    I had my interview. Everything went well. Officer recommended approval and I'm waiting to be scheduled an oath ceremony. STL field office. They do not do same-day oath there.

    My I-751 got approved without interview, and I received a 10 year GC in the mail. Still waiting to hear back for the N400 that I filed in November 2022. Current status is "actively being reviewed" since I filed.

    To maintain your residency to naturalize  you must not be out of the US for more than 180 days at one time (note not 6 months). If you are out of the US for more than 180 days you need to wait 5 years to re-apply for the n400. A reentry permit will save your green card for stays out of the US more than a year up to 2 years but will NOT maintain your continuous residency for naturalization.
     
    To naturalize, don't be out of the USA for more than 180 days at one time and you must be in the US for one day more than 30 months during the past 5 years up through your oath ceremony.

    Sounds good! Thanks! I'll leave the packet with my wife's family, who all greatly support me, so no chance of sabotage. 
     
    I'll have them send it 2-3 days after the 90 days starts just to be 100% within that time frame.

    No requirement to be physically present in the US to send in the I751.  You can either do your plan, prepare the package and have someone else mail it for you, or send it in when you return which would still be within the 90 day window based on your dates.  Just make sure the person mailing the package, if you choose that option, does not mail it even one day early.

    No, the counter starts when they are a permanent resident aka once they have been approved for the greencard. But, since it's been over two years since the beginning of the marriage they'll immediately get a 10 year greencard.

    I-864 is filled-out by the US citizen, and the rest of the forms by the immigrant. In general, send the following four packets (*note that I-765 and I-131 packets are optional, but highly recommended) in the same envelope to the Chicago Lockbox:
    I-485 with I-864 and supporting documents, copy of marriage certificate, electronic I-94 copy, filing fees, etc.; I-765 with electronic I-94 copy, etc.; and I-131 with electronic I-94 copy, etc. They'll separate each packet with rubber bands or fasteners: https://www.uscis.gov/forms/filing-guidance/form-filing-tips
    On the I-485 packet, I-485 payment method (check, money order, or Form G-1450) must be the very first item of this packet.
     
    If they want, the new medical can be submitted after filing. If not sent-in at the time of filing then USCIS will just send a courtesy letter: "DO NOT MAIL DOCUMENTS AT THIS TIME."

    Correct. As the spouse of a USC they can adjust status inside the country. Even in overstay. No I-130 needed (that is only needed if they did not marry within the 90 days of arrival on a K-1).
     
    Leaving now would be the worst decision. The ban would apply. It doesn’t apply until you leave so she should stay. However the second worst decision would be not filing AOS immediately. The longer they delay it, the longer she is out of status and can be deported. Will ICE come knocking on the door tomorrow? Probably not. The chances of a generally law-abiding spouse of a USC being deported for a K-1 overstay are slim, ICE have more serious cases to deal with than that. But it is absolutely possible.

    Hi,
     
    Since the K-1 has overstayed for more than 180 days, leaving would mean a 3 years ban.  If the overstay is more than a year, then leaving would mean a 10 years ban.  Leaving without AP or a green card is just a bad horrible idea.  

    Since they married within 90 days, an I-130 is not needed.  File the I-485 and accompanying paperwork.  Follow the Guides on VJ.
     
    Current status is K-1 visa overstay.  There's no status pending since AOS has not been filed.  Don't go with that lawyer.

    You should fill out your timeline and provide more information regarding your situation, as without more information no one can really say anything. All I know is NVC has been slowish lately, probably due to backlog. Once they transfer to consulate, depends on WHICH consulate.

    If you got a NOA1, and you have a DCF case in London, I'm pretty confident the whole process will be done before 2021.
     
    Most estimates from filing to visa in hand for DCF are location based, but with other offices closing and cases being moved around from closed USCIS field offices, it can take a bit, but definitely not as long as US processing center cases.
    If you don't get any RFEs in either step and issue all documents quickly and correctly, I think you could have the visa by summer.

    Basically anything that shows you’re together is great. Pictures, social media posts from third parties like that congratulation post. It all helps. 5 pages with 4 pictures each is good, so 20ish pictures that show bona fide relationship. As to the deed, doesn’t sound like an issue.

    Not really. Generally the SSA says to wait 3 weeks from date of application (the day of entry or the next day). If you don’t hear anything by the third week, you should call them.
