    Hello Everyone:
     
    Im a green card holder and Im going to apply to naturalization on March of 2021.
    I have my elder parent +80 that I need to bring to the states because I dont have nobody to take care of them in my home country.
    They are travelling with a tourist visa in March 2021, so actually when I get the chance to AOS they have to overstay.
    Is this risky? They wont work or anything like that.
     
    Any advice??

    You're welcome! My cat also travelled under the seat. I was too worried about letting her travel alone in cargo. I was lucky that my seat mates liked the cat, and she didn't make too much noise. I brought her snacks and she ate them, but she didn't want to drink. Hopefully people are understanding with you guys as well.

    Only if you upload a new file (that they ask for!). You are still in line for an interview. If we never uploaded we would stay in that place in line. It sucks but I uploaded to my step daughter’s petition just to put them all on the same schedule.

    The lady I spoke to today said I was DQ and in line for interview and they will not review it again even though I uploaded those documents today because of the incomplete. I’m praying 🙏🏾 they don’t start over. It’s their mistake why we gotta pay for it. Smh

    The only thing I can suggest is make a service request and you have already done that...they have up to 3 months to schedule interviews unfortunately.

    Where does she actually intend to actually live? Where do you intend to actually live?
    If it's in the US, then she needs a visa that permits residency....a CR-1/IR-1 immigrant visa being the most logical choice.
    If it's not in the US, then she needs a visitor visa.
     
    A green card requires maintaining permanent residency with the US.
    A tourist visa does not permit living in the US.
     
    If she wants to live in the US, her petitioner must also establish domicile in the US. It's a family reunification visa...there's no reunification if you aren't coming too.
     
    Something will have to give - either you go with her, she doesn't go at all, or you abandon the plan to study in the US.

    Hi, Well i can tell you our experience, my husband Was living overseas for 10 years and when we Was submitted all the documents to NVC the approved everything except proof of domicile, he didnt have no bank account or bills on his name or anything, we Just sent a letter saying he wants to reestabllsh domicile no later than my arrival. 
    Well they reject that and ask me for more evidence, but we didnt have, so we send a letter form his brother saying we Was going to live in his house and a couple of emails from a school for my child and job aplications that he sent, and they reject again!! 😢 So we finally decided the only Way Will be he move phisycally to the states, and that is what he díd, 2 months ago, finally we presenta everything bank account, job letter, cell phone bills, and everything we found. 
    Now we have case completed and we are Waiting for the interview Day. 
    Also it depends Which CO review your case some are more estrict than others. So i Wish you good luck, and i hope you dont have to waste all the time we díd Waiting for approvals that were rejected.

    Have you submitted all required forms to NVC yet?  If not, just change his address on those forms, then they will have the new one.  If you have already sent NVC all forms and documents, then call NVC and give them the new address.

    I know it’s hard to understand why your evidence is not being accepted when we hear of others who are getting approved with the same evidence. But there are just so many things that come into to decision process. It is true that , if the visas were approved with your current evidence , that your husband could wait to enter the US with you, but if approval isn’t coming then you need to look at a different option. 
     
    He lives in US
    He has a job
    He has a place to live .. rent, own , share , with extended family... 
    etc. 
    He has his state driver’s licence, car insurance, health insurance, voter registration, bank accounts, US cell phone etc

    The best evidence would be for your husband to be physically living and working in the US.......That HE has made the choice and acted on it... that he has gone ahead and is preparing for the rest of his family to join him and make their long term home there.

    I have heard voter registration, insurance bills in his name also.

    Any airport but make sure you have enough time before any connecting flight.   A three to four hour connection is best.

    YOU should not sell your home or make travel arrangements.  Your USC husband may need to travel back to the USA and establish his domicile if he can't find a way to convince the CO of his intent to reestablish domicle. 
    Getting a letter from his brother is a good idea.  A job offer would be good as well.

    Here are some ideas f from the NVC wiki.
     
    Domicile
    Please note, if the petitioner lives with the beneficiary abroad, you'll need to provide proof of US domicile with the AOS package, as well as bring it with you to the interview. Please read the I-864 instructions (pages 3 and 4) for information about it. This is NOT needed if the petitioner is living in the US. Here is a sample cover letter to include in the package (it lists MANY possible documents, some may not be applicable, of course, to prove that you have, or will re-establish, domicile in the US):

    Steps I have taken to return to the US to take up residence:
    • Made arrangements for us to have a house to live in
    • Contacted schools for requirements of things to bring to register my children in school
    • Contacted my auto insurance company to find out about re-instating my insurance on my car
    • Contacted shipping company for estimate of costs to ship belongings

    Supporting documents for the above steps I have taken:
    • Lease agreement for our house
    • Email from schools regarding registration requirements
    • Email from my former auto insurance company regarding my inquiry
    • Email from XXXX with estimate and correspondence regarding shipping our belongings

    I declare that I intend in good faith to re-establish my domicile in the United States no later than the date of spouse's admission into the US.
    I certify under penalty of perjury under the laws of the United States that the statements in this letter and all accompanying evidence are true and correct.

    like i said he has to get his brother to natorize letter for him that your husband which is his brother currently living with you temporary abroad and that you guys will move once the application approved to his house and to write the address on letter your husband name thats what we did and its been accepted..

    No.  Just one AOS fee.  If they are billing you for two, call them and make sure the two cases are joined.

    You should wait i mailed out my i130 on December 2017 and uscis recieved the petition on January 2018 it arrived at Nebraska Service Center and i kept checking monthly on the uscis website until August, it ended up being sent to Texas service Center. And just two days ago October 1 i received in mail a notice for a interview😬 so hopefully this helps.

    I would say it meant his divorce has not been approved/finalized by the government.  In my native country (Vietnam), the date printed on the divorce paper issued by the government is considered the date a divorce is legalized.

    i live in california ,
    so i got divorced on sept 13 2016, (the judge signed the divorced) but my status would only return to single and final on  march 11 2017
    i went ahead and got married in brazil on jan 11 /2107  , 2 months before my divorce to be final, 
    so USCIS aproved the ap , nvc fowerd to the Consulate, i paid all the fees, and travel to the interview, to find out that my marriage was invalid for immigrations purposes, and I had to divorce and remaired and file a whole new ap  =/

    Do not list anybody who is on a separate petition as a family member being sponsored.  You are not asked your income.  You are asked your income YOU ARE USING TO QUALIFY.  That would be ZERO.
