If you read my post over again you will NOT find that I said you couldn't submit the 1040 so yes you can submit either BUT remember the embassy has the gold and therefor if they say TT then if you want the visa provide the TT. Since the TT is so easy to get then why not submit the TT and avoid any possibility of "will they or won't they". Just my opinion.

It's thanksgiving. I have my appointment to put the turkey in the oven. Now I sit back and wait till it's done. I'm 1 hour into the meal preparations. I just don't know why it takes so long. I'm freaking out about now, not knowing when it will get finished cooking. Has this happened to anyone else? Does anyone know what's next?

Happy Thanksgiving to those who celebrate.

Today and tomorrow are big days for some as your case file may ship out to your embassy. Check CEAC for updated progress and look for "in transit"!! If that shows you are on your way. Shipments are throughout today and tomorrow so don't get discourage if your record at CEAC has not changed over to "in transit” Also, for those who want to have a little fun in tracking your shipment see the DHL hack on the first page of this thread NUMBER 19 for instructions. NOTE: The DHL hack information will not be available till Wednesday as the DHL and NVC computers must sync with each other to produce the outcome.

You have three stages 1) transit - shipment is in the air or soon will be, 2) received - physical case file is at the Embassy and 3) ready - your case is ready to schedule and complete your interview.  These will be your current state or status to your case file once you have received the case number. Once your record is set to "ready" you are ready to proceed in processing your next steps as listed in your P3 for your embassy.  I have most P3 if you hit me up with a request, I will post back the links.

Please don't screenshot and post your CEAC status as it just clutters up the thread. We all know what it looks like. Let us know your progress as we want to celebrate with you. Good luck.

I've searched as well this year, last year, six years ago. I read an article or ask.com type thing (way back)  where immigration lawyers were giving answers and quoting sources in the law in their very impressive legal jargon. Bottom line six said yes and six said no.  It was still an opinion based on their interpretation of the law. A debate really. I have never seen anything on USCIS.gov that explicitly says yay or nay. K1s are such a small fraction of visa recipients that  they are not addressed in many things. That period of time after your I-94 expires but before you have been granted a green card is pretty vague when you want to find something in writing by USCIS that you could show to a cop that it's okay that you are in the US without documentation. Or a bank that doesn't know whether to treat you  as a resident or foreigner in their records.

So pay a lawyer to tell you yes, then go next door to the next lawyer and he may say no. Or just keep calm and carry on. Or enjoy a vacation. You'll survive either way.

Sounds like you have an uphill battle on your hands regarding the daughter's aging out. We didn't know if we were going to have the same problem with my stepson. The interview in Guangzhou went smoothly, their POE was a month later, we got married 4 days after their arrival. I had been preparing the AOS/EAD/AP packets, submitted them 2 week after their POE. They got their 2-yr GCs 6 months later, we made it.

We relied upon the VJ K1 Visa Flowchart to help guide us on what and which step to do next. The timeline is outdated, but the scheme the various steps is still quite useful: https://www.visajourney.com/content/k1flow/

Good luck on your immigration journey.

Yes, we should not worry about things which are out of our control. Better concentrate on what we can do - learn the process (it's pretty long and NOA1 is only the beginning of it) and get prepared for it to make everything as smooth as possible.

It depends on your country (if a consulate allows it). Generally, it is very beneficial if a USC attends an interview together with you, but it is not required. Interview is for you.

EllyLilia reacted to Wuozopo in How long does embassy take to write to you after NOA2 approval?
Probably 7-8 weeks. The wait is for:
USCIS to send it to the NVC
NVC to get to it and assign a new case number
NVC to send it to London (petitioner gets an email when this happens)
London to get around to logging the file in and creating a letter (to beneficiary)
Royal Mail to deliver the letter

The instructions are online so you can start gathering the documents needed and getting the shot records and medical summary from your GP.
