You should be fine.  As @Nitas_man mentioned, this is fairly common where folks applying for a K1 have a religious ceremony, or very elaborate engagement party and are subsequently rejected for the K1 as being “too married”.  They usually go back with a spousal visa application after getting the marriage properly documented and are fine.  We usually see a case like that about once a month or so.

    Good Luck!

My wife, who has had to go through 3 interviews because I worked out of the country twice, has to mention her (2) denied visit visas from back in 2007 at every interview.  It has never been an issue and she always notes that they denied her after we married because we got married LOL.  No issue for you.  Good luck!

It is very common for couples who have been denied K1 for being “too married for K1” (even when it was not an officially registered marriage) to marry and re-file for spouse visa.
Your case is a normal case, the K1 will not affect it, and if asked describe what was done and why it was done exactly the way it happened. You did exactly what you had to do after K1 was denied - legalized your marriage and re-filed for spouse visa.

Advice for others - if you have a wedding ceremony legalize it and file for spouse visa - or wait to hold the ceremony until the K1 is issued and beneficiary is in the US.

    Good luck

It seems like during the K1 interview the CO thought you were too married and therefore did not qualify for a K1 visa.  Since then you took the route of getting a legally recognized marriage, and it would seem you have a lot of evidence include a lot of in person time as a married couple to show the CR1 application is real.  Honestly, I don’t see a lot to be worried about here, the CO may ask about the prior K1 rejection, and I assume you noted that on the DS260, but that is easily explained with your story about the religious wedding prior to the K1 interview.

Personally, I think you should be fine.

JK1880 reacted to Nitas_man in Getting Tax Return Transcript by mail.
So did i.  I ran into the same problems you did awhile back and submitted copies of the return/documentation instead of transcripts.

A copy of the return with every schedule/record of income suffices the same as a transcript.  But we online filed so had records of filing date and acceptance receipt.

I also did manage to pull off getting transcripts sent overseas.  The website doesn’t do good with foreign IP addresses, I used a US VPN to log into the system and that magically the “mismatch error” go away.    As long as the address you are sending the transcript to exactly matches the address on the return they will send it.

I found it easier to submit the return than try to game their system into generating a transcript.

Not having a US number might cause you to have a problem generally showing ties.  Hopefully you have a US-addressed bank account.

Same thing happened to me. I applied for K1 and got denied at embassy level.
Technically, our Petition was approved and Visa was Denied.
For me, After my case was sent back to USCIS. I sent separate withdrawal letter to the service center where my petition was adjudicated which was 'California Service Center'.
I also attached same copy of that withdrawal letter along with I130 petition.
    So,
Have you EVER previously filed a petition for this beneficiary or any other alien? - Answer is Yes
    Name - current spouse name
    place - Dallas, TX
Date of filing - The date you filed petition
    Result - I129f Petition (k1) - Withdrawal

Note: After 6 month of sending petition I got letter from California Service Center saying that my petition was expired and will not be adjudicated again.
My I-130 petition was Approved just few weeks back without any issues..

It sounds like you have everything you need.
Yes, you use form 2555, but you might be able to use form 2555-EZ instead.
We also filed at the IRS office because I did not have a SSN or ITIN. They made a copy of my passport right there and stamped it, so you don't even need to bring a certified copy.

JK1880 reacted to junkmart in FORM 2555?
Hi. It sounds like you are on the right track, and yes you can use 2555 or maybe 1116, like I did. Make sure you mail your W-7 and return to the address listed in the W-7 instruction, and not the address from the 1040 instructions, and put in in the following order: W-7, Certified copy of passport, 1040 with W-2 stapled to it, and then any schedules and/or forms that to you have. For us, we had W-7, W-7 COA, Copy of passport, 1040 with W-2 attached to the bottom half of page 2, Schedule 3, form 1116, form 8965. It took about 3-4 weeks from the date mailed (2/4/19) to get the ITIN, and I am currently waiting for the return to be processed.

