    Hi there

I have submitted the documents to NVC and they are asking for 2023 tax returns we don’t have it yet but we do have the extension from IRS

    what should I do

should I send them the extension letter or wait for the 2023 tax returns and how much do we have to send them the documents once they asked?

    thanks

I would always send updated tax transcript. It trumps all other financial documents.
This was the reason why a close relative got AP until they provided the most updated tax script.

Basit had his interview today and they put him in 221g and took his passport. I have no idea why cause we didn't have any missing documents. I feel like he did it just cause he felt like it. Basit said he didn't even ask any questions about me. He asked do you have a job? Who supports you? Is this your wife's second marriage? And took my divorce papers and typed something in the computer then handed him 221g. I'm beyond pissed. I was outside the embassy waiting for three hours for Basit.

I thought AP is pretty typical for Pakistani embassy.

    File tax without income?

I would have still filed taxes with no income.

the way I see it as an immigration officer I would want updated tax returns. If spouse income is below threshold I would request joint sponsor to fulfill that requirement. If there is no tax return (regardless of reason) then we are still stuck at first step.

anyone else can chime in as well but I think for immigration purposes, I would have filed all taxes regardless of no income.

    How long ago was that?

After COVID, most consulates stopped letting petitioners go in.

Your husband can take your passport with him and show it/give it together with other documents and say that “my wife is here visiting”. That usually works well.

This was the year before Covid. But I remember reading the same guidelines that people posted about who can accompany. I did my research and went in.

The way Islamabad embassy works is you have to show up early at a pick up location where you go through some security and then board buses provided by embassy that take you through check points to the actual embassy. Before you board the bus, is when they check your reason for visiting embassy. For being a US citizen, they just looked at my passport and let me on bus.

The worst that can happen is they won’t allow you to go to embassy and you have to wait at the bus pick up spot. But if they let you go in then essentially you have a really solid case of why the marriage is valid.  Remember the interview  is looking at how strong the evidence is for the marriage to have been ongoing. Hence the reason they ask when did the couple physically met last time.

Quite frankly, I think me being at the interview was extremely important. It helped my wife as she was nervous. The interview took 1 min, where they didn’t even care about my wife. They literally called her and asked her to take seat and just asked questions from me about what do I do and how long I have worked and that’s it. We were done in at most 5 mins.

Thanks I was hoping to go with him since I’m here anyway.

That is not true what kuchiki said.

    are you the US citizen?

I petitioned for my wife ( as a US citizen) and when it was her interview date at Islamabad embassy, I went with her. When her turn came they called her to the glass window. First question they asked her was when did she last saw her husband. She said this morning. They asked oh he is here and she said yes. They completely ignored her after that and called me to the window and asked me few basic questions about my work and that’s it.
Actually I highly highly recommend going to the interview because that guarantees this a valid marriage. I m saying this as someone who personally did it at the Islamabad embassy.

if they are asking for your W-2 form just add a comment in the additional document section that you are unemployed. Next time whenever NVC review it they will DQ your case. It happens sometimes that if you submit same docs for two cases, you get case review notes for one case but not for other case.

Thank you so much for this. I followed this. Hopefully it goes through. Appreciate the help.

  8. Hello,

Hope everyone has been cruising along well. I am kind of stuck and not sure how to proceed further despite multiple inquiries to NVC. Here is my situation:

I, US citizen, petitioned for my mom and dad. I have always been unemployed as my spouse makes a decent living. On I-864, I selected unemployed and then used my spouse as household member. We have filed taxes jointly for last three years. I submitted IRS transcript for this year for myself and my spouse submitted I-864A along with three year transcripts, employment letter, 6 month paystubs, three year W2s. We did the same exact thing for both mom and dad petitions. My dad’s petition got DQ. But for my mom, I got Case FE Review note requesting W2/1099 for me. I have sent 2 inquires explaining that I don’t have W2 since I have always been unemployed and using my household member for income qualification. But both time I got the same email, I have attached them.

Of note, no documents under “Affidavit Of Support”and “Applicant Information” says missing. Everything states “Accepted”.

At this point, I am thinking of just uploading a document in “Additional documents” with an explanation of why W2 are not available. It’s kind of frustrating since my dad got DQ without this issue.

I am hoping if anyone else had to deal with this and how they got around it. Any help/guidance would be appreciated. Thank you

Interviewed today.  IO said the package we provided was awesome.  The actual interview took 5 minutes.  Just verified some questions on the form and approved.  Case status changed to card is being produced.

Congratulations. March 2019 MSC filer here.
Got my status changed to Interview scheduled on Jan 7. We will mail the interview letter

How long after the uscis status update, did you get the interview letter mailed? And how long after was the interview scheduled?

I am in tough spot because I have to travel overseas in couple of weeks and I’ll be out for a month. I bought tickets and all and If I don’t get the mail next week I won’t even know when to rebook my flight.

    Thank you

Right now the guess is that many people who didn't get an interview for their AOS, will instead get an interview for ROC. Did your wife by any chance come to the US on a CR-1 visa?

NBC/MSC is the service center that prepares cases for interviews, and it looks like the vast majority of CR1 cases are sent there. Assuming the reason is that they have never been interviewed in the US before, so they will get an interview for the ROC instead.

She did come on CR-1 and has never been interviewed in US prior to this. That would make sense I suppose. Thank you

  11. Hey,

April MSC filer here. I am US citizen, wife is from Pak. I thought my package and everything I sent was pretty strong evidence for bona fide marriage. Everything went super fast, except I just checked USCIS website today and it says Case is ready to be scheduled for interview. Is getting an interview fairly common?

    Things I sent:

Birth certificate of child born from this marriage

Lease/rental agreements from last 2 years with both names

    Tax transcripts last 3 years

Health insurance, dental insurance, Life beneficiary with spouse on it

Joint bank account (I added her to my account few months before our window period, so was not able to send much statements)

    401K with spouse on it

    Phone bills, autoinsurance

Plenty of hospital statements for wife routine health care with our addresses on it

    Macy joint account

Pictures from our vacations throughout 2 years and heck even pics when our son was born in hospital to us taking him for routine health checkups

So I felt our evidence was strong. Maybe not having a joint account right off the bat was a red flag? Either way, should I get an attorney for the interview? Any suggestions would help

    Thanks

  12. Hello,

I have not been able to find answer for our situation, hence I have to create a new topic hoping someone might offer any advice or share similar experience on how they dealt with this

So, we filed our I-751, we got our extension letter and my spouse left country as she had to attend a wedding back home. Reading around these forums, we got the sense that this will be a long process so no worries. A week after she left, we get the Biometrics letter with apt on 4/17th. My spouse is coming back on May 7th. Obviously, we rescheduled it. We have read on this forum that usually they reschedule it after ~2-3 weeks from the original appointment date. We were hoping its 3 weeks that would put us right the next day she lands. Well, they gave it after 2 weeks and her new appointment is on 5/3. Should I just request to reschedule it again? I have read on a different website that multiple rescheduling might result in Denial due to failure to do biometrics.

Has anyone else dealt with this situation and what did they end up doing? I can't ask her to come back sooner since the tickets are extremely expensive. Appreciate any advice or feedback

I'd like to add we live in Michigan and are dealing with Texas service center
