    Having previously filed for a B2 would not have caused the K-1 to be denied......something is wrong there.  Besides, her brother could not have filed an application for her.  Anyway, getting married right after a K-1 denial would not, in itself,  affect a spousal visa.

    No you can't. That ship has sailed. Look at it this way... you were just deemed to much of a risk to come the first time, why would they risk you coming just to get your stuff? This happens a lot more than people think. People from no visa needed countries like Canada and Australia do not fully understand the delicacy of spending a lot of time inside and having a lot of ties to the US. Some of the things you posted make sense of why they denied you entrance.
    For example... 
    This sounds like you were basically setting a life in the US. I'm just looking at it from the viewpoint of an immigration person.
     
    You are free to apply for a B2 visa. But it will not be instant nor will it be a guarantee. Sorry you had to go through this. I have seen so many stories like this.

    That is the interview letter, print it and show it for the medical. You won’t be receiving a physical letter.

    The more the USCs petition and apply for AOS for their parents while claiming to just visit US, the more difficult it will be for other parents applying for B2.

    Sadly your expensive lawyer is not going to be able to help much.
     
    You are ignoring what the CO told you to do and that is taking a big chance. Yes marriage is a big deal and it should be taken seriously but filling for a K1 you should already be passed the lets make sure stage and even after all this time and your extra trips you still sounds like you are not sure.
    The CO already doesn't believe you're serious and you are going to push it with a second K1. 
    So by the time the second interview comes it will be just over 2 yrs since your fiance was denied and probably pushing 3 yrs since you met and filed the first time. 6 visits in 3 yrs is not that great when they already doubt your relationship. How long were each of these visits? 
    If you haven't filed another K1 yet please reconsider getting married and filling the for the CR1.

    When you reach the NVC stage, they will ask you to upload the proof of citizenship. I believe you can upload either one. I upload both in separate file just to make sure I upload everything. Those files get accepted.

    We just got an email from NVC saying our interviews scheduled yesterday December 18 for January 6. So in all, it was a full 91 days from the time we finished uploading all the docs to CEAC (Oct 7, 2019) to when the interview actually occurs (Jan 6, 2020). I've also updated my signature.     Wow..that is really different than how they ask me to create IRS online account. For me, they only ask my social security number, how much was my 2017 W2 and where I used to live in the last 5 years. I guess every person get different questions?
    I also use H&R block back in 2016 and use turbotax going forward. I even make one for my husband because the questions are the same! well, you learn new thing everyday.

    We are trying to get our documents ready, I have 3 questions:
    1. The tax transcripts is the most recent year which is 2018 or we can submit for the past 3years
    2. On ceac there is an option for additional documents. If I don't include are we going to have an rfe or additional documents will help dq?
    3. Scanning and orientation of documents in portrait and landscape mode, should it still be right side up?

    They looked at my case yesterday no DQ there is documents missing ( documents thy didn’t asked at first !) 
    they ask for my husband late wife death certificate and his first divorce decree , a proof of domicile . Ok for that we have .
    but they ask for his taxes transcript for 2018 and we have to wait for the paper to come by regular mail within 15 days because IRS don’t email or fax and my husband can’t not connect on his IRS website because no more credit card so it’s not remember him .. so another delay in the delay . 
    so that’s mean we will resubmit early December they gonna take to mid January I a pretty sure then 4-6 weeks wait for IL etc ...
    i am exhausted .. sad .. 
    i don’t arrive to stay positive anymore friend .. they are draining me honestly .. so unfair 
    what about your IL ? 🍀

    I applied IR-5 for my mom. That is the main reason why we need the death certificate.

    In other posts you stated that your mother who supports the household is receiving government assistance, SNAP.   Then you stated you want your mother to support you. Now you say you have an uncle who can.
     
    i smell a  public charge and red flags all over.

    Someone using public benefits is not a good choice for sponsorship, as the point of a sponsor is to convince the consular officer that the immigrant won't become a public charge and use public benefits themselves. So, you can see how it's probably not a good idea to use a sponsor who cannot support themselves, let alone adding on an immigrant, without taking public benefits. Also, you cannot combine incomes of 2 people who do not qualify to make up a qualifying income. So if you don't qualify on your own as a sponsor, and your mother does not qualify on her own as a sponsor, you cannot combine incomes with her to meet the poverty guideline. Your options are you must find another, qualifying person willing to joint sponsor (someone who is not on public benefits and whose income is above the 125% poverty guideline for their household size) to sponsor your spouse, or find yourself a higher paying job that may allow you to qualify to sponsor for your spouse on your own

    Maaaan..I will kill for playing video game all day! I miss playing my pc and nintendo switch without the pressure of going to work.lol
     
    Anyway,
     
    When I have not have EAD or greencard ready on hand I went to:
    1. Library
    2. Try to cook something new
    3. Join any interested community. Back then I attend a lot of classes at JoAnn to do knitting
    4. Join gym if you like to exercise. Planet fitness has a "good deal" right now. $10/month with $10 down. There was time when the down payment only 25 cents but hey, you just looking for something to do so $10 will not kill you 😆
    5. Going to any farm market or world market. Window shopping also help.
    6. Try to do some art (painting, stained glass art, pottery?)
     
    And the list goes on...

    So he plans to overstay until he suckers someone into marrying him to get that overstay forgiven? Charming. You’re not going to find advice on that here. When his visa period is up, he needs to GO HOME.

    They do not forgive overstays for siblings.  The wait from filing to an available number is about 15 years.  He would have a huge unforgivable overstay by that point.

    This whole process is very very frustrating and we are always in the dark. I know exactly how you are feeling right now.
    We submitted everything on September 13th. I saw few people around me got documents reviewed in last week of Sep and first week of Oct. We were getting excited that we will hear something around same time. We did not get anything and on top of that I saw many people who submitted after us got their documents accepted in one day to one week. I was happy for the people but at the same time I was getting real mad at NVC. After that we kind of stop thinking about it and we avoided to bring the topic during the phone calls. We started thinking, we have done everything on our side, there is nothing we can do about this other than may be get Representative or Senator help. Calling NVC was no help. In fact, I was on the call with one very rude lady and she kept telling me the same BS. Couple of hours after that phone call, finally, we got DQ email (Oct 25, took 6 weeks). I asked her and she said no one has looked at our documents on that day.
     
    I hope you and all waiting get the DQ soon. Just try not to think about it too much. Sometimes it also helps not to compare your case with others as it makes this process for frustrating. I took few days off from this forum as I was getting very mad at NVC for processing some people in one day while some in 6 weeks even for simple case.
     
    You are very close to the end of the process...Let's keep supporting each others to get through the process. There is a light at the end of the tunnel....
