Of course I am! Have you seen any of the chatter about Kyle the Sperminator?? It's..... wild. Poor Anika. Also Luke and his teenage dream/cash drain Madelein; Shawn (who seems very sweet) and Aliyah (also sweet) dealing with something VERY heavy; and we still have yet to meet "he wants a threesome" couple Alex and Adriano.

Nicole and Mahmoud have been together for over 4 years IIRC.  His GC will be a full IR1, not a CR1. In some ways, I can empathize with her - she went to Egypt for some time, didn't adopt a hijab, but did cover herself because she refused to change 100% to fit the "acceptable" mold where Mahmoud was from.  I suspect had they been in a big center like Cairo, things would have been easier.  But when he's so enthralled with women wearing hijabs in the US and finds them so attractive, I have to question how in the he!! those two got married in the first place!

Jazmine and Gino are a mess.  I'm surprised that she made it to the States.  The fact that he didn't put her kids on the K1 to come as K2's is rather dodgy and the fact that she didn't even attempt to work with him on the paperwork is a failing on her part.  Both are educated individuals.  He's an engineer and she was a school teacher.  There are no excuses for her not to be able to understand the forms Gino had to fill out.

Hi OP: I know it's confusing. I think several of us here have given us the best advice we can, and I've personally been through it with my husband.

Again: A DTP, TdaP, TD, etc will all suffice. You cannot get a single pertussis shot for men in the UK. That is not what the instructions are implying, even if they are confusing. Knightsbridge will give the missing shot required, if you pay for it. As you can see on the visa medical's site. It is £70.

I understand there's confusion about polio. Where polio might not be offered in a combo shot in the states, in the UK it is, as the other poster I linked to mentioned as "Revaxis". That will not be what Knightsbridge will give. For years on this forum there is always confusion about the P for polio vs the P for pertussis, and ultimately it won't matter. What shots I mentioned above will be the shots accepted.

If it were a problem to you and your future spouse, he could easily get a single shot for pertussis in the US from any pharmacy and simply get his vaccines recertified for AOS purposes. I don't recommend that unless there is a general health concern, afterall pertussis is increasingly becoming a problem globally. It is still a moot point, because Knightsbridge can give the missing shot (DTP) needed.

Btw, he will get no assistance from the embassy about this. It's not their wheelhouse. It's Knightsbridge.

Furthermore my husband went to his doctor before his Knightsbridge visit, gave them the list of shots needed and got them. I can't tell you if the DTP or Tdap he received actually was the formulation that Knightsbridge believes it to be, but it was accepted by Knightsbridge and that's all that matters. We also had those same results recertified by a US civil surgeon because of an AOS RFE (that was in error) and it was also just fine. I know it's a confusing, scary, annoying, frustrating process - but do not be concerned about it. Make sure your guy gets the shot at Knightsbridge. Don't leave there without it.

Neither TDaP nor DTaP contain pertussis, which is what the OP stated.

Considering the timing, very likely that any court hearings (if there were any) were via Zoom. Simple divorce cases often do not require stepping foot into a courtroom though.

Since OP willingly signed the divorce papers, we can assume the husband submitted all appropriate documents to the court. But either he never followed up to dismiss the case - which would have been incredibly simple - or he actively participated in the ongoing divorce process and hid it from OP. Even once the divorce was finalized, a motion to vacate could have been filed. I am absolutely baffled that, at the very minimum, the husband kept this to himself for so long though.

OP - I agree with others. I would consult a lawyer, and fully expect you're going to have to basically start over and get a new green card.

And personally...I'd suggest having a very blunt, tough conversation with your husband about this. Either he was grossly negligent and hid things from you, or he lied to you and hid things from you. If it were me, I'd be getting the divorce case files directly from the clerk of the court to see exactly what your husband filed and when pertaining to the divorce. There's no way he "accidentally" got divorced.

