  1. English Muffin,

It's OK for the 90 days that you are in K1 status. An employer is required to document the emplyment-authorization status of its' employees, and is subject to penalties for hiring aliens who are not employment authorized. The USCIS Handbook for Employers has this to say about the self-employed:

If you are self-employed, you do not need to complete a Form I-9 on yourself unless you are also the employee of a business entity, such as a corporation or partnership, in which case the business entity is required to complete a Form I-9 on you. So you are possibly exempt from the documentation requirements, in which case you do not need an EAD to show to anyone.

After the 90 days I'm not sure, but working without employment authorization, should you not apply for it, does not affect the adjustment of status decision for a person who is adjusting status on the basis of marriage to a US citizen.

Should you one day apply for citizenship I don't know how you would answer Part 10, section D, question 15

How does self-employment work? I'm hoping to move over in January 2008 and I am a self-employed Internet Researcher. It's something I can do from anywhere in the world, I just need internet access. Is it ok to do this on the K1 without the EAD stamp?

    Thanks

    Many thanks Yodrak.

  2. I would file right away. If you happen to get an interview scheduled before the trip, postpone the interview, or, delay sending back the Packet 3 information for a bit. I wish the Montréal consulate and the California Service Center were as speedy as the London Embassy and Vermont Service Center.

How long could I delay sending back the packet 3 information for? I've had a look through the guides but I can't find anything telling me how long I can hold it up for - perhaps I'm not looking in the right place. I'm now beginning to think that it may be a good idea to file sooner rather than later so that if we get an RFE, or anything else causes a delay, at least that will happen when we're not really too bothered about the speed that things are going.

Thanks to everyone for their advice so far.

  3. Thanks everyone. After looking at the timelines link and reading your advice we're going to file in mid-July. That way I can visit in September because there's no chance I'll have the visa before then. If we file mid-July I'm hoping to have the interview somewhere around the end of October or beginning of November.

Also you can visit after you file and before the visa is issued, so dont feel too limited by that. By the way, I love your screen name :)

Thank you, it's one of the many nicknames my fiance has for me.

  4. Hello all. I am a UK citizen and recently got engaged to a USC. Ideally I would like to move out there around January 2008 and don't envisage any problems with the visa (no criminal record etc). I have a holiday booked with my fiance in the US for 10 days in September so I don't want the visa before then. We will be filing through Vermont and wondered if anyone could advise on when would be a good time to file the I-129F in order to get an interview any time between the middle of October 2007 and January 2008? I appreciate that this is not an exact science and I know that it's impossible to be precise but a rough idea would be ideal.

    Thanks in advance.

  5. I had to have 2 MMR jabs but only had to wait 28 days in between.

Same for me. I had my first MMR shot on Monday and I have to go back for another in 1 month.

  6. Many thanks. And for anyone else who may be wondering the same thing I was pointed towards this from the US Embassy FAQ.

I'm in Her Majesty's Forces/ the Diplomatic Service; I am applying for an immigrant visa, do I require a police certificate?

The Embassy will accept a copy of your military record or discharge papers for any country were you might have served while in the HM Forces. The Embassy will accept a letter from the Foreign and Commonwealth office in lieu of police certificates for any country were you may have served for the British Government.

  7. hi....

i think you discharge papers will suffice - however if indoubt check and double check. I beleive i saw that very same question in the FAQ section on embassy webpage - if you navigate through to the fiancee section then check the FAQ it is in there - i seem to recall the discharge papers will satisfy - if in doubt email them including your case number on the title line of your email

    Good Luck

Many thanks. And if anyone else is wondering the same thing here is a copy of what's on the Embassy FAQ.

  8. Hi,

I'm a UKC and my fiance will soon be filing the I-129F and I'm starting to do a little research. The guides have answered pretty much all of my queries but I have one that I'm hoping someone will know something about. I served in the British Army from 1986 to 1994 and spent 4 years of that time in Germany. Does anyone know if I will need a Police Certificate from Germany or will my Military Record suffice?

    Many thanks.
