Hello all I am in the process of submitting the N-400 for Citizenship. Part 10, A. General Question #4 ask

Since becomming a lawful permanent resident , have you ever failed to file a required Federal, State, or local tax return?

I did not file my 2008 taxes until some time in march 2010 with my 2009 tax return. So in this case do i put yes since i filed late? n or no because i filed at the time i'm filling out the Application?

Hi, may I ask you what did you eventually write on your application? Yes, or No? I am in a similar situation, I filed late, but nevertheless, at present I am up to date with everything. Technically, I am inclined to say "No", because I did not "fail", I was just late.

Hi guys i applied for my EAD on the 1st of march 20101, it was then touched on the 4th of march and nothing since then.I have not received anything in the mail to get biometrics or anything anyone familiar with this?

My old EAD was touched on the 18th as well, now it makes more sense what you guys are saying, maybe they are moving them or something...

And lovenjstar, I am not sure if we can conclude what you said. Had your EAD been touched let's say 2 months ago, and you still not received your GC, then we could say there may be a connection between the EAD touch and your delayed answer.

I am still before time, compared to everyone in feb. Nobody from Feb., from vermont, has been approved yet.

So what would be interesting to see now is if you do get any answer.

I am thinking, I do not know why, a RFE could follow.

Hello, I filed in February with Vermont and today I noticed a touch (from yesterday - Sunday!) on my old EAD case. Anyone else experienced this and if so, did it have any connection with an answer on the Removal of conditions soon after?

Or did they just dropped it from their shelves by mistake and had to scan the number before putting it back?

I am in the same situation, already had my bio taken and neither NOA or biometrics appointment mentioned my daugther (she's 6). The only thing where they practically "acknowledge" that the application was not for one person is in the NOA, where they say "We've received you application and the fee of ___" and the amount is mine plus my daughter's 80 $ for bio.

Now you know, if the fees were incorrect, they would send it back

I asked on VJ the same question and answers were that most of the ppl seen on VJ do not receive anything regarding their minor child (age less than ???? don't really remember, but anyway, somewhere 14-16), until the actual 10 yr green card (where they receive both of them, ofc).

So I decided not to worry

When I was at CSC, Vermont moved fast, now I'm at Vermont and CSC moves fast... but no complaints, just hope they will pick up all the delays in Vermont as well

So best would be I do not bother with this issue until I get my biometrics appointment and then, with the case number, maybe call USCIS... Though indeed the fee indication on my NOA (as well as the fact that they did cash both checks) should be enough assurance for me that yes, both cases are dealt with...

LOL, my bad, I don't know why I read that date of I751 should be date when it was received Which anyway makes more sense then date you sent it, unless ofc one uses regular mail and has no control over the date it arrives... Blah... Both solutions have flaws

Anyway, sent it overnight Feb 3rd (but too late in the afternoon I guess to make it there on the 4th) and it was received on the 5th (my signature could have offered better info).

So again how do I fix the format myself?

Hello, I filed for me and my daughter (6yrs old) according to the instructions and I got my NOA, where, strangely enough, it is mentioned that the total fee I paid is 625. Only that she is not mentioned on the NOA.

Should I expect a different NOA arriving for her? After all, doesn't she need her status extended as well?

Hello my fellow travelers.

On Tuesday night I sent an email to the Romanian embassy asking about package 3. I asked them if my SO should wait for the package by mail or if she can download some of the forms and fill them herself. Next morning I received a reply stating that "she has to wait for the package on the mail but that I could send them the case # and her mailing address and they could send her the package in advance." All this before they receive the documents from NVC.

Can they really do that? That would be really great and will save some good time. What are your opinions on this?

Hello, yes you can do that, we did it. If not for something else, at least it will give you the feeling you are doing something while waiting for the package to arrive at the embassy

It seems to me that the OP did not actually get anything BUT the pink letter, meaning no clear indication on what the RFE (request for evidence) is it about?! I don't have mine in front of me now, but I remember that on the pink sheet there were only general things, and the actual request (medical) was shown on a separate piece of paper. I might be wrong though... But otherwise I don't see the meaning of the question "Anybody with thoughts about this?" Maybe that's it...

Inside the RFE envelope didn't you have another envelope, to use for your response? Use that, if possible. If you didn't or if the envelope is too small, just use the indications in the RFE and use another envelope, but don't forget to add on the envelope "Re: RFE", with capital letters.

Good Evening All - What a great source of information this site has proven to be so far!

My question is this: My fiancee is from Moldova and will be attending her K-1 interview at the Bucharest, Romania Embassy. She has a wonderful 6 year old daughter that is on the I-129F petition for K-2 status. Will my fiancee's daughter need to attend the interview with her mom?

Also, anyone who has some Packet 3 information for the Romanian Embassy would be greatly appreciated.

I did go with my 4 ys old daugther at the interview (they specified she should be with me). The only "advantage" was that I was the first one to get in. but inside I had to wait as long as the others.

She should take some snacks for the child (ask at the gate if it's ok, say they are for the child). Depending of the time of the year when they have their interview, she should be aware that it is rather cold inside for a child; it was summer for us and inside was very cold (around 70 I would say, if not less).

My child was not asked anything, but they did want to see if she was there, so I lifted her up, for the interviewer to see her

That is such a ... so I declare my incomes obtained in my country, even though they were subject to taxation there, but I cannot claim her as a dependent HERE, even though I did have all the expenses related to her for the whole year...

I have to do some calculations to see if it's worth it to file for 2007 jointly...

Anyway, I would still appreciate an answer, if anyone tried this way, to my question related to supporting docs for the income obtained outside USA. Additionally, what income should I declare, gross I suppose (again, in my country the gross income is subject to alot of withdrawals, separate from the income taxation)? Romania has a Double Taxation prevention treaty signed with USA, would that apply?

He became a resident the day he arrived on his visa for tax purposes... he does not need to wait for his greencard to be classed as a resident....

You will need to file as married if you were married as of Dec 31st 2007 you can file as joint or separate...

I was in the same situation and we filed as married jointly for 2005.... you can choose to be treated as resident for tax purposes, it just means you have to declare your worldwide income for the tax year....

How do I do about "declaring my worldwide income for the tax year"? A simple declaration is enough? Has anyone been in such a situation and how did you support your declarations about your income obtained from your country before coming to USA?

Also, as an additional question, what about my daughter? On a short glance, it seems my husband (the USC and taxpayer) cannot declare her as dependent if she did not live with him for at least 6 months, is that right? (since he did not adopt her). If that is true, but if me and my husband file jointly, do I become in this case "a taxpayer" and can I declare her as dependent (since she is my daughter and she did live with me for the whole year)? I am veeery confused and I am trying to figure all this out in order to choose the best option for filing the taxes...
