    The tax return (or transcript) for the most recent tax year may be requested by the CO for the I-134. COs at some embassies require this and others won't. Having filed is all that is required, although the I-134 itself is just a tool to help them assess the beneficiary's public charge concern...so if the sponsor has a significant back tax burden relative to their income, they may consider that a risk. It's best to be current to avoid issues.
     
    After entering the US on the K-1 visa and marrying, the beneficiary will need to file for AOS to obtain permanent residency. The petitioner will need to submit an I-864 for this, which requires the most recent tax year's tax return (or transcript), along with having filed for the past 3 years. Again, they only need to be filed but they will still look at the totality of the circumstances to determine the public charge concern.

    You wouldn't "renew" your tourist visa, you would be applying for a new one.  Having a US Citizen spouse essentially supersedes ties to your own country making the chances of obtaining a new tourist visa difficult.

    He must have been a legal resident of Thailand for at least 6 months to file DCF. Time in country on Thai tourist visa has nothing to do with DCF timing. If he were a legal resident he would have a different type of visa which they would accept in a DCF case. 
    He can call or write the duty officer at the U S consulate in BKK to confirm the info I gave. If he wants to do it in person he can. The consulate office is in the high rise across the street from the embassy visa section.

    You as USC can apply for food stamps.
     
    But your immigrant husband probably won't be included.
    Most states require LPR to wait at least 5 years after getting greencard before they can apply for govt related assistance.

    So your advise is to say that sin sod isn't paid in 2017 by most people based on your own experience ? People are going to hope you are right but sin sod isn't going away. It isn't a color or food choice they are making. Sin sod is ingrained in Thai culture & I believe its there to stay. The families you describe with the money ect indicate how you & others see society there. People in BKK feel superior to others for example while they are really just another person in a mega city filled with poor under educated people.

    This is all over the map to me. You say " most family do not ask for sin sod anymore ". That's simply not true but what is important here on V J is the questions people have about paying it.  
    In the past year you have had several friends that asked for millions yet you asked for nothing. Why? The answer to that & your families reaction would be helpful to others. 
    People should keep in mind that the sin sod money is a huge attraction to the extended family so it goes quickly. 
    The simply way to approach sin sod is to determine what a person is willing to pay without regretting it later because it will always affect the marriage. 
    My husband did what he felt was best and it turned out to be a wonderful way to show continuing  respect for our mother. We have 11 years invested in her not just a down payment.

    Actually, not attaching your various wedding booking receipts will NOT result in RFE. Letters of intent are good enough. If you have some receipts, sure, you can attach them but they don't hold much weight nor do they prove much.

    People who submit anything other than the letter of intent with regards to their upcoming nuptials are doing so as relationship evidence, not proof of intent to marry.  Only the letter is needed for that.

    Answers:
    They will not understand or care and it is too late to correct these kinds of errors on the DS-260.  Incompetent lawyer or not, it is ultimately the responsibility of the petitioner and beneficiary to ensure everything is complete and accurate. See above. Withdrawing is an option.  However, when the time comes to refile you and the petitioner need to be prepared to explain why you went along with something you knew was false.

    It would be better to get the tax return transcript from the IRS vs trying to figure out your entire tax return.

    In this case I think who pays is very important because the family & the money are in the USA. Strong ties are number one & those change to the USA upon entry. The only way to really ever know is to apply. I am sorry to say in this case I doubt the visa would be granted.

    This is a common misconception that a individual can sponsor someone else for tourist visa. When in reality that is not the case at all and in fact it hurts more than it could ever help.

    AOS can take a long time. For K-1ers even up to a year. It all depends on how fast (or slow) your local field office is or the NBC. Every case is different, don't compare.

