    Immigration Security Checks—How and Why the Process Works
    Background
    All applicants for a U.S. immigration benefit are subject to criminal and national security background checks to ensure they are eligible for that benefit. U.S. Citizenship and Immigration Services (USCIS), the Federal agency that oversees immigration benefits, performs checks on every applicant, regardless of ethnicity, national origin or religion.
    Since 2002, USCIS has increased the number and scope of relevant background checks, processing millions of security checks without incident. However, in some cases, USCIS customers and immigrant advocates have expressed frustration over delays in processing applications, noting that individual customers have waited a year or longer for the completion of their adjudication pending the outcome of security checks. While the percentage of applicants who find their cases delayed by pending background checks is relatively small, USCIS recognizes that for those affected individuals, the additional delay and uncertainty can cause great anxiety. Although USCIS cannot guarantee the prompt resolution of every case, we can assure the public that applicants are not singled out based on race, ethnicity, religion, or national origin.
    USCIS strives to balance the need for timely, fair and accurate service with the need to ensure a high level of integrity in the decision-making process. This fact sheet outlines the framework of the immigration security check process, explaining its necessity, as well as factors contributing to delays in resolving pending cases.
    Why USCIS Conducts Security Checks
    USCIS conducts security checks for all cases involving a petition or application for an immigration service or benefit. This is done both to enhance national security and ensure the integrity of the immigration process. USCIS is responsible for ensuring that our immigration system is not used as a vehicle to harm our nation or its citizens by screening out people who seek immigration benefits improperly or fraudulently. These security checks have yielded information about applicants involved in violent crimes, sex crimes, crimes against children, drug trafficking and individuals with known links to terrorism. These investigations require time, resources, and patience and USCIS recognizes that the process is slower for some customers than they would like. Because of that, USCIS is working closely with the FBI and other agencies to speed the background check process. However, USCIS will never grant an immigration service or benefit before the required security checks are completed regardless of how long those checks take.
    How Immigration Security Checks Work
    To ensure that immigration benefits are given only to eligible applicants, USCIS adopted background security check procedures that address a wide range of possible risk factors. Different kinds of applications undergo different levels of scrutiny. USCIS normally uses the following three background check mechanisms but maintains the authority to conduct other background investigations as necessary:
    • The Interagency Border Inspection System (IBIS) Name Check— IBIS is a multi-agency effort with a central system that combines information from multiple agencies, databases and system interfaces to compile data relating to national security risks, public safety issues and other law enforcement concerns. USCIS can quickly check information from these multiple government agencies to determine if the information in the system affects the adjudication of the case. Results of an IBIS check are usually available immediately. In some cases, information found during an IBIS check will require further investigation. The IBIS check is not deemed completed until all eligibility issues arising from the initial system response are resolved.
    • FBI Fingerprint Check—FBI fingerprint checks are conducted for many applications. The FBI fingerprint check provides information relating to criminal background within the United States. Generally, the FBI forwards responses to USCIS within 24-48 hours. If there is a record match, the FBI forwards an electronic copy of the criminal history (RAP sheet) to USCIS. At that point, a USCIS adjudicator reviews the information to determine what effect it may have on eligibility for the benefit. Although the vast majority of inquiries yield no record or match, about 10 percent do uncover criminal history (including immigration violations). In cases involving arrests or charges without disposition, USCIS requires the applicant to provide court certified evidence of the disposition. Customers with prior arrests should provide complete information and certified disposition records at the time of filing to avoid adjudication delays or denial resulting from misrepresentation about criminal history. Even expunged or vacated convictions must be reported for immigration purposes.
    • FBI Name Checks—FBI name checks are also required for many applications. The FBI name check is totally different from the FBI fingerprint check. The records maintained in the FBI name check process consist of administrative, applicant, criminal, personnel and other files compiled by law enforcement. Initial responses to this check generally take about two weeks. In about 80 percent of the cases, no match is found. Of the remaining 20 percent, most are resolved within six months. Less than one percent of cases subject to an FBI name check remain pending longer than six months. Some of these cases involve complex, highly sensitive information and cannot be resolved quickly. Even after FBI has provided an initial response to USCIS concerning a match, the name check is not complete until full information is obtained and eligibility issues arising from it are resolved.
    For most applicants, the process outlined above allows USCIS to quickly determine if there are criminal or security related issues in the applicant’s background that affect eligibility for immigration benefits. Most cases proceed forward without incident. However, due to both the sheer volume of security checks USCIS conducts, and the need to ensure that each applicant is thoroughly screened, some delays on individual applications are inevitable. Background checks may still be considered pending when either the FBI or relevant agency has not provided the final response to the background check or when the FBI or agency has provided a response, but the response requires further investigation or review by the agency or USCIS. Resolving pending cases is time-consuming and labor-intensive; some cases legitimately take months or even several years to resolve. Every USCIS District Office performs regular reviews of the pending caseload to determine when cases have cleared and are ready to be decided. USCIS does not share information about the records match or the nature or status of any investigation with applicants or their representatives.

