Jenna Ting got a reaction from Crazy Cat in AOS packet lost in mail (moved and merged)
I want to clear out something .I think you misunderstood the point. You just need to get married within 90 days of your wife arriving here .It doesn't matter if you file ASO during that period of time or not. Also you got the receipt from UPS when you mailed it out that's a way you can track your package. Best luck !😊

Jenna Ting got a reaction from Ben&Zian in Will i loose my K1 visa while applying for my AOS?
You'll be out of that status but still legally staying in the USA. Just don't leave the USA before you got the AP or green card.

Jenna Ting reacted to Crazy Cat in Point of Entry Questions
They might ask "Do you plan to marry within 90 days?" If they ask that, say "YES"......
There has been at least one case I recall that a K-1 immigrant was asked that. He said "Maybe......Maybe not".............they denied entry and sent him back to his country.......
In all seriousness, relax..........99.999999999999% of K-1 immigrants don't have issues entering......

You'll need your valid i94,usually you can get it updated 1 week after you arrive in the USA. Not sure if you'll get married soon or not,if you'd change your name after the wedding ,then you need to wait till you've gotten the Marriage record .It's convenient to go on the website of your local social security office ,fill out the form, print it out ,bring it with your valid i94 , passport ,marriage certificate then it'll be done soon.Your social security number card will be mailed to you in 2 to 4 weeks.

1.Yes.
2.If your annual income is higher than the poverty guideline, you don't need to attatch the other asset .We prepared the employment letter, life insurance, 401k,bank letter also included car as personal property but on the interview, they only asked for 1040 forms of recent 3 years. If you want, just bring as much as you can get.
3.1040 forms are necessary

Jenna Ting reacted to K1visaHopeful in Hi. Hope this is the last question before mailing out the AOS packet
Yup you need to provide any prior divorce decrees.
This is page 10 from the I485 instructions:
"6. Marriage Certificate and Other Proof of Relationship If you are filing Form I-485 as the derivative applicant spouse of the principal applicant, you generally must submit a photocopy of your marriage certificate issued by the appropriate civil authority where the marriage took place. Refugee derivative applicant spouses do not need to submit a photocopy of the marriage certificate. There are also some immigrant categories that require the principal applicant to submit a marriage certificate (for example, K-1 nonimmigrants (person admitted to the United States as a fiancé(e)), abused spouses and children under the Cuban Adjustment Act (CAA), Haitian Refugee Immigration Fairness Act (HRIFA) dependents, and abused spouses and children under HRIFA). See the Additional Instructions for more category-specific information. If either party to this marriage was previously married, you must also submit evidence to prove the legal termination of any prior marriages, typically a divorce certificate or death certificate. If a required marriage certificate (or divorce certificate or death certificate) is unavailable or does not exist, you must demonstrate its unavailability/nonexistence and provide other acceptable evidence as explained above for birth certificates."

I have no idea either but I just feel my concerns are being discounted when the truth is we cant know what an individual IO may think or decide to do for someone's individual case either should they decide to submit an unsealed medical packet when every instruction says all documents need to be sealed or transferred to USCIS as initially sealed. Logic doesn't apply in this case as it would be an IO's decision.
So why initiate a situation when there is no benefit and perhaps a consequence?

Someone already said they sent it so...
there wouldn’t be anything as when you’re sending these copies you are sending them with the acknowledgement of them having it. The benefit for what I thought would be was that the person maybe a newbie who saw it would realize that there’s a copy hence there is an original accompanied my visa application.
i have no clue why this is even becoming this big of a talk here.
These are MY personal records it is normal for me to have them. If they can expect me to send a copy of my vaccination records which have no official thing on it, then the same logic applies to any other I send.

Almost. You will never get an RFE for an I693 before the interview as providing medical documents are not a required submission before the interview. You could get a Courtesy Letter for a medical exam prior to the interview but that is just a reminder that one needs to be submitted at the interview. Or you could get a request for it AT the interview if you did not submit one then and be required to provide one before final approval but you would not get an RFE for one before the interview.

My concern is not that it's a copy. My concern is that it's not sealed but I think you get it. Just submit your DS3025 as the instructions state. That's all you need. You dont need to complicate it anymore than it has to be.
The official copy that was collected at your POE will be waiting for you at your interview. And if it's not, submitting an unsealed copy wont be accepted anyways (you'd have to redo your medical, get a signed and sealed I693). Your copy would not be valid as it is not sealed.

My wife also received a full copy of her medical exam and records, I have a extra copy, and I scanned them into my computer for safe keeping also.
Important note that I think is being overlooked is I witness the officer open my wifes packet at POE, and we kicked it and went to the airport bar and had a few brewski.... No, but really the copy he pulled out of the sealed envelope had a seal stamped on every page stating original copy where the copies I have did not have the seal on them, so I think that is how they would know you don't have original copies, because the ones I have don't have that stamp on them saying they are original. So I am sure the same applies here possibly, but I only sent in my DS-3025 with my AOS anyway, package was thick enough.

Okay that makes a bit more sense. I think you understood my concern though.
I still would only submit the DS3025 with your AOS package as submitting any other copies of anything that you should not have a copy of may raise issues. It may not but just to be safe. I'd pretend you doing even have a copy of the entire medical package.

Jenna Ting reacted to K1visaHopeful in HI! WANNA MAKE SURE SOMETHING BEFORE MAILING OUT THE AOS PACKAGE
Did the CBP officer give you a copy back? If so I would definitely NOT submit that with your AOS package. You are not supposed to have access to that. The only thing you should have is a copy of your DS3025.

Jenna Ting reacted to Naes in HI! WANNA MAKE SURE SOMETHING BEFORE MAILING OUT THE AOS PACKAGE
I have a copy too.

Jenna Ting reacted to Ate in HI! WANNA MAKE SURE SOMETHING BEFORE MAILING OUT THE AOS PACKAGE
Oh. Well I guess that's a country-specific difference. Unless you mean you already got your I-693 (Report of Medical Examination and Vaccination Record)? If what you have is your I-693, then yes, that needs to be submitted when you file for AOS.
-
Jenna Ting reacted to K1visaHopeful in HI! WANNA MAKE SURE SOMETHING BEFORE MAILING OUT THE AOS PACKAGE
Actually if it is an I693, they can choose when they submit it. With the AOS application or at the interview.

He can go to irs.gov and print his last 3 tax transcripts. Bam!

Jenna Ting reacted to MrandMrsAlexander in Affidavit of support evidence
If he’s prints the 3 tax transcripts, he needs nothing else. No paystubs, w2, nothing. It’s overkill. No employment letter.