I agree, a good lawyer is required for your case as on the surface it appears you are no longer legally married and therefore the second AOS was decided incorrectly.  In simple terms it appears your GC is invalid, and would most likely require a new legal marriage, and a new AOS package.  A good lawyer will know how to proceed and more particularly as to how best to inform USCIS about the mistake with the second AOS decision to alleviate any potential of material misrepresentation claims.  Maybe try getting on Hacking.

As one of the 90 Day podcasts I listen to puts it about Nicole, "something happened on the way to heaven." As in, there is something very dark in her past, above and beyond the bizarre relationship she's in. Mahmoud is not the greatest human being, and a terrible husband, but at the same time she is actively trying to make him miserable, as if in payback for how traumatized she was in Egypt. (And if you watch that season, she looks like she's in shock half the time.) Her home is full of items seemingly calculated to rile him up, like pictures of naked women with luxurious downstairs hair, and Hieronymus Bosch's "Garden of Earthly Delights" as a shower curtain. (I actually kind of want that too, but all of my bathroom showers have doors, lol.) And then she wears clothing that is cropped -- but only slightly -- or has a small amount of exposed skin, knowing that Mahmoud will lose his mind. Yes, he needs to get used to her wearing clothing he doesn't approve of, but she is being needlessly provocative.

    TL:dr -- they both suck.

I know several people who adjusted on ESTA because of fairly serious questioning by CBP. Basically if you are scared by the officer that the next time you visit you might be denied entry… it makes sense to have a conversation with your partner and decide to stay and adjust. Unless OP was told that they shouldn’t/mustn’t adjust while visiting (and I’ve only seen that mentioned once here on VJ) adjusting is not against the rules after being admitted.

@Zumbadaddy This is what you need to do. Conditional permanent residents (those with a 2 year green card) are required to file for Removal of Conditions to receive their 10 year green cards, not I-90.  Your problem is now compounded because you need to get her back home and she needs to file ROC as soon as possible.

If you look at the USCIS page to file the I-90 online, it says this:

It is very clear about this, more than once.

This is an unfortunate mistake. If a proper I-751 had been filed, she would have received a 48 month extension letter long ago.

The previous people I've seen on here who have married prisoners and then filed the Spouse visa application have done so because their partner was going to be in prison for a long time - years -and they wanted to be there in the US to be able to visit on a regular basis.

In your case, as he's getting out in a year, I'd give you the same advice I'd give anyone who has begun a relationship with someone online and from another country - give yourselves a lot of time to get to know each other in different circumstances. First face to face - and then in your case face to face outside of the prison environment - meet his family, meet his friends, see if your goals and futures are compatible, see if your living habits and needs are compatible.

THEN... make the big life-changing decisions about marriage. Work out what his prison record means for his travel options, will he ever be able to go to Switzerland with you? If you have children with him in the USA then you will have to commit to living there until they are adults if he can't leave the country.

This is what I'd advise to anyone in a relationship where there has been little in person experience of each other.

You don’t need a special visa to get married in the U.S. or to a prisoner BUT there might be special rules around how to get married in his particular facility so you’ll want to investigate that.
Regarding being sponsored and living together. After getting married you can file the I130 and I130a- you might want to wait until after he has left the facility if he has difficulty completing the needed documentation online unless you plan on completing the paperwork together on one of your prison visits and mailing in a package.

Then you will wait for the I130 to be approved. You will have to more than likely find a joint sponsor as your partner might not make enough to sponsor you( and generally the non U.S. citizen cannot self sponsor unless they have an income in the US- if you have about $100K in savings though you might be able to use assets)
There are communities online of foreign women marrying prisoners in the US and a current TV show following foreign women marrying/ dating men based out of Michigan so you might want to find those groups for some support and tips while you navigate the process.
Good luck and I hope your first meeting goes well.

BE AWARE: THE SPOUSAL VISA PROCESS TAKES ABOUT 18-24 months. So, you won’t be moving to the US anytime soon. And you might want to visit several more times and really have a firm understanding of his crimes as you might be questioned about how well you know him/ the reasons he was incarcerated at the interview.

Other lady stuff isn't always fun, but I'll take beauty any day.