    It still makes little or no sense as to why we have to submit this information again for the second time and go and get another biometric done! Seriously. Think about it, if it was a scam or a fraud and they were doing their job right the first time then why do we all have to do it all again in 2 years, typical waste of time and money and once again the federal government agency trying to justify it's existence by creating more busy paperwork and procedures that are more for show and do damn little to stop immigration fraud, just a waste of taxpayer money. AND we have to submit an inordinate amount of this ####### again for a 3rd time and pay another ridiculous fee again and go do another biometric again for citizenship. Bunch of jackoffs in the federal government if you ask me. For example I asked a USCIS worker 2 yrs ago that I knew "Why do we have to get a biometric done everytime if you already have it all the first time" Well I was told because of the background Interpol, FBI, NSA, or state police security check has to be done with new picture and fingerprints due to FBI requiring it if it is more than 15 months old. Which I then pointed out, ok so you say but then it is going to be less than 12 months when we apply for US citizenship next year! So why do we have to do it a 3rd time for biometrics, well I got a deer in the headlights look and no real reason, just that is the way the agency is type stuff.
    As for the Ukraine dual citizenship stuff, I could have told you that, USA does not care and neither does Ukraine(they have no clue anyway and neither does the USA). There is really no such thing as dual citizenship other than the fact that most countries just recognize their own passports like you said, and I would highly recommend that your wife keep her Ukrainian citizenship or passports(local and international) and renew them, will make life much easier for her if she has property or apartments or parents inheritance or property in her maiden Ukrainian name, cause that is all they are going to look at in Ukraine, speaking from experience. If you have citizenship in Ukraine, that is a first, never heard of American going and getting that, but sounds interesting if you did.

    On his radio program, Dobbs slammed the Nation's one-year investigation as "a fairly typical hit piece" and a "smear piece" before speaking with its author, Isabel Macdonald. He also described the liberal political magazine as a "left-wing activist attack publication."
    During the interview with Macdonald, the former CNN host repeatedly asked her if he or his company had ever hired illegal immigrants. "The truth is," he said at one point, "I have never, nor has the Dobbs Group, at any time, hired an illegal immigrant."
    Macdonald acknowledged that Dobbs himself hadn't, but countered that illegal workers tended to his grounds and looked after his show horses for four years. She claimed that the contractors and trainers whom Dobbs hired then employed illegal workers.
    Dobbs questioned other aspects of the article, but also told his audience to read the Nation article for themselves.
    "Your listeners deserve better," Macdonald said before leaving.

