    CBP says --
     
    Lawful Permanent Residents (LPR) of the U.S. must present a Permanent Resident Card ("Green Card", Form I-551), a Reentry Permit (if gone for more than 1 year), or a Returning Resident Visa (if gone for 2 years or more) to reenter the United States.
     
    United States (U.S.) LPRs do not need a passport to enter the U.S. as per 8 CFR 211.1(a), however, they may need a passport to enter another country. Please contact the embassy of the foreign country you will be traveling to for their requirements.
     
    While CBP does not require the passport as noted above, the airlines may have their own requirements, please check with your airlines prior to travel. Also, travel documents for LPRs do not need to be valid for any certain amount of time. Your LPR card only needs to be valid on the day that you are entering the US.

    Also, Americans are required to present their unexpired US passport when returning from international air travel.  There are some exceptions:
    Traveler may present a NEXUS card, but only at designated NEXUS locations Military personnel on active duty may be boarded without a passport if in possession of official travel orders and military ID Merchant mariners may be boarded without a passport if in possession of US Merchant Mariner Card indicating US citizenship Note that entry requirements are different for land or sea travel.

    In Louisiana, "a marriage license may be issued in any parish, regardless of where the ceremony is to be performed or where the parties reside" as long as the ceremony takes place in the state.
     
    In any case, Ascension parish may also waive the requirement for SSN if you choose to apply for a marriage license there -- "If no number has been issued, that person must appear in person and sign a statement to that effect."

    The letter says your fiance can't be interviewed until the US Embassy in Manila (not your fiance) receives the physical case files.
     
    Once your fiance has an email from NVC with his MNL#, he can proceed with his medical at SLEC.  No need to wait for any snail mail.
     
    As for the K1 visa interview, wait for the status on CEAC to show READY before scheduling.

    Unless your husband's income will continue from the same source, it is irrelevant, not asked for, and cannot be used in any way.
     
    If you take all your tips in cash or any in cash that don't show in the gross pay on your pay stub, then you just make sure you have claimed those tips as income on your tax returns.  If you have not, you are going to need a qualified joint sponsor.
     
    The self employed have similar issues.
     
    If you are in the same job and have been claiming your tips the last three years, showing a "total income" from line 22 of your 1040 form, you should be OK.  If not, joint sponsor time.  It IS, what it IS.

    I don't think it's fair to immediately insinuate the wife has found someone new and that's the reason this is happening. I haven't seen anything in what he's describing, so far, that indicates she's cheating or met someone new in the US. See below.
     
     
     
    Based on many comments on this thread, particularly along the lines of the above in bold, I agree that it is most likely something she is struggling with. Whether it's directly symptomatic of the medication she's taking, or it's a combination of other things (i.e. homesickness) in addition to the type of medication she is on, that's what it looks like to me. Were the two of you educated on possible side effects of mixing something like Chantix with whatever anxiety medication she is on? Some medications cannot be combined with other types of medication. I have a relative who was put on specific anxiety medication a few years ago, along with some other meds for something unrelated, and it literally made her a crazy person. She was not herself, and as soon as she was taken off the weird med combo, she returned to her old self.
     
    I'm not saying taking your wife off one of the meds she's on will magically turn her back into the person you knew before this all began happening, but you just never know what meds can do to you, both physically and mentally. Sometimes it's out of your control and you don't even realize it in the middle of it.
     
    I definitely recommend seeing if she'd be willing to see someone (therapist), either with you or at least on her own. As others said - if she leaves now without a green card or advanced parole, she won't be able to come back under the same circumstances she's currently here under.

    I just re read this topic and OMG!!!! Now, I am in a way better situation, I got my dream job  (French teacher in Houston, TX)I am still with the father of my first baby, who is now 4 almost 5, and we had 2 more after... I never heard from my ex-husband after my first baby was born when he served me with the divorce paper...But I got my green card with no problem. I went to the interview I was very pregnant of my second baby, the officer asked who was the father? husband or new relationship? I said new relationship and that was it, she said "you are approved" in February 2016. I just feel like I had to update you guys!!! bye

    There is no such thing as an emergency visa.  It doesn't exist. 
     
    You would need a tourist visa to come see your fiance in the US. 
     
    You are asking about visiting the US, so that means a tourist visa.  Wanting to visit during the K1 process has nothing to do with the K1. It would be a separate and new process for a tourist visa.

    Called my CPA, he said you can request an extension online, here is the link to a list of free services below....

