    Checked the mail today and found that my SSN card was sent to me! Called a week ago for an update and they said it was still pending. Really glad it got to me before my i94 expired. I thought my application wasn’t going to be approved since I had taken my husband’s name but I guess it was fine in the end! Hope you guys get yours soon too if you haven’t already

    1/2: You only need to send photocopy of the marriage certificate. USCIS doesn't need original copy at the time of filing the application. They have mentioned about this clearly in their instruction pdf and discourage to send any original documents unless made specifically for the purpose of the application adjudication. 
     
    3. Yes, do include the last page even if its blank. Every page has page number so make sure nothing is missing when you count them.

    all 3 NOA texts: 8/20
     
    I sent mine without the i-944.

    Yeah I always heard people on here say you needed to do it before marriage but that still seems a bit silly. Like surely they can work around a name change.
    At this point I am just applying for mine with AOS because I am just tired of dealing with it. I hope it doesn't delay me TOO much!

    Sorry about the late reply, we just submitted the AOS paper work an such.  
    Yeah we were able to get an appointment like literally 17 days before his 90 days were up. 
    It took alot. We called alot, emailed the senators office, talked to the senators office on the phone, called the SS office multiple times afterwards. They said they had been doing "research" on the k1 visa -whatever that means but that research took about 2 weeks. Then the office wasn't sure if they were going to be able to schedule guards to be there that day so they had to call us back. Ugh it was a nightmare trying to get an appointment.
     
    But they managed to get guards in time for the day we needed it. He had his appointment and everything went smoothly. Now we are waiting as well for DHS to verify his entry dates. He's called three times and he was told that it could take 2-4 weeks to process.
     
    Ya it's a pain. You can call and ask for updates if you want to.

    Correct! I am getting married this Friday but our health insurance doesn't start until September so if I do the i-944 I can't submit it until then. I have everything ready to go now bar the marriage certificate and I was ready to post it so now I am not sure what to do.
     
    I will be so happy if it takes effect from a future date and would post everything before then..

    IMO FedEx I've used them both times K1 and AOS no issues and great tracking. Make sure you tell them what you want. The USPS  is to be avoided for now due to all the turmoil.

    Just sent the application in today! I’m so glad I checked this thread because I missed a few things, so I did a mad dash of writing in ‘N/A’ and made my husband get 4 more passport photos. So now we wait!

    Hi guys! I am just joining, I send in my package last week, it arrived on Monday, the 10th of August. So far I haven’t received an email. I did send in the I 944 because it took me a while to get all evidence, and I could’ve send in my package weeks ago, if I had known I wouldn’t need the i944. Now the waiting starts and I am seriously a bit worried that it might take forever. I’m living in Alexandria, Virginia now. Good luck to everyone 🍀

    I found this in a news article regarding this issue: 
     
    Dan Hetlage, a spokesperson for U.S. Citizenship and Immigration Services, which administers the public charge rule, said Thursday the agency was reviewing Wednesday's order to "determine the administrative viability of reimplementing" the policy "where applicable."

    I would assume from the wording from the spokesperson that the public charge rule is currently not in effect as they are considering re-implementation. If nothing has changed tomorrow on the website, I am thinking that I will send my package out without the I-944 and include a copy of the I-485 page with the alert saying not to include the I-944 to show that these were the rules that were in effect when I submitted the application.

    It's hard to say much about that particular case. The announcement that an I-944 no longer needed to be sent appeared on the USCIS website only on July 31st (the ruling was on the 29th), according to archive.org's records. The page's last modified date showed the 31st as well.
    So with overnight delivery, the soonest a case could be actually filed with USCIS was August 1st. That's a Saturday, so they won't actually be able to start processing it until Monday the 3rd.
    Having a paper application (I-485 can only be filed by paper) rejected and getting the actual rejection letter stating why by the 13th - 10 days after fist getting it - is unusual.
    Or it had to be at the very, very start of when they got such applications. It's very possible the intake worker didn't get the notice yet or otherwise just forgot about it.
     
    Widow cases are also unusual in themselves with the public charge piece. They need an I-944 but no I-864 is required. When the I-944 was on hold, they needed neither form.
    It's possible the intake worker mistakenly rejected it for lack of an I-864. The actual rejection notice for a missing I-864 or I-944 is the same. It says an "I-864 and/or I-944" was missing. So it's possible they filed the form correctly for that time period with neither form, but the rejection notice says I-864 and/or I-944 still, and they are assuming it was due to the lack of an I-944 when it could have been due to a lack of an I-864 that was mistakenly assumed required.
     
    Either way, I would always go by whatever is currently posted on the USCIS website. When there is reason to believe that is outdated, I would hold off a few days - if possible - until the situation is confirmed.

    I just completed most of my forms today and was hoping to post it out on Friday, without the I-944. I really hoping I wouldn't need to complete the I-944 so I would be interested in knowing what this means now that it seems that the injunction is narrowed.
     
    I hope you won't get an RFE for the I-944 given that the guidance on the USCIS website when you applied asked applicants not to include it. Hoping more clarification comes soon

    Filled it all out, and then decided not to send it in. I don’t want it to work against us especially since I filled it out in a few hours! It was Tier 2 officer and I referenced the conversation. 
     
    Feeling much better now. I do think we made the right decision, though time will tell!

    I saw that you were filling out the I-944 before. So you won't include it? It's too late for me to send it out today but I may send it out tomorrow without the I-944 if nothing changes over night.

    I agree, we will wait to see if USCIS issues any updated guidance to how they will apply this new court decision. In the meantime I found this article talking about the injunction and their interpretation is the nationwide injunction still applies as long is there is a pandemic and that the recent court decisions were in relation to the general application of the public charge rule.

    I’m not sure what to make of it yet but I was also hoping to send my application, without the I-944, this Friday.

    Talked to two people on USCIS, they both said not to include it. We are including it. They can disregard it if they would like...

    Thanks for the link, seems like we still have some hope, but we will see. At this point I dont trust in anything...