    Pakistan is by far one of the most difficult countries to get a visa from. Period. An online Nikkah wedding is not valid for immigration purposes, if that were the case everyone from Muslim countries would be doing it. There are couples who have been married years and spent months and years together in real life who get denied through Pakistan. You seem very naive to the process and I suggest you do a lot more research. My friend(who I met here on VJ) and her Pakistani husband were denied twice despite  spending years living together in Pakistan. He was finally granted his visa last year after over 6 years of trying. Take a trip over to the Pakistan portal and talk to the dozens of other couples who have literally been waiting years for visas.

    I am not sure of your entire timeline, but as long as you had a foreign income and spent at least 330 days of a year outside of the U.S. , you are not required to pay taxes on the first $101,000 of your income. This is if you can prove a bonafide stay and physical presence in the country through the FEIE. Your tax lawyer should be able to help with that.

    So when the USCIS replies with a confirmation that they have received our application for an I-130, that definitely does not constitute permission to stay in the USA, right?

    She can stay and you can file. Once i130/i485 is filed she will not be deportable. I don't know why ppl are telling you she needs to go back. You are married.
    As far as the i864 affidavit - you have to show compliance with filing taxes before you file. Between the time of Sept 29th and when that is completed and you can file - your wife would be deportable - probably not a priority for ICE, but at risk.
    A US citizen or resident for tax purposes is required to file global income.

    No question that you are correct. I have seen a few cases where the relationship on line began well but trying to make any determinations without personal contact became the very reason it failed. 
    In Thailand its very important to meet the family & especially important to figure out to best do that. Great way to find common ground thru the planning ect. Foundation needs language ability very early as well.

    Obviously there isn't a right/wrong answer on when one visits. I look at this way, if you have the means to visit then I say just go. If it doesn't work out, then take the loss as a vacation. There are many places to visit/do in Thailand.
     
    I also have relatives from Thailand, and meeting the family is very important.

    I agree to a point. Sooner is certainly better to get to meet at least for a short time. Few Thais can just plan a trip to the USA so its almost always the USC that travels there. Thais have a very difficult time getting B 2 visas. To me this means an early investment in the relationship is the best way to eliminate many questions. A serious chance at chemistry can make the difference in the end. 
    Many Thai wives will wait because they are committed to the person & the entire concept of a better life. Not so much if they are in another category simply because they are human having needs you might say. IMHO

    An anguishing situation for you, certainly.
    You don't want a schizophrenic or depressed girlfriend or wife.  Not there, and not locally.
    Take what you see now and multiply it exponentially after she or someone else like that comes here (consequent to homesickness, etc.).
     
    Difficult though it might be, avoid putting pressure on her or yourself.  See how things evolve.  Whatever is meant to result will happen.

    With your attitude I think in time you will succeed. If not with this girl for some reason then by then you will have learned a lot about all of this Thai cultural stuff. That being the case there are a lot of ladies in Thailand that would love to find a quality person to become part of their lives. Ask your lady to read Thailand Fever & formulate some questions for you. You do the same. Get away from money entirely. As her what she knows about America & American people. Find out what she sees in her future.

    I am very late in this response but it may still help others. No offense taken. This is a very subjective subject where the farang typically wants badly to believe they have it all figured out. They don't. 
    The O P said she didn't bring it up I think. That means the parents did. That's very Thai & I am sure the whole family was or is talking about the subject of sin sod. A cash cow has arrived or will one day because as we see here the O P hasn't even met her yet. That being the case the family is just fishing & using money as bait. It is sadly normal in Thailand due to lack of understanding about farangs; especially Americans. The fact that this subject is here again should indicate that people need to be very careful as they enter into these things. 
    Its a terrible way to start an relationship but I have seen this many times. There is a lot to understand & do in this case I am afraid. The statement that she is a slave ect & cant stand to leave her family is troubling when she then says she will never return to see them if she gets away. Few Thais will turn their back on the family. Pay huge sin sod to a family that she describes? 
    Of course I hope it all works out but there is a lot of work & time to put into this & sin sod shouldn't be part of it until way down the road.
