    Smiles..💞💞😊 can't turn my back on a place that gave me support when the greencard wasn't there...when I was broken to little bits...uncertain and scared..yes..I'm the one that tell you it's okay with a smile even though my world is falling apart! I despise negativity with all of me! I fight it with positivity and always win!(STILL WINNING) 😊 I encourage everyone to do the same..stay humble..refrain from being unnecessarily boastful and proud!💁 The best way to be a leader is to serve..not to dictate!👍💞💞💞💞💞

    Agree.
     
    I find it cruel to bring someone over on a K-1 or K-2 and not file to adjust their status.  Letting someone become undocumented is bad.  Letting them become undocumented knowing that the K-1/K-2 petitioner is the only way for them to get a green card is worse.

    According to you, I will never clear the background check since the first expires when they do the third one. And it's not the frustration what people feel and what the immigration love to call it, it is a sense of depression, hopelessness and despair accumulating with years of waiting. These petitions used to take 4 months to adjudicate, not 3 years. I have no crimes on my record here and there. My name is rare. Only 2 guys in the States have the same name. I know they call it a privilege to get anything here. But I want to hear yes or no, since it's a matter of principle now, because now I know that the immigration services have departed too far away from the laws they adopted themselves. They just want us out. Once it was a service, now it's not. You know what it is now.

    Your and your daughter safety is the most important thing, be thankful to God he is out of the house with the help of the social service and police, when official are involved abuser know better. If you don't feel safe start seeking for a new place. God bless and have peace.

    Sup... I have a pending i485 from my spouse and now am in my vawa process.. I filed vawa September 20th 2018 , and same September I had my i485 interview without my spouse , I took my vawa receipt from USCIS and also a copy of the vawa package that was filed to the i485 interview and explained to the interview officer that I was in an abusive marriage and now I have filed for vawa , I gave him the vawa receipt notice and copy of filed vawa and I told him to pls put my case in abayance /leave my i485 pending and he did left it pending.... advantages of a pending i485 is 
    1) you can still apply for EAD or renewal of EAD  and get it under C09 category 
    2)once ur vawa gets approved you would need to pay or reapply for another i485
    3) its helps you to get ur green card faster after your vawa gets Approved due to you were previous on queue for interview b4 you went and and the i485 to be on hold or leave it pending by the officer... after vawa approved they just put you back in the queue of your interview for i485 then you go and get your green card.. this is the little I know ...

    AOS Case update notice on April 9th, 2020, waiting for mail.
    Interview date: Scheduled as of July 15, date is August 19.
    I think I got it like last week.

    Just FYI - USCIS will accept any complete package and relatedly cash payment attached regardless of whether or not you are eligible, used the wrong forms, etc. There's a no refund policy as well. So sending it and having the check cashed is to be expected. 
     
    Based on what you posted it has no chance of being approved.
     
    A k visa holder can divorce/remarry or marry a different USC but would need to fill out the 130 and then probably a waiver depending on any overstay before doing consular processing abroad. If done correctly they would only leave the US right before the consulate appointment and be 99% confident that they will be returning with in 1-2 weeks. They would have no status in the US during the process though and could be detained.

    If your spouse  did not withdraw the I-130 then the I-485 is still pending.You still can get a letter to attend the interview with your spouse , and if this happen you must go witht him/her and ask the officer to put the case on hold until final adjudication of your I-360, but if your spouse withdraws form I-130 then just refile I-485 right away, DO NOT REFILE form  I-485 now because your AOS is  still pending.

    I don't want to diminish how severely immigration fraud impacts everyone who follows the proper, legal steps to immigrate . . . BUT . . . you say that you have access to their social media and have a wedding invitation suggesting your are more than a casual acquaintance to this couple.  If you are comfortable with your motivations to report your friends, are you confident of the facts surrounding their case and their intentions.  If you are wrong, your report could have a long-lasting impact on your friends' education and lives together.  If they are making statements on social media that show an intent to commit immigration fraud, the CBP may also access these statements at the port of entry.
     
