I dont see what they would be able to? The immigrant is the petitioner/applicant on all three forms. The USC is only the applicant for the I864.

You are probably right whenever my wife called for I-485 they asked are you the applicant or the petitioner and she said I am the USC and by husband is the beneficiary and they always talked to her. Only for the I-765 they said it is my application and that she cant ask questions without me.

Started my call with USCIS at 7:03am CST. "You're wait time will be 1-3 minutes". It picked up to their tier 1 officer immediately. I explained the BC issue and she escalated my call. "You're wait time is 5-10 minutes". After an hour of sitting on hold some guy picks up and asks me my name and date of birth.

Him: Are you calling for yourself or someone else?

Me: I'm calling on behalf of my husband

    Him: Is he with you?

Me: No, because I have to be at work. And guess what!? He can't be with me at work because he can't be employed because you all are slow

Him: *sits in silence for about 30 seconds* I need his authorization to discuss the case

Me: I got his authorization before I left for work

Him: I need to hear him say it

Me: Well, he can't because he's not here.

Him: Then there is nothing I can do for you right now

Me: So you're gonna let me sit on hold for an hour last night and an hour this morning and then go 'sorry we wasted your life'? Just like with how long this ******** process is taking?

    Him: *More silence*

Me: Why did someone say they were going to escalate my call if they knew you all couldn't do anything if my husband wasn't present with me?

Him: *30 seconds of silence* I don't know
Me: You need to provide better training. That should have been told to me immediately rather than wasting my day.

    Me: *hangs up*

If any of you all ever wanted to yell at USCIS, I got you already.

Literally that is exactly that happened to my wife. I called back furious checked with them and it is true. Spouse can call for I-485 but not for I-765.

Yeah, you're telling me! We've pretty much come to the conclusion that my BC is totally fine but that they just lost it. This is just what happens when you hold onto documents for 6 months.

The NBC in Lee's Summit is 15 mins from where I live, so if I ever end up working there I'll show them how NOT to lose documents like this.

As far as I saw, you're right. Nowhere does it show country of issue but I thought this was pretty normal and that they'd know this having received many UK BC's.

Thank you though! My wife is repeat calling USCIS this morning to clarify, and I have an InfoPass scheduled for Tuesday for another matter so I'll also raise it with them then and see what they say. All I could really do was re-send another copy, you can't translate a BC that's in English, to English that makes no sense at all

I have been dealing with the US government for a while and I know how they accept and deny things so I have learn every acceptable document in the world. For example in my home country you take a birth certificate for foreign use so they include the country and everything. Then I take it to be translated by my country's official translating service (it takes freaking months but well they accept that one). Then I take the official translations and originals and have them be stamped with the Apostille stamp. Also I know that everyone says send in the copied and that might as well work perfectly for many. But I always make extra certified copies and send them in. This was a lot of extra work and it took me months to compete the packet and a lot of frustration. I haven't received a RFE or anything yet.  Copies work perfectly but US authorities have a hard on for stamped and authorized papers and originals so I always take the extra mile to make sure everything I provided was overly stamped approved and authorized. I even had my marriage license stamped with the Apostille stamp I just shows them that there is no way on earth this copy is fake or altered. I did the same process with every single document possible. In the past I think that USCIS was far more relaxed in their applications. Currently, they are scrutinizing every single application and RFEs have increase dramatically. Again I know copies work and I don't want to say that everyone who provides copies will receive an RFE but I think certified copies can't be disputed. I also send the double amount of everything. Just in case they lose one I included a second envelope with all document backups.

I wonder how many times they are going to keep pushing back? Whilst 'pushing back' on inquiry dates more filers keep filing as months go on. Their system is going to crack soon. There's only so many delays they can have in place.

I'm trying not to let it get to me but I can see them gradually increasing to 5.5-7.5 months, then 6-8 months. Any wander why there is so many expedites?

I sound like such a sour soul and apologies for that. I just wish they would transfer cases but go figure :P

I know I might sound repetitive but they don't want to make this process easier and faster if anything this is the administration's goal to make it as hard as possible. This is part of their anti immigration campaigns. They can't change the laws to stop immigrants from coming without proper congress or senate approval so they are backlogging the system in order to discourage immigration. I won't be surprised if the immigration timeline goes up to 12 months for EAD at some point. If you look at the USCIS historical average times. They have increased so much it is crazy. I am thinking about removal of conditions coming up soon. There is people there pending 22 months+ and there is no local office difference they are all getting processed in the big centers.  By the time I apply and with this backlog it will take me 40 months for removal of conditions.

wait for them to tell you to do it! They will probably ask you to do it and bring the medical exam form to the interview. Welcome to the journey :)

I was looking at your timeline and it is interesting. Did you have a boyfriend that lived in the US before you moved here? In that case if you haven't disclosed that during the interview that might considered fraud. You know F-1 is a nonmmigrant visa which mean that you have to prove that you had intention to go back at the time of application. Read the ombudsman report they deny a lot of visas on the fact that they are examining the legitimacy of their visas at the initial entry. I doubt they would have granted you an F-1 if they knew your long time boyfriend lived in the US.

thank you! the only thing i am curious about is the medical exam. do i have to take it before filing, and include the results in my package or wait for them to tell me when to do it?

What you are doing is not illegal. It is unethical and they know you came here with your B2 to get married. They a lot of controversy about it here because K1 people go through hell to come here and you kind of skipped the line so you can imagine. However, you need to prepare things have changed during this administration and they might make you go through a lot of questions to prove all this was legitimate.

