    Yes. As noted, it is treated like an insurance policy, not a public benefit.
    It also is not income maintenance nor means-tested. Even somebody who earns $1 mil/year can qualify for unemployment (although likely an insignificant amount)...eligibility (note: not the benefit amount) is not based on your income level.
     
    As always check with your local state's UC program.
     
    Right. Most work visas are tied to a specific employer, so being unemployed would mean you have no legal means to work, and therefore won't qualify for UC.
    Some other visas are not tied to a specific employer. There's also TPS recipients, asylum seekers , DACA holders with an EAD (I believe this is limited by the state's program), derivative beneficiaries who qualify for an EAD (like spouse of some H visa holders). and various other individuals with statuses where they can legally work who would generally qualify. As always, check with local laws to verify.
     
    LPRs are fine in every state. It's the more fringe cases where it becomes less clear (like uncommon status holders, if it's a federal UC period or the normal state one, etc.).

    This is totally ridiculous. There are more than a few people who get rid of all photos of their previous marriage. Like others have said, ask around from family members however if you cannot get more, provide what you have. You cannot go back in time and take new ones.
     
    Perhaps they hope to find out that you guys are related and were at each others previous wedding to say this marriage is a sham? Fishing expedition? Did your perhaps petition for your previous spouse?

    Our case is Pending at the NVC with monies paid and documents submitted. My wife will turn 30 on July 30th so as her birthday request we decided to try the B1/B2 Visa. Got denied today. I wasnt surprised though. Thought we should give it a shot to see if my wife can be here for 10 days for us to celebrate her 30th birthday together. We still in the process so nothing lost.
    CO: Where are you going in the US?
    My Wife: answered
    CO: How did your husband got to the US? Was it through sch, work etc?
    My Wife: answered
    CO: you are going to visit your husband?
    My wife: yes
    CO: You are a nurse?
    My wife: yes
    CO: Your immigration petition filed by your husband has been approved right?
    My wife: Yes
     **CO goes back to talk to another CO then came back with the Refusal paper
    The journey is still on👌👌✌✌

    It's never too late to be honest in these immigration processes. Better to explain the truth than to stumble around in the interview with half-truths about permanent vs temporary residences. Just explain that you weren't aware of the requirement and that you'll be abiding by the requirement from now on.

    No problem, it’s a pain I can imagine. I can’t see where I mentioned agency however I do believe you should reach out to your fiancés police force (where the arrest took place) and reach out explaining the urgency and importance, perhaps attaching the email from the embassy to perhaps get them to prioritise your case.
     
    As you stated it’s a minor matter, they have more serious crime cases to present which is probably the reason why it’s taken this long. 
     
    I reccomend emailing and if you hear nothing contact your police force headquarters directly using the usual 101 number.

    She should answer the question as best she can.......if exact dates are not known she can give the approximate dates........"unknown" is also an option.......she will, of course, need a police certificate from Taiwan if she lived there.

    On form DS-260 for the beneficiary there's a question about usage of other names including aliases. I'm assuming they're talking about officially using a different name (i.e. on official docs). Correct? using Skype or Facebook aliases doesn't count. Right? Thanks.

    It depends on the consulate. Right now CR1 interviews at Montreal are approximately 2 months (give or take a few weeks) after case complete, which happens about 3 weeks from when you submit your documents. If you don't have any issues with your documents and get case complete first go, I'd say the interview is about 3-4 months from where you are now. Every time you have to submit more documents it adds about an extra 3 weeks to that estimate though.

    I do not believe your cousin is telling you the entire story.... AWA denials are for 'specified offenses against a minor'. Neither of the things you described fall under that. So either he has another charge you are not aware of- or he was not given an intent to deny based on AWA but rather based on  domestic violence charges which are also under IMBRA but not AWA necessarily. Do you have a copy of the notice you can post with personal info blacked out?

    I don’t have to do ROC but I have been through a divorce so I have no immigration advice but please do take it slowly with the new flame. You haven’t been here long so you obviously haven’t been working there long. It’s very tempting during the final stages of an unhappy marriage to rush things with someone else. Maybe it’s the fear of loneliness. Maybe it’s establishing your own self-worth. The grass isn’t always greener. 
     
    I would also check your company’s policy regarding establishing a domestic relationship with a co-worker. I was surprised to see it was very much frowned upon where I work and can even cause one party to be moved to another department. I found this out because a co-worker recently resigned following her marriage to another co-worker. She was told she had to be moved to a role where there is no direct involvement with her wife and she didn’t want to do that so she resigned.

    It is not really the NOA2 date that matters, it is when NVC receives the petition from USCIS. Some times USCIS takes their time, other are sent very quickly after approval. My case was expedited at USCIS and it still took them a week to send my case to NVC and another 8 days for NVC to officially receive it. Good luck.

    We submitted about 8 photos with our packet. All at different stages in the relationship, so my husband had different hair cuts and beard lengths. But in our case, I was living in England with him at the time. For your case however, I would focus more on things such as ticket stubs of places you've been together, boarding passes, hotel receipts. Just to really prove an on going relationship! Hope that helps!
