This is worded poorly. I get what you mean though, just want to clarify it better.

When you get a GC through marriage (which means 130-485 or K-AOS) then there is an 864 in effect by the spouse as the sponsor. The 864 will always be in effect. It only ends when the immigrant becomes a citizen or gets 40 credits with SSA. However if someone gets their GC through VAWA (360-485) there is no 864. She has her GC based on marriage- so there is an 864 and its not going away.

Also public charge determination is ONLY done when the GC is first issued. Its not done at ROC or naturalization. So she does not have any issues about being found to be a public charge. A separate issue is being able to use social service benefits. When there is an active 864 any benefits used can be collected from the sponsor. IMO that should not concern her. Her husband is abusive and if he has to end up paying back benefits she got- good. But more importantly- immigrants are barred from receiving various social services for the first 5 years- EXCEPT in cases of abuse. So VAWA laws allow an immigrant victim of abuse to get help. She needs to go down to her local welfare agency and bring proof of the abuse (police reports) and request help as a victim of abuse. They will enter her into the system as such which will make her eligible for various programs and override their systems requirements for considering her husbands income/864 sponsor when determining benefits. None of the benefits she would get would ever be held against her. Again, they may go after the sponsors for it but thats not her concern.

She also should be aware that she is entitled to support from him under the 864. This is separate from divorce/alimony although in some places the divorce court will consider the 864. I suggest she googles 864 enforcement attny. Most likely she can find one to represent her. They will not charge her as 864 requires the sponsor to pay all the legal fees for her side.

She also should find a divorce attny and see about getting some kind of temp spousal support and possession of the home during the divorce process. When theres abuse the court tends to be favorable to the victim. They are not likely to tell an abused mother with a 10 month old child to leave the home.

She also needs to follow up with the victims advocate at the local police station and make sure that the guns are taken away.

To the OP- I am sorry this happened. Stay strong. I know a lot of info is being thrown at you and its a stressful time and hard to understand and process it all. If you have any questions please post them or you can PM me if you need to.

One more thing, Do not be afraid to become a public charge. You will be protected by VAWA if file I-751 based on divorce due to an abuse. You will be exempt from I-864 and I-944.

OP, sorry to hear what happened. It is up to you what to do next but if I were you, I would do the following:
    - get a restraining order against your abuser ASAP
    - if he's still in jail I would NOT let him return home. You can do it if receive a call from police/judge answering "No" to the question, "Is he welcome back home?"
    - call Domestic Violence Hotline and ask them for resources to victims of DV in your area
    - locate local WIC or other social services agencies providing help for women with small children
    - apply for food stamps with DES (many states allow green card holders to apply, some even for state medical insurance)
    - file for divorce as soon as possible
    - look up special housing programs for women with kids and apply for a subsidized apartment
You must be at a juncture where you may feel overwhelmed and lost. Do not worry, help is out there. You just need to know how to look for it.
Whatever you decide to do, PLEASE PLEASE do not allow yourself to forgive him and get back together! He is dangerous, and you may end up dead.

My last post was about an abusive partner. Well stupidly stayed. And just recently had to have the cops called and arrest him because he pointed a loaded gun at my head. I freaked out and called the cops. They took him and he isn’t being bailed out. I don’t know what’s going to happen to him.

But anyways. I’m really struggling to stay strong right now but I need help, I don’t know what I’m entitled too and what I’m not. I don’t want to become a public charge. But I don’t want to loose my apartment and end up in a shelter. My anxiety is so bad so please don’t be mean. My son is 10 months old in the next couple of days. I don’t think I want to go back to the Uk. But now my husband is in jail my sponsor (his grandparents) are not helping me.
am I going to lose my right to be here. I want to give my son a good life. And believe me I’m trying to keep it together. but I’m a mess.

Lol, don't you think if faster ways existed we'd all do it! We all miss our loved ones, and want to be back with them as quick as possible. You are not the only person who feels like they are missing out on things. My case was expedited towards the end and now I  have my visa interview on the 12th July. Our cr1 process has taken a year. It's been stressful, but we kept it together and finally we are at the end. You have to just be patient and wait your turn. Just like the rest of us. Remember this, Short time sacrifice for a lifetime of happiness!!

