If she can proove that she entered the marriage "in good faith" then she can file to remove conditions. The legal part that will hurt you is that you have to take care of her if she uses government assistance such as food stamps.

Hey guys, i'm a little worried about getting an RFE. After reading several posts here, i see people getting RFEs. Myy concern is..is there anyone here who received an RFE for writing NONE or N/As in the wrong places???? i hope that this won't be a problem! also, another one of my concern is that i left the bottom part of the G-325A form which was asking for the A# blank beside the because i already put N/A in the top of the page when it first asked for it. so i figured i didn't need to fill it in anymore the second time =(....Can anyone help me with this concern?? THANX GUYS =)
My wife worries about bears climbing into our second floor bedroom window. Such is what happens when a woman from a big city in Ukraine moves to a small forested island in Vermont inhabited by bears, coyotes, raccoons deer, moose and her husband. She makes me sleep toward the window and she sleeps "behind me" If a bear comes into the window she will escape down the stairs while the bear eats me! And YOU are worried? I have to worry about bears eating me in my sleep, an RFE is nothing.
I never heard of an RFE for an NA or None in the wrong place, unless you put that in the place for your name or something. Now, you have done your best, yes? I presume you did your best and sent it off. Now is the time to prepare for the next step and get your dicuments for the interview ready, not to worry about what could happen. If you get an RFE, you will answer it and go on with life, at worst losing a few weeks time in the process which results in a lifelong marraige. What are you worried about? I have to deal with vicious black bears leaving behind the berry patch in the middle of the night and invading my bedroom window to eat me!
(PS, this fear my wife has results in her sleeping naked close behind me all night so please, do NOT tell her the bears hibernate in the winter and NEVER climb in second floor windows to eat unsuspecting people, they are, after all, black bears, not AFRICAN LIONS, but I like having a beautiful naked woman snuggled up to me all night so we are not dispensing with any unreasonable fears of bears here, and apparently she is not modest and does not care if a bear sees her leap naked from a bed to make good her escape!)

You say you live with your mom, you should have her draw up a lease for you and have you both sign and notarize it. They probably accepted your income tax and everything, but they need to prove you actuially live together. Or if possible can your mom have you both added to her lease and submit a copy of that?

YAY I made the list *dances* Thanks hehe

I did not call this fraud. His question was "What happens if I do not wish to remove conditions" I took that as.... "help get me out of the ^&%# situation I am in" and the way to get out of that is to remove the evidence that would allow her to stay in the country. That evidence is what will allow her to remove conditions on her own regardless of their situation.
-
It's her burden to prove that she entered the marriage in "good faith" if there is no proof that you were merging your lives and you call the USCIS and report her as fradulant and she had no evidence to prove you are legitimately "merging your lives" then she has no real leg to stand on.
-
Personally I would remove all evidence of bonifide marriage and divorce her....

Aweeeeeeee you missed me

Yeah they probably will, but as far as I am concerned they can do what they want with it. It arrived today and all in one piece YAY!

Mine was all tabbed and labeled to. I mailed it Friday and it should arrive today in California. I have all of it in a 3 rinig binder with sleves and tabs and it's very organized and nice. I hope I got it all right *crosses fingers*

Perhaps that wasn't her "intent" and that's fair enough.
However, if you are already stressed out about filing and perhaps I am more freaked out than I need to be, but this is the love of my life I am talking about here not my pet or something... This is my heart and soul and yeah I am pretty much freaking out because making any kind of mistake is not an option and someone straight up tells you that "if you skip an interview, then don't feel like your something special" that's like making an already stressed out person feel like dog dung for no reason.
I will feel special if we get this over with. I will feel special if we skip that appointment. I will feel special when his greencard arrives and I don't have to think about the USCIS until we Naturalize and I will feel special and I do not need anyone turning my already emotional state into something that they feel is petty and small simply because they may not feel as passionate about this process as I do.
She may have good intent and that's great, but there is no need to be sarcastic toward someone that's already emotionally jacked up and scared over everything being just right. she could have worded it differently and her intent could have been better expressed and I do have a right to have hurt feelings and there is nothing wrong with that.
-
Yeah I took it personally. It's not like it could have been worded better or something?
-
I am sure people just love the support that you offer here. I mean you are a complete asset to this site because you bring such a wonderful feeling of sacasim and arrogance that it's overwhelming. I am sure you should avoid thinking that you're special since it's pretty obvious and since you offer such great advice, then perhaps you should follow it. I am honestly sorry that you must have a pretty horrible life if you want to make comments to people that are completely rude for no real apparent reason other than to be rude. I am sure it feels good to you to be that way to others...shame really. Glad I don't have to ever know you.
-
LOL wow you're really sweet. Thanks!

You should call them to see if they have a tracking number or anything. Typically they send this stuff certified mail because it contains personal information.

I wonder if the person who worked on my case got upset with me since I sent in at least 3lbs of documents? I know that it's way, way, way too much but from the looks of it, it didn't hurt my application at all.
True, but it didn't help either.
People need to understand that the ROC is not equal to an application to become a permanent resident. They have been approved 2 years earlier and are LPRs already; the ROC is just a check to filter out the fraudsters, many of which would not have been able keeping up the charade of a fake marriage for 2 years.
A married couple that is still living together, filing jointly, is automatically approved. All they like to see is SOME documentation showing intermingling of life and finances.
The size of the package means nothing, it just slows things down and makes the IO want to close the file and pick a smaller one so that she can go home.
I disagree... especially when I know that most of the things that I sent were strong proofs that we are intermingling. I am a believer of "the more, the better" and so far it has been working for me from the time we did K1 till ROC.
I completely agree. Look at all my time lines. Every step of this entire thing I have freaked out and went overboard and sent in too much stuff and never had an RFE or any delays. Our whole process has been smooth and quick and I think it's because I am so organized. I have a 3 ring binger sitting here with more than enjough to justify everything they need. I am looking to avoid an interview and go straight to Biometrics. I personally think it makes their job earsier than having to do the paperwork to issue the RFE and cases like mine are the simple ones that people want to "get off their desks"
-
*relaxes* and honestly I don't care if I piss him off with "too much" I would rather do that then get an RFE and delay my case. It's their job to look through this ####### and that's what our tax dollars pay them to do. I am relaxing now that someone told me it was too much ####### though hahahaha.... whew

Does anyone here know if we need a new passport photo for this?
