    The chance of a summer wedding was probably minimal before the virus outbreak - k1s take time. I'd say there is almost zero chance now. Everything is shutting down here - airlines aren't flying, Government offices closing etc etc. Its a bummer but the Government is more concerned with trying to prevent people dying than ensuring you can get married on your desired date.

    Suppose he’ll find a joint sponsor. But even in this case he is your main sponsor. Do inmates file taxes, by the way? And what does he write in his I-130 Petition as his residence address...cell number, Unit number, Prison name?

    Yes the USA has instituted some restrictions however the restriction is on Iran (which already had a restriction) and screening  protocols for people coming in from some other countries including Italy and South Korea.
     
    Considering how the virus is spreading in the USA, it is getting to a point where the travel bans will lose relevance because the USA will soon have a higher concentration of the epidemic than most foreign countries so infections will be from within, not visitors.
     
    That said nobody knows what will happen tomorrow or what restrictions will be deployed tomorrow so it is better to come sooner than later. Cutting it close with anything is never recommended.
     
    Remember the president has almost unfettered power to implement policies ties to keeping Americans safe and Trump typically defaults to restricting foreigners/immigrants  from the USA as the solution to any problem.

    Presumably, there have been more visits, resulting in more time together in person and other additional evidence of bona fide relationship.  Whether it will be enough to overcome the REAL REASONS the original petition was denied will depend on those reasons and how valid they appeared or still appear.  I advise the petitioner to make a judgment call based on their own understanding of the totality of the circumstances and motivations.  That it is the beneficiary and not the petitioner who is asking these questions at this time is somewhat worrisome.

    Yep, I have some news. The CR2 visa for stepson is ISSUED (ironically, he won't be using it). For husband CR1 is still REFUSED.

    Please do not use capital letters unless you are angry and want to SCREAM. It’s hard to read. 
    The best is to go to your interview on 3/14 and explain your situation and ask to hold I-485 till your I-360 approval.

    Yes, it's normal to be in AP after being approved. The AP can be as short as 1 day and as long as several years (hey, the latter does NOT apply to you guys:).
    AP means they are working on issuing the visa.
    Just wait, and you will see the status on CEAC changes to ISSUED.

    It's an assumption that if a USC cannot afford themselves, they cannot afford a spouse. However, the reality proves that in most cases an immigrant spouse gets a job and supports both themselves AND a USC spouse. There are lots of jobs in the US available even for those with low English language skills (or none at all).

    M word (sorry for my French), the Embassy is unreachable, today after many attempts on the phone we finally got a rep answering. The guy sounded outsourced in India, he could not provide any info on our case nor the answer to a simple question, Did Embassy get the medical results or not?? He gave us an email address for Immigrant visa Unit and we wrote an email today.
    As far as my husband is concerned, he got info that the medical was received by the Embassy back in December (from the only phone call from the Embassy). Did they misplaced the medical, and don’t want to admit that, or what?

    After 85 days in AP we finally got a word from Paris Embassy - they do NOT have our medical results! They waited THAT long to tell us that now?! I am absolutely disgusted!🤮

    Today (85 days in AP) we finally received an email from the Embassy. "To be able to finish the immigration process" for my son and stepson they request my husband's passport back. Also they request "medical results" - this one is surprising. As far as we know, the medical results had been sent from Lisbon to Paris end of November and received by the Embassy on December 12th (the Embassy confirmed it on the phone).
    Tomorrow morning we are contacting the Embassy via phone to clarify the issue.
    My husband is in USA with me now (on ESTA visit). He will be flying back to France on March 23rd.

    It would be a waste of time/money. She needs to go the immigration route, not the family law one. She needs to fight in the immigration court, in front of the immigration judge.
     
    OP, listen: I know of a similar case where a marriage ended in annulment based on "green-card fraud" even though a U.S. husband refused to sign I-864 and help with AOS to his foreign wife and there was never the "green- card" in the first place. The decision of the family court judge was based purely on allegations of the U.S. husband. Wife fought, and lost. She was placed in removal proceedings. Ultimately, however, she was granted a permanent resident status based on abuse. She had plenty of proof to demonstrate that she was a victim of abuse. And it was the immigration judge's decision to grant her an LPR status.
     
    I advise you to hire a good immigration lawyer experienced in VAWA. If you know you are right, you should fight.

    Nobody "brought" nothing on themselves, it's called life circumstances, my dear. You seem to be young, and may have more patience, good for you. My husband and I are approaching retirement, and life is too short. We already feel being "robbed" of many, many days that could otherwise be lived in happiness.
    It's not ethical to try to shame me into my "privileged position", as well as to compare my situation with the others. Do I feel sorry for those in the same boat? You bet, I am. But it doesn't change the fact of an opportunity to see my husband sooner. It is present, it is there. And we are willing to take a risk. The worst case scenario is being sent back at the border. But at least we tried.
    If my husband were say, from Pakistan, I might have not opened this topic. And there is an option on the Embassy website to request your passport while being in AP, and it's for a reason, so we think we do have this reason. Even if most people here disagree, and I understand it, too.
    For those saying that asking the passport back may slow down the process, I disagree. Passport or no passport, Administrative Processing is under way. Just ask those whose passports were returned to them post-interview and pre-AP, then asked be sent to the Embassy as soon as AP is completed.

    I know of a similar case with a positive result. Happened long time ago to someone I know well. Congratulations on the I-360 approval! Based on this approval, it’s up to the immigration judge to decide your fate. Depends on the reason why they put you in removal proceedings in the first place. Yes, to live in the unknown like that since 2008, it’s really hell. My heart goes for you. Pray that the judge take mercy on you. Good luck!

    Sorry if I missed this, but what is stopping you getting a job? If you already have a conditional GC, you have been here for a while. You clearly speak decent English. The jobs market is absolutely pumping at the moment. At worst you can get a minimum wage job. I know others have suggested counseling, and that is certainly an option, but my reading of your posts is that you are quite certain you will be moving out. If that is the case - if the area you are in is not suitable for the profession you’re in (though I imagine IT jobs are needed most places), move. Or move back to Switzerland if your job and living prospects are better there.
     
    I don’t mean to sound unsympathetic, but I am wondering why you seem intent on staying here if your marriage does break up, when you say you “feel alone and have no contacts”, and have no job, and are worried about becoming homeless, when it sounds like you could return to a comfortable life in a safe, beautiful first world country.

    100% wrong. A person doesn't need to be on the lease in order to be considered a tenant in the legal sense and you can't just kick them out. Especially if you happen to be married to them.

    Okay first a NOID/NOIR will not be forthcoming anytime two. It can take 12 to q8 months to hear from USCIS. Your petition can sit at embassy 3 to 6 months before they even send it back.
     
    It says refused, but did they actually tell your husband they are sending your petition back to USCIS?
     
    What were the question they ask your husband?  Was there a main focus of questioning? When was the last time you visited? Has he ever been married? Does he have children? Any red flags? Has he ever applied for visitor, business or student visa before? If he has did he say he was married to show stronger ties?
       
    This is what you need to do. You need to email the embassy now at Lagosiv@state.gov
    In the SUBJECT : CASE#-His full name-Reason for Refusal
     
    In the body of the email state yuru husband had interview on XXXXX and was told he was refused the visa and we could appeal but no reason why he was refused. Why were we refused?
     
    Is there any evidence or document you need me xxxxxx the petitioner to send to you.
     
     
    I would also contact your US Senators office and ask them to look into it.

    We sent the Police Certificate to the Embassy in Paris electronically and also by mail.
