    As it stands there are many September and October filers still waiting. I don’t even want to suggest August although logically of course anyone before Sept 22nd can put a case enquiry in. 

     

    I think something has got to give with their processing and hopefully it works out quicker for everyone! ❤️

     

    I think it is absolutely random at this point. I have talked to so many officers and I think that yes there is a general sense of first come first serve but with a perspective to the month and not each individual applicant. Fun fact my expedite request was denied and then my card was approved. What can I say they have a unique way of working.

    To be honest the expedite didn't do it was because of the senator I used. They literally called me and told me I got approved before I even received an email.

    I mean of course and being a B2 visa and applying for AOS is crazy. But there is loops in the system and people know them and use them. Like the dude above with the J1 and the asylum. In my schools here in MI there is dozens of people that are from Eastern Europeans countries that clearly don't qualify for asylum. They apply for it then the application takes for ever to process and in the meanwhile they are scouting for someone to get married. Then they apply for AOS through marriage. Unethical yes, illegal well depends thousands of people still do that.

    I really don't think it has to do with the category you are adjusting from. There is K1 waiting for months there is other categories waiting for months. It is all a matter of how they prioritize the applications. Of course some are more simple than others. Like my friend had 2 marriages 4 kids different divorces. It took him a lot more than others. Also depends where yu come from. I know people don't pay attention to that but USCIS is not like a all inclusive organization. There is more or less screening from country to country.

    Goodness that is quite a few avenues you've explored. The only thing I would/could say is hopefully you'll get approved naturally quicker than what it would be for them to respond to your expedite. I wouldn't doubt they are inundated with expedites especially with these longer processing times maybe so might take a little longer to get a reply but fingers crossed for you :) 

    Well I would love it if that was the case. However there is a group here where everyone, and I mean everyone who submitted an expedite has been approved. I am talking about people with the smallest reasons. Some of them even say in this forum that they weren't expecting to be approved and that they just gave it a shot. Some of them receive their cards withing days. It is what it is at this point I am ready for whatever happens. Told my boss about it and and will go on vacation when  I lose my job and enjoy the my time off. My only fear is my wife and what will happen will our coverage.

    Worst case, my plan is I'll do a case inquiry at the end of May (when I'm due then) and if I don't hear anything, I'll expedite in late June! I'd want to do whatever I can to get it as I really just want to go home over the summer and won't be able to afford it last minute. 

    I have tried everything under the sun.

    Congressman

    Ombudsman

    Call every day

    Submit E-Request

    Expedition

     

    But you know what's amazing they haven't denied anything here. All those things are in process. No responds no updates no nothing. The only thing I can say is the last few weeks I am in peace. I can say I tried everything and it didn't work.

    Just reading through last night comments and the fact they have barely got most of October down is a scary concept. I was kinda fooling around with numbers on scans in old app and seen quite a few late September filers not approved either. They definitely do not approve in their "first come, first served" basis.

     

    I don't want to sound negative about NBC but I can only predict their processing times to increase much further to 5-7 months and being inundated with loads more case inquiries as they clearly can't keep up the demand/back log. But I feel they can't cry wolf as they are aware of the situation. I just feel it needs managed much better and I feel they need to disperse cases out amongst other processing centers. 

     

    And then my thinking is we have Dec filers who I would assume be due to be possibly touched some stage next month as some of the earliest filers hit their so proclaimed 'normal processing times'. 

     

     

    I am right there with you at this point our local office seems to be very fast and i am looking forward for the interview to be scheduled within April. EAD is a waste of time they might never approve it.

    Maybe the more productive officers are working on November maybe? I do think they will plow through November in April as I think the earliest December filers will be within their 'normal processing times' as of mid-April just scraping 4.5 months. So they gotta get their skates on I would think :) 

    I really agree with your posts. This makes no sense there is no first come first serve. When I use the app tracker it looks like there are some cases all approved and then. There are other spots with 100 cases none of them approved. I applied my EAD Nov 6th, still no reply still no update still nothing.

    I got married last August and sent my application for the AOS as a concurrent filling in the end of November, PD is 11/23 and the notice date is 11/28.
    On the same 11/28, I got an update that my "Fingerprint Fee was Received"... and that was it.
    Until today I haven't got any other update, and still haven't done my biometrics.
    Is anyone here still waiting for the biometrics appointment too? 

    One side note, I went back to Brazil last June to get my O1 visa stamp in my passport, so I had to take my biometrics there for it. I wonder if since they took my biometric in such a recent time, it's already in the system and that explain why I haven't got any notice?

    I came here as an F-1 the fingerprints that they took for you as an F-1 student or O-1 have nothing to do with your AOS application. You have to be subject to a fingerprint for all immigration adjustments. It is not only for background check but in order to establish your identity.

I would hope that if EAD processing times increased beyond 4.5-6.5 months in the future that USCIS would update this on their website so you could apply slightly before that '180 mark'. Most are lucky I would think to get a GC interview before the EAD expiration. 

     

    But again, awful situation people could and have potentially been in with the thread of losing their jobs over the head of this. Some don't necessarily lose their job and are put on leave instead until it gets approved.

     

    I don't think mentally I could go through this wait again :( 

    You are right the problem with the leave is your boss won't wait for ever and here we are talking about extremely uncertain processing procedures. They ask me how long could this take. There is no certain answer to this.

    You won't have received your EAD AP in three months check the processing times. Also if you leave for 2-3 months you might be issued an RFE or called for an interview which might have severe implications to your application.

    I really appreciated my K1 visa getting expedited so I was able to see my man before his deployment.

    I mean for me the medical coverage is the highest priority. My wife's medical exams cost $100,000 plus

  13. I requested to expedite the case for I-765. I am currently employed and my wife is covered under my health insurance. She has a medical condition and it will be unbearable for us to pay her medical bills out of pocket. I will soon be fired and the expedite has gone to . I must tell you guys you can't imagine this nightmare. I got to work every day and HR send me 30 days to termination update I-9. 29 days to termination update I-9. 28 days to termination.... It took me months to get this position. I won't be able to make house and car payments. USCIS tells me to wait... wait... wait... wait...

    We faxed our evidence on 03/05 and the app was updated on 03/14 that a new card was being produced and today I received my NOA2

    Mine is an expediting nightmare. I submitted the request and they ask me for evidence immediately I faxed them the same day Feb 19th and I haven't heard a single thing back from them. It has been more than a month.