    Before reporting them, perhaps direct them to Visa Journey or other immigration resources so they can make a more informed decision about their immigration intentions.  As noted previously, the student visa has been used legally so far and the couple can marry while she is a student. It is what they intend to do after the marriage that could be problematic.  Their intent to commit fraud in the future may be out of ignorance of the law rather than willful manipulation of the system.  If you have not done so already, help them first and report them (if necessary) second. 😃

    How can you or anyone prove that? Most fraud cases has been caught after the fact. As of now it is all intentions and can change at anytime. There is no solid evidence of a fraud - in my opinion. 
     
    This is like reporting someone who are on their way to buy drugs. They didn't really buy the drugs yet and not even arrived. Even if they arrived, they could change their mind last minute.

    Good Morning Everyone, 
     
    I was going to use this response for another post I read this morning but felt it needed it’s own post. 
     
    I know that this may not be the case with all couples but counseling is an option when you notice the relationship going downhill. The divorce rate in this country is partly due to finances but in my opinion also due to people not working out their differences. I have been married 7 years this past April and the truth of the matter is that:
     
    1. Immigration is stressful in the best of times, let alone now with the pandemic. 
     
    2. When two people get to know each other and want to live together you find out each others quirks and that is not always fun.
     
    3. Every person has gone through some type of trauma, whether it be due to fractured relationships growing up, living in poverty, or living in a war torn country. 
     
    I will share of my woes in my relationship over the years. When my now wife and I started this immigration process it was long and stressful. I was the detailed passive person and she had/has a strong personality. Suffice it to say this did not help during the process from K-1 submission to point of entry (POE). 
     
    Once I entered the United States and got married, this is when the hard work started. We lived together and we found out each others quirks. I was still the detailed person who stressed getting my Adjustment of Status (AOS) in on time and this put a strain on our marriage as we had the finances, it was just a matter of putting it into our budget, but I still worried about getting it in on time. Oh, and not to mention I could not work from April to September 2013, that did not help the bottom line, hence more stress for her as she was sole bread winner, but also stress for me as I did not have a driver’s license and did not like being cooped up in the apartment. We kept trudging along and trying to work things out, me and my anger (I’ll get to that later). We went through some rocky time during AOS. 
     
    Before getting married my wife knew that I had children from a previous relationship but this would not hit her in the face till my son came to visit for a summer. We have dIfferent parenting styles still to this day but are working through things. When my son came to visit ####### hit the fan and this had to be worked out. My son’s grandmother, also s strong personality, had made my wife to be out to be the bad guy. Naturally, being passive, I did not stick up for my wife, so there are still issues there to this day that I am working through. 
     
    Fast forward to 6 months after receiving citizenship. Wife and I were going through some very rough times and my anger had really resurfaced and become uncontrollable. It got to a point where I had to take 2 weeks to think outside of what was going on in my own home due to the chaos that I felt as I had my issues and my wife had her own issues. I took two weeks and continued working but also went to see family in Canada. In that two weeks I made a decision that my wife and I needed to do counseling because our issues are more than we can handle on our own. We are currently in counseling and doing much better. 
     
    I say all this to say, before you even put in a petition for a fiance(e) or spouse, get to know the person, who they are, and their family dynamics as much as humanly possibly. If it turns out that you notice quirks before or after they arrive in the US I would encourage you to seek out counseling. This will look different depending on whether you are in the US together or separated. In my time of getting counseling so far here is what I have learned:
     
    1. I cannot control other people, I can only control myself.
     
    2. If left unresolved, my past hurts will spill over into my relationships (familial, friendship, and professional). 
     
    3. Marriage takes a lot of work (active listening, embracing others strengths, knowing that my spouse and I may say different things but both be right and that there is healthy conflict).
     
    My hope is that this post may help one person to think through the fact that maybe its not your spouse that bothers you, but the memories of your past. If you have read this long, I wish you all the best on your immigration journey and marriage. 😁

    I personally do not think this will affect us K-1 people. I honestly feel as though he is just trying to curb those who are coming here strictly to work. Just my interpretation though.

    To be honest with you I dont know much about the stimulus checks, I was here two days ago asking information about the stuff and today my husband gave me a check of $1200 and he told me is from government, I was suprised but we filed together as a couple early March and he filed single in 2018 so may b they got our details from 2019 taxes that we just filed last month.
