    Complicated Issue - Step Brother

    Hi,

    My daughter married to american doctor around 6 years ago , and currently she is working doctor over there and is permanent resident . She is a green card holder and got her own american passport also now .

    She is still dependent on me for emotional and other needs of her , so called me to america for 1 month and filled my application also for a green card .

    The problem is my son is currently studying Medicine in china , (originally he is born and bought up in china) and is 19 years old , also wants to come to America after studies to stay with her sister . To work in america as doctor he needs to clear USMLE i know that , but when she files the application for him there is a minor problem , my son is from other man and my daughter from another , as i divorced and re-married .

    My friend said that could be a major problem and my daughter must file for him before he turns 21 years of age , as after that we can no longer show he is dependent as 21 year old are independent on their own .

    Also should i wait for my green card and file it under mine or should his step sister file his application under her ? and show that the brother is dependent on needs from sister ?

    Also could you tell me any guide or some self-help where i can learn more about visa applications , as most of the work my daughter does and i quite literally do not have a clue .

    Also if he does not clear USMLE do you think he might be able to work in USA in any medicine related profession as he says USMLE competition is tough.

    my daughter is recently naturalised usc she wants to file for my husband and my son, and me, can someone please advice me which forms she might fill so that i can let her know and what evidences are needed?

    Hello,

    actually i filled N-400, i did pass civic and english test. but because of less documents they called me for re interview.with my husband. they gave (Immigration officer)me I-751 form filled out with documets like utillity bills, credit card statements, tax returns transcript etc....

    now as i fill i-751 form i have to put some documets showing me and my husaband's name joint. now my question is we are living with my husband's mom and dad so house is on their name, gas,electric,cable, phone is also on their name. what should i do to show proof for utillity bills?

    if my father in law write affidavit showing we are living with them is ok?

    pl. help me for this matter? if any body have letter stateing something like this pl. send me at :wacko:

    the affidavit from father in law might help , get it notarized

    meanwhile i am not sure if they require joint things for naturalization? n-400 i thought they need for only removing conditions!

    There is no '3-week biometric' rule.

    Your NOA (I-797c) is your extension for your PR/Green Card.

    my concern is that my passport is in my maiden name and my extension letter and expiring gc is in married name so my travel will be in name of my passport that is my maiden name ,

    i dont understand how my expiring gc and extension letter help me in travel in my maiden name?

    any comments ?

    hi friends please help me ,

    i received my NOA from VSC ON may, 2nd, 2009 and till date that is today 06/11/09 i havent received the biometrics appointment yet,

    i my application was sent on 05/19/2009

    so its exactly 3 weeks now i havent received biometrics,

    can somebody give me the phone number where i can call them?

    i also need to ask if someone can tell me where to get the passport stamped in new orleans, 70123 for i-551, i will be travelling shortly and i need the stamp for that purposes?

    The work is legit. Very few scammers get through the screening. There's a free logon and one where you pay a small fee. Most things you'll find via craigs list etc are scams or very, very, very low income (like those internet survey things) and you will be wasting a bunch of time and getting very little back.

    i am asking this for my very close frnd who is starting to file for her family

    can a usc file for her mom , and her step father and step brother married currently to her mother

    Hello. :) The I-130 contains instructions on who a USC can file a petition for. It explains that a I-130 cannot be filed for a step-relative if the marriage took place after the USC was 18. If her mother married her stepfather before your friend was 18, then she can file the I-130 for him. Although I've got to admit I can't figure out whether she could file for her step-brother if the marriage took place before she was 18...

    EDIT - I just noticed that this in the IR1/CR1 folder...

    The "before age 18" is for a step-child of a USC or if the USC is the step-child and wanting to file for their step parent.

    Section 3. C of the instructions (who you cannot file for)

    C. A stepparent or stepchild, if the marriage that created the relationship took place after the child's 18th birthday.

    Hi, pushbrk. It seems that you've said the same thing I said. Are you just posting the same thing again only more clearly and with the instructions copied in? Or do you disagree with something I said? :)

    No, I don't disagree with your conclusion. Later I added an opinion on the step-brother. In this case the age 18 applies to the USC because the relationship is to a step-parent rather than step-child. I wanted to clarify that the age applies to a "child" not generally to the USC unless the USC is the relevant "child".

    As for the step-brother, the marriage would need to have taken place before either the USC or the step-brother were age 18 and the step-brother must be under 21 at petition filing. I'm not sure if the visa must be issued before the step-brother turns 21 but I suspect it does. Probably more expertise on this in the family members forum where it will undoubtedly be moved.

    but when she was petitioned by her husband she did mention about her biological dad as her father n not her step father as her father

    Does anyone watch Indian Idol? Whose your favorite? What did you think of the showdown between the judges last week about the "love" comment?

    It is actually possible to download and/or watch all the episodes of Indian Idol, Saregamapa, and Star Voice of India on www.muft.tv. Check it out.

    My favorite show is actually Saregamapa. The quality of singers on that IMO is way better than Idol.

    what airline are you flying from JFK to DFW Dallas? You should be arriving at Terminal 1, see the list below, Lufthansa gate will be there. From there after you clear custom you can rechecked your luggage and see the list below what terminal you have to go to. There's a Tram a JFK that goes around all the terminal, you can take one from terminal 1 to your connecting flight.

    thanks fopr the response , anyway i booked my ticket at 2045 hrs through jetblue airways form JFK to AUSTIN .

    This is the only option i have to fly close to DFW . All other DFW flights are concentrated around 6:55 pm and from EWR or LGA airport , and i think its very risky transferring from jfk to any airport .

    4 factors i was considering is :

    *Lufthansa delay from Frankfurt

    *Immigration check ( never know 15 min to 4hrs)

    *airport transfer (JFK TO EWR 75 min to 90 min , and that too weekdays , traffic factor; JFK to LGA can take 35 min to 60 min)

    *check in time for domestic airlines atleast 50 minutes before departure

    i'm arriving by Lufthansa form Frankfurt @ 1610 hrs ( if evrything is on time)

    any suggestions welcome
