    Hello, Montreal group! I wanted to provide a bit of an update to the group, since our interview is scheduled for Wednesday and I know inquiring minds are dying to know the latest 🙂   We actually decided, after MUCH deliberation, stress, many pro/con lists (SO many lists lol), that we are  pulling my husband's case and are going to stay in Canada.  Some of you may be aware of our background and the complications and nuance of our ongoing immigration saga in the US (our case was NOT a straightforward one).  After many years going through this process, lots of money spent with lawyers, application fees, waivers, etc., we were thinking - why are we doing this when we love living in Canada - yes, despite this insane amount of snow in Toronto!   I don't know what it means for my PR going forward - I did apply for citizenship, though I think that's lost in the abyss of the Covid-backlog.  There's a good chance they'll deny me anyway since we're living in Toronto right now. I need to figure that part out. I am aware of the implications and consequences that this may bring.   But - we are happy here, our children have friends and are settled in a good school, we both have really good jobs, friends around, extended family, etc. My husband's mom can come here and visit from Mexico without the hassle of visas. The lifestyle here is definitely more suited to us and our personalities, and honestly - I am tired of moving.  We've lived multiples states and countries over the past 15 years together and the thrill of moving has definitely worn off! We are ready to put down roots now that are children are getting older.   I'm not sharing all of this to somehow justify our decision to everyone here, or myself. I know living in the US is an amazing opportunity and the end-goal for all of you on here, so I didn't want to come off as unappreciative of the life and opportunities that the USA provided me and my family or seeming overly privileged in our desire and ability to close that door and settle here in Canada. I wanted to let you all know - my online immigration family - what our latest update is and to also wish everyone on here the best of luck in your cases and all the happiness to you once you're settled in the US.  And hey, now there's one more spot open to someone 🙂   If anyone has any questions about waivers or our process or anything, I'm always around to answer messages/chats.  I can't wait to read everyone's updates on here as you begin your next chapter!   Cheers, Rachel

    Hi everyone, my husband finally got his interview date at the consulate in Montreal (two years later!). Our children are derivatives on the application so they must attend with him. They are 6 and 10. 
     
    Does anyone here know what, if anything, do they ask kids?

    Thanks everyone for your responses!  We will likely see it through, and then decide what to do.  Since there could be difficulty in travel if we pull out now (or if he gets denied at the interview), I tend to agree with @African Zealot that we should finish the process and go from there.

    Perhaps you meant pre-visa application waivers (i.e., the 601a) -- which is only available to certain immigrant visa applicants -- but there are certainly waivers for non-immigrant visa applicants, including B visas.  They just cannot be filed for prior to departing the US and filing a subsequent non-immigrant visa application.  And, they are less likely to be approved, especially if the ineligibility was for a recent action -- for a lengthy overstay, it would be years before a waiver would likely be approved.

    The prudent thing to do in this case in my opinion is go through till they get a green card and then they can relinquish it. At that point the ban will have been fully "spent" since their status changed. Subsequently they can enter without that overhang

    NOT. A. WORD.  Seriously guys, it's crazy - I cannot believe there hasn't been any movement.  I got one of those generic, "your case is still in line" emails about a week ago.  Y'all have my word - the second I hear something, this is the first place I'm going to update!

    To add insult to injury, I just now got this email -AGAIN- from NVC 🤦‍♀️
     
    So who even knows anymore LOL.. I'll keep you all posted once we hear something definitive!

    This notice is to inform you that your case for an immigrant visa is documentarily complete at the National Visa Center (NVC) and has been since 20-Sep-2019.  NVC has received all of the fees, forms and documents required prior to attending an immigrant visa interview. Your petition is awaiting an interview appointment. At this time, no further action is required.  We appreciate your patience.

    Your case will remain at NVC until an appointment is scheduled, at which time we will send it to the appropriate U.S. Embassy or Consulate General.  We will notify the applicant, petitioner, and attorney (if applicable) when an appointment is scheduled.

    The U.S. Embassy or Consulate tells NVC which dates they are holding interviews. NVC fills these appointments on a first-in, first-out basis and is unable to predict when an interview will be scheduled.

    Visa interviews at many U.S. Embassies and Consulates have been delayed as result of the global COVID-19 outbreak.  For the most up-to-date information about the U.S. Embassy or Consulate's operating status, please visit their website at https://usembassy.gov.

    Hi, yes it is F2A. And our idiot prez just extended the ban apparently until end of March. Hopefully Biden overturns it for everyone’s sake. We’ve been fortunate enough not to be separated but my heart is with so many of you here that have been waiting away from your families. Fingers crossed for a better 2021!

    I heard Mexico would pay for a border wall but I haven’t seen that happen. I also heard we would wake up one day, back in April, and coronavirus would be gone. I haven’t seen that happen either.

    Hi,
    We applied for the 601A. Fingerprint fee was received August 15th (with our waiver app), actual fingerprints/biometrics done mid-September. 
    So basically 9 months from filing waiver to get the approval. 
    Now we're working on the rest of the paperwork so the interview can be scheduled, which hopefully will be good to go in the next week or two. Basically just waiting on police checks from Canada, US, and Mexico. Everything else I think/hope is in a good spot! FYI we have a lawyer..
