Alas we've since learned that no all airlines and at airports will board an LPR who holds only an endorsed immigration visa:

I know of no legal basis for USCIS suspending / interrupting  production of a green card because the immigrant is overseas. I know of at least once case where an immigrant with an expired 10 year green card filed I-90 online from outside the USA, and then had a relative bring the I-90 receipt to him. The immigrant was boarded with the I-90 receipt plus expired  green card and admitted with the same.

I would supply the documentation you spoke up, in particular the stuff that the other posters have called out. You have a lot of good evidence, I wouldn't worry too much about the domicile. I don't see why you can't go back to India and then go back with your wife.

I believe that there are guides for the Cover Letter under the Guides tab, but you can also do an internet search. For my domicile cover letter, I did an overview of my situation (I am in Ireland for this reason and am tied to the US in these ways) and made a list of the evidence I was submitting with it. I've been DQ'd, no interview yet, but it was at least accepted at the NVC stage.

    Good luck!

Your proof of paying rent, your landlord's statement, your utility bills, your car registration and car payments are the best proof that you have maintained a US domicile.  Financial accounts are less important since many Americans who live full time abroad will maintain US financial accounts.  Few will pay rent and make car payments unless they intend to return to the US.

The operable phrases are "no adverse information" & "which would render her ineligible"  In other words they have found no reason on their records that would stop her from continuing with immigration process.  The wording is correct.

Part 9, "Additional Information" is where I explained I had filed for an extension for 2018 taxes on the I-864.  I uploaded the 4898 as a separate document to CEAC, either as a financial document, or as an additional document, I can't remember.  I did not upload W2s for 2018, since the instructions requested an IRS tax transcript for the most recent tax year, so I uploaded the transcript for 2017.  I did upload the most recent six months of pay stubs and a letter from my employer.

Taxes aren't due until april 15th.  Take transcripts to the interview for the years that you have and a tax return if you can't download a transcript.

During the interview, if it happens post April 2020, the CO may ask for 2020 tax return.

    Hi,

For me, I did 2016,17,18 because at the time I submitted my paperwork it was Feb 11 2019. When my husband goes for his interview, I will give him those 3 years and 2019; if my tax return is done by then and his interview is after the April 15 date.

I did the same thing a year ago, filed for an automatic extension until October 15, so for the I-864 I put the three most recent years for which I had actually filed returns, in April 2019 for me that was 2017, 2016, 2015, with 2017 the most recent year.  I also explained on the I-864 that I had filed for an extension for 2018, and uploaded the 4868 at the NVC stage with the I-864 and financial documents.  By the time of my husband's visa interview in June, we had filed as married jointly with a W-7, so he took the 2018 1040 with all schedules and W2s and was approved with no problems.  Good luck!

    Hi, yes Feb 11 2020.

Original submission date for us was 11 Dec 2019. Then NVC asked for additional documents including an I-864a from my household member. And that lastest tax return request was 2018 tax return

    Rare, but technically possible.
Add in the ~$1000 for the I-601 to be filed, attorney fees (optional), and around a 1 year extra wait after being refused the visa due to lack of vaccinations. That's the current timeframe for an I-601...that can change in the ~2+ years (12-16 months for the IR visa to get an interview + ~12 months for the I-601). At the end of that, you will get your decision if the waiver is approved or not. By then the medical will likely have expired, so a second medical would be needed.

Every country has different requirements. Brazil required two different police reports, but India might require a different kind. Follow the instructions on NVC page for India. It tells you everything you need for your country. I suggest you have all this done now to save time later. As far as uploading, every country is different. I know they’re trying to make everything electronic but some still have to go old fashion.
I’ll check tomorrow and let you know everything I upload to the CEAC website.

What other form you filled besides I-864?

Don't take this personal but here is my response to that. In a country of civil unrest you husband reacted in a professional in a way in required the staff to tell him to "calm down". Yes, I can see why that may raise some eyebrows.

And you are making a huge mistake by saying that you know your husband and he is not violent because you are not being impartial. You know your husband. They do not. And with all that is going on, they have to be careful with anybody. And if I was a doctor who just met your husband and found out he acting in a way to my staff, I would make note of it also.

sonicview got a reaction from Abcd1234 in Possible to file tax as married while beneficiary is living abroad
My tax guys said i can't include my wife name or show as married in my tax return because she is not in USA and don't have SSN. How you guys did your tax return last year when you were married but spouse was overseas waiting for her visa approval. Did you guys filled application as single or married? I am little worried because i am expecting my wife's case to be approved next year as i recently files her i-130 and my 2019 tax return will be needed in the next stage of processing. I want to file as married, don't care about the deductibles but at least for the correct record, but without her having SSN i can't include her in tax filing. I don't want visa officer to question her for this point, any advice, what you guys did?