Some asked to let them know when the baby is here. Well klayton was born via emergency c section on 09/02. At 10:09am. He is the most precious little boy in the world. I'm completely smitten. He weighed 7lbs 11oz I'm still completely overwhelmed that i made it over here in time. Everything just fell into place last minute. It still feels like a dream. Again thank you to everyone that provided support and guidance. ❤️

I got here in Washington  yesterday, I can't believe we finally have a break from immigration for 2 years... it's such a nice feeling knowing we can relax now. and enjoy the next 5 weeks together before our son is born, I've stayed over here in the past and no all my husbands family and friends so I know I'm going to settle in just fine. I just wanted to thank everyone who helped me with the process and answered all of my questions. You have a break from me for 2 years now LOL.

This is My personal experience. But note everyone's experience is different. And this was a while ago,

It was my first time for me visiting my husband in his home country , he had been to visit me a good few times in the uk. So I wanted to visit him and his family and explore where he was from, I applied for the esta and booked a 90 day return trip. (You need to show proof of return flight) I was asked why I was going to America and why i was going for so long by check in staff at the airport. I told them my reasons when handing over my passport and They were happy and gave me my boarding pass. (But note It's down to the officers in America to let you in, even with an esta. They have the last say!!!)

I got to America and the custom officer at the boarder asked for my passport, how long I was over here for and if I had intentions of immigrating. To which I replied honestly one day but I'm only visiting for now. I showed him my return flight information and esta and He told me and my husband to park in the car park and to go inside and speak with the custom officers. I lined up and then was called over. They wanted my passport, asked how long I was over here for, wanted to see proof of return flight, asked how much money I had, and how I was going to support myself for the time here, they wanted to see proof of home ties, job, and then once he looked over all my information he told me if I stay over the time stamped in my passport there will be consequences and I will be banned from re entering.  My flight home was booked for the 11th July and he gave me till the 16th to leave. But I left exactly on the 11th!! Give them truthful straight forward answers to their questions. They are trained to know when somebody is lying. It is a little daunting. I must remind you again it is completely down to the officers to let you in. Nobody can tell you for certain they will let you in and you will be fine. They might find reasons not too. But Good luck. 🤞🏼

I might add that I work for an airline. A ticket purchased at very short notice, someone of working age, traveling alone for a lengthy stay...don’t be surprised to see SSSS on your boarding pass.

Short-notice trips are not unusual - funerals/death-bed visits, etc but these are usually short in nature. Lengthy trips by solo travelers are also not unusual, but these usually have a lot more pre-planning involved. Put the two together and our reaction is usually “who or what are you running away from?”

So why the rush and why the need for such a lengthy stay?

You’re preaching to the choir here about wanting to see your girlfriend. Almost all of us did this long-distance for many years before immigrating. I can assure you I don’t love my husband any less than you love your girlfriend and we survived almost 5 years on two separate continents. Visiting here is a privilege. Don’t abuse it.

    The situation is this:

You are going to be questioned by someone who probably gets, at best, 3 weeks holiday a year. Not only that but his job is to automatically assume that everyone trying to enter as a visitor is intending to stay illegally. In this situation it’s guilty until you can satisfy them that you are innocent, not the other way round. He doesn’t have to look for any reason for your situation to be a genuine visit, you have to prove it to him.

So, with that in mind we have someone who lives at home with mum and dad, with no bills or financial commitments in the UK, buying a ticket  at the last-minute for a holiday longer than the CBP Officer has over several years combined, who claims to run a company (that can run itself for 2 months?), with a love interest in the US (have you actually met before?), with £4K to his name (is that before or after the ticket purchase?) and now ask yourself what you can show the CBP Officer that you have every reason to return to mum and dad’s spare room?

You do not adjust status. You remove conditions that are placed on you to show USCIS that you entered a good faith marriage and are still married and living with your petitioner in order to get your 10 year greencard. You need to save things starting from right now that show joint things. They want dates covering  the whole two years. So don't throw everything out and in two years wish you had something from 2019 showing you got a joint bank account or joint car insurance or lease for example. Stash a few things away in a folder somewhere as you go, then you'll have a good sampling of things covering the two years when it comes time to organize your evidence.

My interview was on the 12th July in London. My case was expedited due to medical reasons in my pregnancy.  It was very straight forward, they made me feel relaxed, I was nervous at first but I think that's normal. But there's really nothing to be nervous about. The staff were So nice. I was asked questions about my relationship and it just felt like a conversation. You wait about longer then you are actually interviewed. I ended up with a green 212g slip for a joint sponsor. Which I was gutted about and the consular officer even apologised and said that it's the only thing holding up our visa. He kept my passport and My case changed to administrative processing. I submitted my hubbys grandads documents on the 16th July and on the 17th my visa was issued and in my hand on the 19th July. I'm now leaving the uk tomorrow to be back with my husband.
