Nebraska. Last I checked, processing time there is 19 months. But at this point, since I already have the extension letter, I'm good. It will most probably still be stuck/processing when I file N400 next year anyway.

I would not bother with affidavits.  They are extremely weak.  There should be plenty of quality evidence available.  Concentrate on quality...not quantity.

It says right above that section to select all that apply if you're not filing jointly with your spouse or parent's spouse. I genuinely think it got rejected because she selected that she's applying jointly and then also selected all the applicable extra boxes in the waiver section. Admittedly I've never looked at any of the waivers, but that's how the form reads imo.

in other news, my bio re-use letter came in the mail today. No sign of the receipt notice with extension yet though.

    4.  I prefer a personal check because, it can be easily tracked, easily stopped if needed, and USCIS will resubmit once if declined for insufficient funds.  USCIS does not resubmit card charges if declined.

I have only heard of that making an impact for initial petitions, (such as I-129) when evidence was omitted.   Haven’t seen it for AOS or ROC with new evidence.   Normally evidence of events that occurred after the packet is sent would be submitted at the interview, if there is one.

After a million years, I finally have an update.

Got another RFE on 02/16/22. They wanted evidences of our shared life together. 🙄 My response was an inch-thick file of documents and photos. Status update of receipt on 03/25/22, said our case is on Initial Review. Initial review after almost 2 years, are you kidding me?! 😭

Then I got a text from USCIS earlier that I have a case status update. I thought it would be receipt of my EAD renewal that I sent last week. Turned out to be an AOS status update: New Card Is Being Produced. 🥳 So they approved our case without an interview!

Something that needs to be kept in mind is that immigration is a privilege, not a right.  So, as frustrating and annoying as it can be, it's a matter of being at the mercy of USCIS.  At least you're with your partner and can travel and work.  Lots of people are stuck in limbo, separated or are stuck and can't work.  Gotta search for the silver linings or the process will drive you mad!

    Hi everyone,

just an update for a few those still remaining here - our visa was issued in Feb 2020 and I couldn't leave due to notice length at work, a month later travel ban was introduced.

We were never part of the lawsuit. Had my interview and got my expired K1 reissued in London on the 1st July, 2021. Now just waiting for the courier update.

Trese reacted to Mike E in New policy from SSA regarding mailing USCIS documents and passports
SSA has issued a new policy that will allow non citizens  to get an SSN or updated SS card without sending a passport, EAD, green card,  or other irreplaceable document:

    https://secure.ssa.gov/apps10/reference.nsf/links/05262021015248PM

“Individuals also qualify for an EXI if they are unable or unwilling to mail original evidence documents. ”

    AND

”IMPORTANT: Do NOT request a non-citizen to submit his or her immigration documents by mail or using the drop box. Due to DHS regulations, non-citizens are required to have their immigration documents in their possession at all times (GN00303.610.B).”

Do not allow yourself to be badgered by an SSA bureaucrat into breaking the law.  Do not yield possession of these documents.

Had interview today at LA. Very fast. Took lease, joint bank account, photos, birth certificate and marriage certificate. Asked same questions in the application. Then asked about our marriage: how we met, when we decided to get married, if we did any traveling in the US, how many times we visited each other before we got married. I was stressed because husband said the wrong marriage date but was okay. Approved on spot.

Trese reacted to MarryMe987654 in Can I continue working remotely while waiting for an EAD?
I work for a Canadian company while in the Philippines. When my K1 visa was approved, I left my job.
I could have continued working for them since my pay is sent to the Philippines anyway but I didn't. It's too risky. It's a kind of "lie" that can haunt you later as it is hard to keep up with covering up a "lie".

If I continued working while waiting for EAD, I will also have to not report my earnings for tax purposes.
In addition, I don't think my Canadian company will let me continue working without a permit. If I have to lie to them too about my location, that's another integrity issue that I have to face.

I am now back with the same company and working from home.

    Hope this helps!

No.  You did do something illegal.  You just didn't realize it was illegal.

By your own words, you worked in the US for your Canadian employer.  That was illegal and a violation of your entry into the US.  You just didn't realize it was illegal.

By your own words, you were in the US for over 100 days and left all your stuff here - you basically brought your entire life including your keys.  That's not consistent with someone taking a vacation.  That looks like someone moved to the US.  That's illegal even if you didn't know it.

Yes, it's certain you're in the system.

If you try to visit in a month, you will be forced to buy a return ticket home and you will listed as a repeat offender trying to enter the US and it will make it worse for you.  You will likely be deported with a 5 years ban.  This means you would be denied a spousal visa after waiting 12-18 months and you would need a waiver for your deportation - yeah, so making your situation way worse.  You might not get the waiver.  DON'T EVEN TRY THIS.

You have to look at this from CBP's point of view.  You spent over a 100 days living and working in the US without proper authorization.  Essentially, you were an illegal immigrant.  You have been flagged as such.  Trying to enter again without a visa would be a BIG MISTAKE because you will be deported with a 5 years ban.

Your chances of a B-2 visitor visa are zero.

Either your wife files for a spousal visa which will take 12-18 months or she moves to Canada.  She can visit you.  Your days of visiting her are over.

So we had our interview on the 5th and were told that our case needed further investigation. After nearly 2 weeks of overthinking and manically refreshing the USCIS page, yesterday it changed to say my new card is being produced! I realise that things moved pretty fast for us (our field office is Las Vegas), but am so, so relieved and happy. Best of luck to all my fellow May filers and try not to worry too much if you don't get approval right away.
