    Hello to everybody. I have put here some FAQ regarding I-129F/ K3 path.
    To have all necessary information please read EVERYTHING before asking already answered questions.

    1.      What are we talking about?
     
    We are talking about spousal visas.
    There are 2 legal paths to bring your spouse in US.
    The most common one is CR1/IR1 visa – in order to apply for it you have to fulfill I-130 form and attach all required documents.
    K3 path is additional route that is not really used anymore because only few K3 get approved per year. As today, it is considered to be obsolete. In order to apply for it you need to have I130 pending and file I-129F + attach all required documents.

    2.      If K3 is obsolete, why are everyone on this group talking about it?
     
    Some members of this group decided to try K3 route in order to bring their spouse in US while I-130 was pending because of increased processing time in Nebraska Service Center (11-14 months).
    By doing this, we discovered the following: I-129F is systematically denied but I-130 is approved faster (approximatively one month after your I-129F PD).
     
    3.      How do I file I-129F
     
    In order to file I-129F (K3) you must be US Citizen and have an I-130 pending on behalf of your spouse. Once you receive your NOA1 for I-130 you are ready to file I-129F.
    Filing fee: NO FEE
    Needed documents and address: https://www.uscis.gov/i-129f
     
    Documents required to file (I recommend to make a cover letter too):
    -        Form 129F fully completed.
    -        Form G-1145 for e-notification (not mandatory)
    -        Evidence of US Citizenship
    -        Marriage certificate
    -        Divorce decrees if applicable (yours and yours spouse)
    -        NOA 1 of your I-130 filed on behalf of your spouse
    -        1 passport photo of petitioner and 1 passport photo of beneficiary

    4.      Isn’t I-129F for unmarried people / to bring your fiancée?
     
    Yes, it is the same form for fiancée visa but it works for spouses as well.

    5.      What happens if I-129F is approved before I-130?
     
    Then K3 visa can be issued. And you can follow K3 path as explained here : https://www.visajourney.com/content/compare/
    But it is more expensive path and your spouse won’t be able to work right away upon his/her arrival to US.
    You can choose either to go along with K3 path or to ignore it and wait for your I-130 to be approved in order to follow standard route (USCIC – NVC- Embassy)
    It is highly improbable that K3 will be issued though.
     
    6.      Why is this working?
     
    Nobody can tell. And no one knows for how long this will work. I know the case from 2017 where people applied for both and waited 1 year to be approved on I130. Their I129F got denied only a year later.
     
    7.      If I am already in the I-130 process for a long time – should I still file I-129F
     
    If you have approximatively 1- or 2-months waiting time left, then it is probably useless to file. It can help to speed up all other cases.
     
    8.      What is the impact on my I-130 petition?
     
    It can’t hurt it. It can only speed it up.
     
    9.      And if I don’t want to file it?
     
    Then you don’t. It is your choice.

    i have 2 friends one who wife filed for him in march 2019 and the other oct 2018. the march one is moving on to NVC after to RFEs the october one has not heard yet. I don't know what they are going by but it is a long process and thats one way to look at it keep the faith and think ahead already claim it. Good Luck to all

    Am sorry for the disappointment. The best you can do now is to get marry in Nigeria and file again. Getting K1 in Nigeria is tough expecially with divorce hustory or when you someone have past history on attempt to travel out, VO normally look at it as someone looki g for every mean to get in. During my interview anyone with attempt to travel to US before applying for K1 were denied.  Just stay calm and channel your energy to spousal Visa, which I think is the best, if I know better I would have option for spousal visa,it has alot of advantages over Fiance K1 visa. It might be a blessing in disguise.

    Thank Yeap, we have become family here this is very emotional for me , meanwhile my fiancée and I are taking our time to focus on us rather than the immigration drama, she would be moving here soon. God bless you

    Divorces can take a long time to finalize.
     
    Usually a divorce decree states somewhere at which point the couple ceased living together. My final divorce decree was not too far from the time I met my now fiance. But in my divorce paperwork, it indicates the ex-spouse and I hadn't lived together for at least two years.