    The White House may view the last 18 months as historic, racking up a legislative scorecard that includes a $787 billion stimulus package and an overhaul of the health care system.
    A majority of women, however, see it as a failure, according to a new poll conducted by Kellyanne Conway for The Kitchen Cabinet, a conservative women’s group.
    The findings point to the divide this year between Washington and the electorate, which has yet to give President Barack Obama much credit for his string of legislative victories.
    Fifty-six percent of women consider the health care reform law a failure, while 29 percent view it as a success, according to the poll.
    The economic stimulus package is viewed only slightly more favorably: 53 percent say it was a failure, while 34 percent say it was a success.
    Among independent women – a group that Democrats and Republicans are battling over – a majority viewed the health care overhaul, the stimulus package, the auto industry bailout and the Troubled Asset Relief Program as failures, the poll found. TARP was approved during former President George W. Bush’s administration.
    The negative take on what the White House views as signature achievements helps explain, at least in part, why the president and congressional Democrats have seen their approval ratings plunge since early last year and are struggling to gain traction ahead of the midterm elections. Women historically turn out in larger numbers than men, spelling trouble for incumbents.
    “People who voted for Obama feel just as betrayed by the outcome as conservatives,” said Sonja Eddings Brown, treasurer and creator of The Kitchen Cabinet. “Everybody realizes we’re burying our kids in debt, and even Democrats realize hope and change had a price tag they didn’t expect.”
    In the survey, 41 percent of the women identified themselves as Democrats, 37 percent as Republicans and 15 percent as independents.
    Conway, a Republican who specializes in polling women voters, said she expected to see more optimism about the four major legislative achievements. The poll did not include any questions on the Wall Street reform law.
    “Women are looking at this election almost entirely through an economic lens,” Conway said. “They expect the president to be a mathematician, not a magician. The policies they have seen in the last year literally don’t add with them.”
    A New York Times/CBS News poll released last month suggested that women may be less likely to turnout to vote this year, showing less interest in the election than men.
    But the Conway survey paints the picture of a more motivated electorate. More than two-thirds of women who are registered to vote said they are 100 percent “likely to vote.”
    Conway’s firm, the polling company, inc./Woman Trend, surveyed 600 women. The poll was conducted from Sept. 30 to Oct. 3, and has a margin of error of plus or minus four percent.

    It still makes little or no sense as to why we have to submit this information again for the second time and go and get another biometric done! Seriously. Think about it, if it was a scam or a fraud and they were doing their job right the first time then why do we all have to do it all again in 2 years, typical waste of time and money and once again the federal government agency trying to justify it's existence by creating more busy paperwork and procedures that are more for show and do damn little to stop immigration fraud, just a waste of taxpayer money. AND we have to submit an inordinate amount of this ####### again for a 3rd time and pay another ridiculous fee again and go do another biometric again for citizenship. Bunch of jackoffs in the federal government if you ask me. For example I asked a USCIS worker 2 yrs ago that I knew "Why do we have to get a biometric done everytime if you already have it all the first time" Well I was told because of the background Interpol, FBI, NSA, or state police security check has to be done with new picture and fingerprints due to FBI requiring it if it is more than 15 months old. Which I then pointed out, ok so you say but then it is going to be less than 12 months when we apply for US citizenship next year! So why do we have to do it a 3rd time for biometrics, well I got a deer in the headlights look and no real reason, just that is the way the agency is type stuff.
    As for the Ukraine dual citizenship stuff, I could have told you that, USA does not care and neither does Ukraine(they have no clue anyway and neither does the USA). There is really no such thing as dual citizenship other than the fact that most countries just recognize their own passports like you said, and I would highly recommend that your wife keep her Ukrainian citizenship or passports(local and international) and renew them, will make life much easier for her if she has property or apartments or parents inheritance or property in her maiden Ukrainian name, cause that is all they are going to look at in Ukraine, speaking from experience. If you have citizenship in Ukraine, that is a first, never heard of American going and getting that, but sounds interesting if you did.

AND who will benefit from all this trading of tax credits??? WALLSTREET, they are the ones that will be making the lucrative commissions off all those trades and guess what, when you factor in speculation and their commission, those costs all get passed on down the food chain, right on down to the bottom, that is right you and I the end consumer once again gets hit with this hidden tax, thanks to Ovomit and the democrat congress. I have never seen such a spend and tax bunch ever, this is ridiculous and it is not going to stop pollution from corp or green house gas, which is the problem, think about it all it is going to do is allow these companies to continue to pollute but now US govt is going to make them pay a fee or tax to pollute thus guess who that tax is getting passed on to??? That is right you and I the end user. What a joke Ovomit is.
