    To be very clear, the fact that someone has an immigrant petition pending doesn’t automatically disqualify that person from getting a non immigrant visa. Many people with pending immigrant petitions have successfully renewed their non immigrant visas and traveled on them.
     
    Immigrant intent is determined by the consular officer at time of application for the particular trip you’re applying for, or by the CBP officer at the border for that particular visit. You can have immigrant intent for when your immigrant visa is approved but not for this particular visa application or this particular visit.
     
    I just felt I needed to emphasize that.
     
    However overall having displayed immigrant intent for any particular period, now or in the future is a red flag for your non immigrant visa application regardless. 
     
    A waste of time, won’t do diddly squat for his application or credibility, could rather be a red flag.

    I know this is not what you want to hear, but if there's any way to recoup some of your money for the April event by cancelling or rescheduling it, I would begin to do so sooner than later.  I would like to be wrong, but I'm 99+% sure he will not get a B2 visitor visa without an interview, which is the only way the visa could be issued within a month.  Why do I say he will need an interview?   If I understood all of the following points from your posts correctly:
    National of a very high fraud country. Last B2 vIsa issued in Nigeria (I assume). Visa application to renew that visa denied in Nigeria. Immigrated to Canada, first B2 application there, so no consular evaluation of Canadian situation. US citizen spouse, with clear intent to immigrate as soon as possible. All of these issues will be of concern to the officer reviewing the "drop box" application for a visitor visa.  The only way to get those answers and maybe issue the B2 visa is to interview him.

    Can you go to Canada and marry him? I don’t think and April wedding in the US will happen.

    Currently, there is no U.S. plan for refugee status for Ukrainians, only temporary residency for Ukrainians here already. 
     
    The expedite process that has happened already with others, including myself are expedite requests for standard petitions. As far as I can tell, expedites have started getting approved as early as Feb 28, when the war started getting worse. Maybe they can try again if it was requested before this time? As I’m a May filer and just got approved along with others who had much later files as well. Best of luck!
     
    Edit: I found the thread you referred to. Definitely sounds strange when put up against the others who have gotten approved. Some, including myself weren’t even asked for evidence. Just a quick phone call to USCIS.

    Sorry to tell you this but it's just not going to happen.  You are not even in the NVC process yet but even then, it does not matter.  Even married couples are still having difficulty trying to expedite so being a K-1, unfortunately, I don't see any possibilty anytime in the near future.  Wish you luck.

    This question has been popping up a lot in recent weeks. There are reports of failed expedite attempts from members from that region who have tried. Don't think they will expedite based on that, quite unfortunately. If anything, I'd wager they would expedite spousal visas and minor children visas over fiance visas.

    What country are you in? You might be better off in the meantime seeking temporary asylum there and then just plan to have her interview in that country, and stick to the K-1.

    Nope. You are wrong. Babysitting is considered work and people have been denied because of it. There was a news report about this a few years ago. See below.

    Just my opinion, you’d probably have a better chance at success once you have your Canadian student visa. (Admission letter by itself is meaningless, many people get admitted but refused student visas.)

    I'm not talking about you taking care of her right now; that's totally fine and great that you can do that for them.
     
    In the US, you are not allowed to work on a visitor visa. And work does not necessarily mean paid work. If you are doing something that a US citizen or resident could do and get paid for, it's work. So if you will be at their house all day babysitting their child while they go to work, you are considered to be working, even if they don't pay you. Be very careful with this.

    That is incorrect, at least in terms of US immigration. Unpaid activities can be work, and they have enforced it as such. Being paid or not is not the determining factor.
    Taking care of a child is certainly work. Ask any parent.

    Incorrect.......Work does NOT have to be paid......even Grandparents caring for their Grandchildren could be considered work.

    I have friends who married spontaneously on a visitors visa.  It all worked out.
     
    Just to point something out : She had to stay for the entire process which took over a year. She couldn’t work or so much of anything, that was difficult for her, even though she was planning a long visit on her visa. She had visited after  a contract job that just ended. Her mom took care of getting her documents, etc. They ended up traveling a lot.
     
    They filled out the forms on their own but got a request for evidence even using the guides here. If you fill out the forms yourself do it carefully.

    Someone thought it was a good idea to screenshot all of  that users posts and then post them to r/90dayfiance. 
     
    Just be careful when posting your information for your own protection.

    I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.

    First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered.   While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards  those fortunate to have their case dealt with quickly, or  critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!

    Secondly- in the info forums, you may get bad news.  When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed.  However, the emphasis is still on being welcoming and friendly.  If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive.  No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or  illegal actions in the past- instead, encourage and explain legal options for the future.  And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.

    Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums.  But if you feel that way, just scroll past- no need to criticise the OP for asking the question.

    You will have more than an uphill battle. Everything about your relationship looks like fraud.  Marrying on the first visit makes it worse.

    File in April makes sense, move in July 2021 and you will be very close on current timelines, they could lengthen, get a few months of pay to show you meet the I 864.

    May I ask why you are doing a K1 visa rather than marrying and doing a spouse visa? He would be able to continue to live and work in Canada and accrue time (if he needs it from your other post.) He will be able to work immediately when he comes to the US.

    Good luck OP. As you know the issue you face is that immigration intent is assumed and the applicant has to disprove it. The more ties a person had to the US, the more likely it seems that they might stay. It’s sad that relatives can’t see family but that’s just not enough.
     
    The number of people who come to the US and overstay seems high. Marriage to a US citizen cures the overstay so it can be an attractive option to stay, even though that doesn’t apply to you.
     
    I know it’s hard to believe but I recently met a woman who left a baby and husband behind years ago to stay in the US. She didn’t see her son for 12 years. I’m only mentioning it so you know that people make the choice to overstay even when they have compelling ties.
     
    i had an immigration judge as a teacher. Even as a judge he was unable to initially get a visa for his mother to visit from Argentina. He had to work through people he knew to help her get a visa. In doing that he sent a letter that he would support her, but that was only through the contacts he had.

    Even without fake universities/visa mills, it is my understanding that there is a lot of fudging around what people do on OPT. Not surprised they are cracking down/increasing scrutiny as per 3rd post.

    It really is a simple and stress-less process. You do what they ask of you and you wait. Don't compare yourself to anyone else. Everything through this process can be corrected if a mistake is made. You're not the first to be in this position and the others got their visa's and you will too. Just trust the process.

    Living together for a year is different than what most people have as evidence. You should be fine with the evidence you mention because it’s real.