    Final divorce paper in 2018 and B1/B2 visa interview with your ex wife in same 2018... c"mon you made awhole lot a wrong decisions, please somebody correct me If i'm wrong.. the time frame is too close.
    Your only option is if your relationship with your fiancee is real, get married in Nigeria, give it more facetime together with your new wife and then file for CR1.. Best of luck

    What was the interview like?  What did the CO seem to focus on in their questions to you?  That will give you some indication as to why it was denied.
     
    Your option now is to file the CR-1.. if the K1 was denied due to any finding of inadmissibility (ie. criminal history) that would need to be overcome with the CR-1 as well.  If the K1 was denied due to the CO believing it was a fraudulent relationship, that can be overcome with plenty of more evidence during the CR-1 filing after marriage---more facetime goes a long way with Lagos, too.

    Was there any indication of problems at the interview?
     
    You get married and file a spousal visa.   A spousal visa, if revoked can be appealed at the USCIS.  A K1 petition simply goes to die.

    If this was a K1 visa you have no other option. 
     
    Once USCIS receive your file it will just sit there for one year until it dies. Because USCIS does not reopen files sent back to them.
     
    In some cases USCIS may send email to the petitioner to give more evidence if available and can consider to send back your file to embassy.
    This is very rare because Embassy always recommends to revoke the file and USCIS almost always does that. 
    You can call them to know about the status about what is done to your application.

    I haven't seen anything that would indicate K-1s are affected by this proclamation.  It specifically says "immigrant visas".  Health care becomes a factor for K-1 holders at adjustment of Status.

    They have all the pictures you submitted for  I-129F among other documents , most of which will be returned to you when they are processing you for your fingerprints which is the procedure before your actual interview (if you're lucky enough, you will have few people before you which will  give  you plenty of time to check the docs returned to you in case you need to remember any extra info you've filled before).
     
    Romantic pics and sweet memories you've shared with your partner in between the time you submitted the I-129F and the day of your interview helps. If you have shared your moments on Facebook , screenshot and print them off too.The C.O won't ask to see all your hundreds of pics , it's your choice to set aside the special ones ,like 10 of them and give it to the C.O.please if you can print it with dates on it, cool.You can easily achieve that if most of your pics were take on an IPhone which automatically has dates and location on each pic.Just carefully screenshot them with dates and location and print them on A4 or glossy papers.If those details are not available, that's fine.
     
    Possible questions you are required to prepare for :
     
    The C.O sometimes starts with - Who is filing for you .It's another way of asking the full name of your partner as it's in the applications.
     
    *Tell me about your partner ? Not his or her age or name but about the character and personalities
     
    *What do you have in common? Movies ,sport , whatever .If it's a movie mention a popular movie or tv series which the C.O can relate with (Game of Thrones is one, everyone knows that ) Do your research .
     
    *When was the last time you met physically ? I hope you guys have met again after you applied ?  It helps , if not, it's ok.
     
    *Where does your partner live in the US? Please be short and precise on that . I suggest you go through all these questionnaires with your partner via video call.
     
    *What kind of building does he or she live ? House or apartment? Make sure you know that 
     
    *Who does he or she live with ? It's key because they're trying to determine if he or she will have someone else to cater for and if there will be privacy for both of you .
     
    *What does he or she do for work ? You should know that 
     
    *When are you planning to get married when you get to the US and where ? I suggest you tell the C.O  you have a plan to get married within  a month of your arrival.Ask your partner  to ascertain the nearest court house to him or her where marriage is being conducted .Have the address of the place and possibly your partner should confirm the process and how long it takes to get married at the court house.
     
    Dont panic . The good thing about immigrant visa application interview is that the C.O will give you time to answer your questions.Some people would be asked just 3 questions and some will be asked 7-8.
     
    Please make sure you submit his or her TAX TRANCRIPTS o! because the people who are supposed to process your finger prints and take your supporting documents (their naija staff) forgets at times .I had to go back to the lady after 20minutes of submitting other docs to her when I realized everyone before me submitted the tax transcripts  but I was never asked.Always show them what you bring to the embassy and let them choose what they need to have with them .THE  TAX TRANSCRIPTS  SHOULD BE REQUESTED FOR.
     
    If you've traveled together and you can find the flight/ bus tickets and other receipts, good.If not, no wahala.
