You apply for the visa. If otherwise eligible for it, they will notify you of being inadmissible due to the bar. The CO then has discretion to recommend one or not - it's not something you apply for or anything you have say in. Then you wait for approval of the waiver.
A lawyer won't change any of the above or improve your eligibility for a waiver.