I'd like to maybe widen your horizons a bit.

    1. Well looks like my husbands biometrics appointment for Monday is cancelled. I wonder when they were going to notify me?  They never contact when holidays are approaching. It's your responsibility to keep posted on these matters. You check web sites, USCIS, NVC and most of all your Embassy for the most current situation.

The U.S. Embassy London and our Consulates in Belfast and Edinburgh are CLOSED for Christmas.
    Christmas Closures
We will be closed and there will be NO visa or passport services on these days:
Monday, 24 December (closed by Executive Order) Tuesday, 25 December (UK Boxing Day holiday) Wednesday, 26 December (Christmas Day holiday) The U.S. Embassy in London and our Consulates in Belfast and Edinburgh will re-open for business on Thursday, 27 December.
We will also be open on Monday, December 31st.

    2. If I didn't keep abreast of current events I may have taken the 2 hour drive for his scheduled appointment!  This validates my answer above. This is for everyone out there. It is your responsibility to check your Embassy/Consulates website for the most current conditions and operating hours before you make you plans to attend any interview or procedure.

    3. Things may be shut down much longer since the president is not getting his way.  So Americans want to keep those who are coming into our country illegally by building a wall but you and your fiancé are spending a year of your time, plus all this money to do it legally. Don't you find something wrong with this picture?

    4. We need to give him 5 7 billion for the wall Mexico was supposed to pay for.  Understanding the amount of money that if the wall were to be built the US would save from the "welfare" programs by those entering the country illegally is more than enough to pay for the wall. Let's look at a few. If an illegal Alien (IA) is not using the medical facility without payment there is a savings. (A IA uses the emergency room for their primary care and they are not required to pay up front but leave and are never heard from again. Their bill goes unpaid, the hospital charges it off by raising rates to those who pay either from personal funds or from medical insurance. Medical insurance goes up and everyday people who pay taxes and buy health insurance see an increase in premiums).  If the IA is not using welfare there is a savings. If the IA is not using the food stamp program their is a savings there. The list goes on and on. So add up those savings, that your and my taxes pay so an IA can come into the country illegally is a valid savings that could be used for the WALL. So Mexico might not be sitting down at a desk and writing out a check for payment to install the wall doesn't mean it cannot be paid for from just the cost saving of keeping Mexican Citizen's and other South American's out. So yes you don't see Mexico stepping up but the savings will be there to pay for the wall.

Here is a few statics I can share with you.
In 2014, 63 percent of households headed by a non-citizen reported that they used at least one welfare program, compared to 35 percent of native-headed households. Welfare use drops to 58 percent for non-citizen households and 30 percent for native households if cash payments from the Earned Income Tax Credit (EITC) are not counted as welfare. EITC recipients pay no federal income tax. Like other welfare, the EITC is a means-tested, anti-poverty program, but unlike other programs one has to work to receive it. Compared to native households, non-citizen households have much higher use of food programs (45 percent vs. 21 percent for natives) and Medicaid (50 percent vs. 23 percent for natives). https://cis.org/Report/63-NonCitizen-Households-Access-Welfare-Programs

I personally have no problem with anyone who can receive a visa legally to immigrate to this country. None what so ever. What I have a problem with are those who walk across the boarder that are not screened for illness's, if the have the ability to be self sustaining and can contribute to the country and not be a burden. It's everything that you and I have done for someone in our family to immigrate to this country legally I want them to adhere to. I don't think that is much to ask.

Anything incomplete/missing can cause an RFE (i.e. a missing checkbox). Something immaterial to adjudication of the petition is unlikely to do so.
I wouldn't be worried about one this one field personally. I've never seen or heard of an RFE actually being issued for it.

It's a fairly common mistake.  Since this is filed for a spouse, they know who the beneficiary's spouse is in at least two places already, including one place on that page.  Don't worry about it.