Hi guys , I want to ask when I expect REF after filling AOS ?

it has been 60 days with no update although I did biometric fingerprints !

Dude I went 145 days without update just relax. Check the processing times  it will give you an idea of what you should be expecting. You don't have any information about your location so I can't help. There is people that wait for 3 months min and others waiting for 32 months or even more.

I forgot to share that a few days ago, I was searching on statistics at the USCIS site and found a manual describing in full detail, their plan on how to decrease the backlog.

Appeared to me very thorough and sound, with the only downside of being dated back to 2006. 😅 Way to go!

This administration has no intention of decreasing the processing times. This is not a new process they know the impact of their decisions. I just tell myself to wait and wait and wait.

Oh I have a feeling wee ‘Janny’ is working on mine someday when she feels like it or can be bothered 🤪

Janny also has a personal life you can't be so selfish she can't just look at the computer 8 hours out of the day for your immigration benefits. Grow some perspective here. She needs to go to Florida get some rest jeeez you foreigners don't seem to understand.

I couldnt agree more. The pain, hurt and everything comes with it is unbearable. They have a problem processing, they obviously recognise it with increasing to 4.5-6.5 months yet still don’t seem to be sharing the workload out with other processing centres. They probably don’t realise the impact this has on couples.

In whatever positive I can strike is thatI really do feel that April will see many Oct/November filers flooding in too. I’ve been the grinch the past few days and the words and names I’ve been using to describe this wait have been disgraceful!! My mouth should have been washed out with soap lol 😂

I think they are fully aware of the impact that the delays have. I think this is the retarded way the government decided to discourage anyone that wanted to commit fraud and overall slow down immigration to point that people won't consider applying for benefits here. I mean if you look at the processing time it is insane. Based on USCIS the applications have declined dramatically the last years across all different immigration categories. However processing times have increased 3-4 times since 2016. This is an attempt to slow down immigration to a standstill.

Utterly unfair indeed. It's like they're completely unaware that they're dealing with people's lives.

We're just a number for them! 😢 *read with hyper dramatic voice*

Maybe we should send LOTS of family pictures, moving stories and a poignant soundtrack to make them emotional and feel compelled to work hard on our cases.

I moved here 6 years ago and I got a feel for the immigration vibe right away. When I was having my interview for the F-1 visa. A guy beside me said that he is going to study in MIT and has an I-20 and blah blah blah for a PhD. Then the lady goes like do you know anyone in the US. He said I met this person through like an MIT community which is a fellow PhD student and that they will be roommates and blah blah blah. Because the person was a female his F-1 was denied on the spot. They gave him a piece of paper that said what the next steps are and that you should apply in the future and blah blah. When i got outside the embassy the dude was crying his eyes out. Can you imagine all the time spend all the studying all the pain to get in the MIT and then boom gone because of an assumption. Like that dude will had to get married to stay? He would be sponsored by any company in his field for a green card. Just doesn't make sense.

Thanks for sharing guys. Might sound dumb, but a shared pain seems more bearable. 💚

I woke up around 4am, thinking of this and haven't been able to sleep again. I hate being angry as it is basically useless in this case. Who am I going to yell at in order to force them to get things done correctly?

I bet the agents scheduling those cases brag about it, like: "Yeah bro, well, I'm already working on Dec/Jan cases" Duh! Because you skipped like 10,000 preceding files?!

I dont know why it is happening but it is unfair we got families and plans and everything just like everyone else there is a kid in my timeline that applied Nov 6th and got his green card on Jan 21st. I am like wow and I am sitting here like if I get my green card by June I'll be happy.

Is it wrong that I'm having a fit of rage because someone from my same local office who filed a month and a half after us, already has the interview scheduled while we're stuck on "fingerprint fee received"? 😠 It is totally not right. Feels exactly like when someone jumps the queue. And I can't do a thing! I feel angry, frustrated and powerless. I know I'm not the only one experiencing this, but this delay makes me feel singled out.

On a more positive note, thanks so much to rrobin0609 and Derlon, for sharing their decoration/ remodeling pics. 🙌 I'm totally obsessed with decorating our home and truth to be told, I'm dying about traveling, to get stuff for the house. :P Meanwhile, we'll keep on buying at Home Depot and Ikea.

P.S.: How do I tag members on a post?

So listen to this I filed in November 9th for AOS in Detroit filed office. And this dude that filed on Jan 20 already has had the interview. First come first serve my ###. And I am still here thanking god I got the EAD.

Yes you’re absolutely right that works just like some fake marriages get approved as well. I just wish everyone who needs and deserves it to have a fast process for AOS🙏 Good luck everyone and let’s be respectful to each other and positive ✌🏼

I wish the best luck to you and your family. It would be amazing if you could update your timeline for Detroit helps everyone to get a perspective.

Don’t judge everyone on someone’s experience! Not everyone applies for asylum for no reason..some people really need it! You don’t know my story too. And I’m not “scouting” anyone to get married to get papers! I have a daughter and I love my husband there’s no reason to wait for asylum for YEARS when I can go through AOS

Not everyone is the same you are right. There is a reason why the majority of asylum applications are denied. It is extremely hard to get one. The majority of people that apply for them use them as an extension of time in order to settle their life here. I have been in this country for 6 years now and been part of immigration communities for a long time. You are not the first one. You know what it obviously works!!!
