    HuberKimFamily reacted to Fullbien in Return to the US before Spouse or With?
    Hi all,

    I'm a US Citizen currently living abroad with my husband (been here for about 4 years, together for 3.5, married for 5 months), and we filed the I-130 in December 2019 (woo!) while I'd love a response on our case by June/July, given other timelines from couples coming from the same country I'm not expecting to hear back until Sept/Oct of this year. Due to various factors, I may end up moving back to the US in November. While it will be super difficult to be apart for an unspecified amount of time, it might be a good way to get settled and get my feet under me again before my husband moves to the states as well.

    My question is this: Strictly from an immigration standpoint, is there an advantage or disadvantage to me moving back to the states before my husband after having submitted an I-130? (I will have a joint sponsor)

    Thank you in advance for any advice, and in general to all the helpful people on this site! What a wonderful resource this is.

    "A general guide used is whether you have been absent from the United States for more than a year."

    The 6 months absence is only a factor in regards to Naturalization requirements;

    "Additionally, absences from the United States of six months or more may disrupt the continuous residency required for naturalization. "

    Yes it is.   Upon initial entry at POE he would receive an I-551 stamp in his passport (green card equivalent) valid for 1 year.    If the Immigration fee has been paid to USCIS his physical green card processing would be initiated.

    Often people use the wrong words, or misinterpret the correct words.  If the visa is in his passport, it will be used upon entry and a stamp next to it substitutes for his green card.  Just take the green card to him when you go to sort things out in Switzerland.

    Yes. He will enter on his IR1 when he goes to visit the US and go through immigration processing. This doesn’t mean that he has to move to the US at that time, though. He can enter, activate his visa (and now will be an LPR so visa validity is no longer in the equation), then can leave and move whenever you are ready to, and he will remain an LPR after entering the US as long as he is not outside the US for more than a year. Which, since he’s moving in June, shouldn’t be a problem

    This seems weird to me. I thought the IR1 visa is a one entry visa which becomes invalid once he enters.

    By the way: Exciting to see some swiss people moving to the US. Where are y’all going to live?

    Me and my husband plan to move back to the US in December 2020 - hopefully 🙏🏻

    Try saying that you did not move an click next. This way that page saves.

    Then go back an edit the page and add the addresses. Read about someone doing that with success. Try it.

    It needs to show on A w2. Whichever year.  But i think the I-864 is better suited for you right now.

    I just looked through the form I-1864 as everyone has stated and I see that I can include my husband's asset (optional) with this form. Thank you!

    Safe to say you're already there.
    Count 15 working days after the "sent" date and call to find out if they received your file.
