. Embassy in Stockholm will resume K-1 visa services, or when the U.S. Embassy in Stockholm will return to processing at pre-COVID workload levels, but please be assured that we will resume K-1 visa services as soon as possible while complying with operational and travel regulations and restrictions.   We strongly encourage applicants to monitor our website regularly for the latest information about the Embassy’s operating status and any further updates: https://se.usembassy.gov/visas/immigrant-visas/ “
      Meaning, there is no longer any need to send in new evidence and ask for an extension, have you already gotten your NOA2.

    I'm happy to report that our case status changed today from "At NVC" to "In Transit." 🥳We received our NOA2 in mid-March, our case number was assigned in early April and our embassy is Sarajevo, Bosnia. Wishing everyone positive movement!! 🤞