    He also said, and I see people saying it here that you just need to send a letter saying you didn't make enough for the tax year so you don't need to file. He said why that is accurate, and will work, since you are obviously involved in immigration proceedings that is not what you want to do. He says he makes a good living of back-filing taxes for people that get stuck out of the blue because all of a sudden USCIS wants to see a tax transcript from a year they didn't file because they didn't make enough money. If you send the letter saying I didn't make enough, you really didn't file, so you will not be able to get a transcript for that year. He said file with a zero income to make sure you can always get a transcript down the line when you might need it, and also you should file because even though you had no income you may still qualify for certain programs or rebates and actually get a refund, and it helps since you will be filing with your now husband you can use the tax transcript for proof of commingled finances if needed down the line. Just because you didn't make any money it still shows you and your spouse filing together  like USCIS likes to see you are doing the husband and wife thing like your supposed to in the marriage. He also said to make you aware that there were a bunch of tax changes for this year including changes to the ITIN process. He said one of the things they changed was that if an ITIN number isn't used for 3 years it gets removed from the system or something so you would have to get a new one. Don't think that matters to you as you will be getting the ITIN for the first time, and once your spouse gets a SS number the ITIN won't matter. His advice was to get an extension because that will be the path of least resistance because coming up with an ITIN and getting your taxes filed by the 15th of next month from outside the United States is going to be a challenge, he was thinking it could be done, but wasn't sure. Also with the extension you don't have to wait until October to file, you just get that much time, you come back to the US in August or something make filing your taxes your first priority to get it out of the way.

    Oh dear.... 18 years of working for an airline here. The automated check-in procedure (online or self-service machines) won't work for you. You will have to desk check-in. The thing is, TCX is a "holiday" airline, not a scheduled carrier. As such, the majority of their passengers are tourists going for their 2 weeks of Disney, Walmart and Jack in the Box. They hardly ever handle immigrants, USCs or GC holders. That doesn't mean they don't know what to do. 
     
    I can assure you that an ESTA is not required and you don't even qualify for the VWP. The VWP requires a return ticket within 90 days and no immigration intent. You cannot satisfy either of those conditions. Don't worry, the people on the phone lines are not the ones who check people in all day, every day. When you get to the airport, the person at the desk will know what to do. All of us who came here on immigrant visas and K-1 visas from the U.K. travelled just fine with no ESTA.

    Your NOA2 has a 4 month expiration date

    Your K1 visa (when issued) has 6 months expiration date from the date of the visa medical (the expiration date will be on the visa when its in the passport)
     
    Your 90 days to marry starts the date your fiancé lands in the USA with his K1 visa
     
    Edit: you also dont need the entire I-129F packet, the embassy will send him a photocopy of the form that was approved, just focus on your evidence/documents needed for the interview

    You (the USC) need to file a petition first.  You can mail the petition from anywhere.  Then wait around 6 to 8 months for the petition to be processed.  If the petition is approved, your fiance can apply for a K1 visa at the US consulate in Guangzhou.

    They will look at her passport and it doesnt matter where she flies from. They will question her ties to the country she lives in, not which airport she travels from.

    I get that, but sometimes well-meaning  advice is wrong, and potentially harmful. In this case it could result in OP’s mom not only without a visa but having lost the money spent on the air ticket too. 
     
    fyi: any official US website including the embassy websites for visas (and this is true of both immigrant and non immigrant visas) always tell you not to buy tickets or make any non refundable reservations until you actually have a visa in hand.

    "Guilty until proven innocent" is the same for every country when it comes to tourist visas. It's the law.
    All tourist visa applicants are presumed to have immigrant intent until shown otherwise.
     
     
    A return flight would be worthless, it means nothing for a tourist visa application.
    The embassies specifically tell applicants to never buy flight tickets until they physically have their visa in hand.

    That is true, I was surprise about the interview went, I envisioned a room where you go in and sit and talk. But it was just window tellers and they have about 70 people for each time slot, it was more like a factory or a drive through.

    Also keep in mind the context. Some items of relevance:
    The OP is going through Canada, a very low fraud country. They already sent evidence. How much? We don't know. Are there any red flags? We don't know. How much time have they spent together in person? We don't know. For instance, if there were no red flags, they see each other in person monthly, and they sent all kinds of good, quality evidence initially, then sideloading at NVC is just a waste of time for everybody.
    If they were going through a high fraud embassy like Nigeria (not picking on Nigeria...just an example!) and only met once, then it is very highly recommended to provide more evidence at every opportunity.
     
    Also note that there is no need to send evidence that was already provided with the I-130 or any subsequent RFEs for it. They already have it.
     
    While not asked or likely particularly relevant here, the CO only has to consider evidence provided at the I-130 stage. Anything sent to NVC or provided at or after the interview is considered at their discretion.
