    The petitioner  needs to establish  US domicile at some point. Today is good. 
     
    It is possible to get a U.S. phone number outside the U.S. ; just enter this into a search engine:
     
         how can i get a us number from outside U.S.
     
    This way, in the unlikely event DoS calls the petitioner, there will be no delays in responding.

    If your income from current job will not continue after arriving in the US, then your income is $0.  If that is the case, you will need a joint sponsor or sufficient assets.

    It means that we're no longer set in our plans, but want to keep the option open to proceed with the IR-1 if we decide to move back to the US after all. I'd hate to have to start over and pay another application fee!
     
    She doesn't work here or own property, but I have a full-time job. Probably not the most convincing sell 😕

    Best advice has already been given: be honest and upfront, if you have nothing to hide then just give it a shot and see what happens. Plenty of people end up visiting in the exact same situation and never had issues.

    The return ticket is meaningless....Lots of people visit the US during the process.....but those are when the petitioner is already inside the US.  Is there a risk of being denied entry?  Yes.  Is it a significant risk?  No one can predict.  CBP might think you are trying to get around the wait for an interview.

    My wife isn't Czech, we just live here. And yes, IR-1 is what I meant. She's been approved for the first stage, but that was right when COVID began, and we've kept her case open but held off on progressing to the medical check and interview phase while we wait things out and assess what we want to do.
     
    But OK, thank you. We'll have our return flights booked and I'll also give them the address and phone number of the family member with whom we'll be staying.

    Green card case?  You mean an on going spouse visa process?
     
    Yes, your wife can visit the US, at CBP discretion.  They may or may not ask about your ongoing case.  Just be honest when they ask. It helps if you have a definite itinerary and return ticket.
     
    Also, I thought CZ is part of the visa waiver program?  Entering on VWP would be the same.

    The I-130 remains valid as long as the relationship continues.  You do not to formally withdraw.  The case will expire at NVC eventually.

    You can also just contact NVC once a year and then later when you do decide to move to the US go through NVC and later steps.

    1.  Your wife can not be deported for working under the table.  Illegal work is ignored for the spouse of a USC.
     
    2.  BS on having any attorney on retainer.  
     
    3.  I wouldn't give this lady any personal information; especially SSN.  The chances for identity fraud and opening financial accounts are high.

    4.  Let it go.  No one has clean hands.  Your wife was working illegally.  This lady took advantage of that.  Just let it go and ignore her.  Is $1500 worth more BS?

    According to NVC, your application at NVC will be stayed for 1 year before it get cancelled.

    Nothing wrong with the idea of H-1B and similar programs. That's how we bring in a lot of very qualified talent to the US...including jobs that US residents just are not equipped for right now and are in demand today. Not everybody wants to spend 4-7+ years studying (H-1B requires a 4 year degree) in a profession they aren't interested in. The number of unemployed computer engineers, doctors, etc. is pretty few and far between.
     
    The issue is the implementation, which has permitted broad abuse of the program via both US and foreign agencies to fill seats, and the too-often rubber stamping that some companies (or their hiring agencies) receive.
    They have - at least anecdotally - kicked up scrutiny of the prevailing wage requirement in the recent couple years. Although renewals tend to skate by still IMO.
    They have not, IMHO, addressed the issue of being unable to find a worker locally. Far too often this is breezed over.

    Sounds good. Another reason to get them done before the exam is their prices are usually inflated because they have you over the fire so to speak, you're there and need them done. Look for a red Cross or other type of organization that will offer them cheaper than at the exam.
     I believe in the Philippines it really doesn't matter because they include the vaccinations in the cost of the medical, so you might want to check that out also. Maybe your medical will include them in the price.

    She will only need about 4 vaccines in actuality, if she doesn't have them already. If you are talking about the Hep B vaccine, she doesn't need that. Only visa applicants 18 years old or younger need to get the Hep B vaccine.

    Most kids no longer get chicken pox because of the vaccine.  If you've had chicken pox you can declare that and you dont need the varicella vx. For instance my kiddo had the vx as a baby and has never had chicken pox.  But i had it as a baby and just declared it so didnt need the vx. I have a chicken pox scar as proof too (and a titre test. Lol) 
     
    Even if you gotten chicken pox, as an adult it's a good idea to have the varicella vx later in life to prevent shingles.

    One of the most regularly created threads in this section is "Can I visit the US while my application is pending?" So I thought I'd create a thread on it with the aim of reducing clutter and having all of the information in one place. Currently there are hundreds of individual threads in this section on the question!
    The simple answer to this question is that if you are from a VWP country or have a tourist visa yes, you are allowed to visit while your visa is pending, but you may well face extra scrutiny because of the pending CR1/IR1. The CBP officer at your point of entry has the final say on whether you will be admitted. If he/she feels that you are not going to return home then they may deny you entry to the United States. It's up to you to convince the officer that you will return home. Make sure you only answer what you are asked and never lie to the officer.
    Sometimes you will get asked for proof of ties to your home country to help convince the officer that you are going to return home after your visit. Great examples of ties to your home country include:
    - A letter from your employer stating when you are expected to return to work
    - If you are in school/college instead of work evidence that you are studying in your home country
    - A copy of your NOA1 to show you are following the process legally
    - A printout of your flight itinerary showing your return flight home
    - Evidence of ongoing home ownership/rental in your home country
    Nobody wants to be turned back at the airport/border. Every visit is different depending on your circumstances (amount of previous visits and length of visit etc) and the CBP officer you get at the point of entry. Why not share your experience here as the visit can be stressful and it's great for people to see others previous experiences. Have you ever been denied and why? What questions have you been asked?
