    You're looking at the short term game when you should be playing the long game. Lying to CBP will come back to bite you.  Maybe you get through the K1 process fine, but then you still have to adjust status AND remove conditions.  After that, naturalization.  At any time, your hopes and dreams could be dashed because you made an unintelligent decision to lie to CBP.  Is your fiancé ready to move to Malaysia if you mess this up and get caught?  
     
    Don't lie and don't do devious things.  Immigration is a PRIVILEGE, not a right.  There are rules for a reason and lying to CBP is doing yourself and your partner no favors.

    Feb 15, 2024 Case Was Approved for Form I-751, Petition to Remove Conditions on Residence.
     
    Feb 13, 2024 Case Was Submitted For Quality Review Based on An Approval Recommendation for Form N-400, Application for Naturalization.
    Reviewed History for N-400, it does say N-400 to qualify for approval, already placed in line for scheduling for Oath Ceremony.

    If she’s had an American Express in another country they offer a global transfer program that gets you a card based on your history with them rather than credit score. 
     
    If that is not an option, she can always apply for a secured credit card where she deposits money as collateral for the credit.

    Amex does not require the SSN. One cannot have an online account without the SSN but you can have authorized users. I have done so many times successfully.

    Hi everyone, today I had my U.S citizenship interview and I got approved.
    Because ready, other people stories has been so helpful for me, I feel I have a duty to share my case, hoping that it would help other people.
    I also want to acknowledge that everyone's experience is unique, and my situation may not reflect the norm. 
     
    I applied for my removal of condition more than 2 years ago, but never got an interview date. In the time between, I got divorce, then applied for N400 when I became eligible after 5 years. I also got several traffic ticket.
     
    After I got divorce, I did not refile an I-751. I sent a letter to the USCIS with a copy of my divorce decree, and I requested my I-751 to be converted to a waver.
    I never heard back from them.
     
    On my N400, I mention that I got traffic tickets. 
     
    I was not said that I will have a combo interview. My online I-751 status never changed. I remained, "case ready to be schedule for an interview."
    I also had no copy of any document that I submitted along my I-751.
     
    The day of my interview, I had only the interview letter, my passports, my green card, and my state ID.
     
    The officer was very friendly, it felt like I was talking to a friend. He requested all documents that I mentioned above.
     
    He mentioned that we will start by the I-751. He asked me " did you enter in your marriage in a good faith? I said "yes".
    Then he said " you got divorce, what happened, the marriage didn't work out?", I said "yes".
     
    Then he moved to the N400, starting by 6 questions, then a sentence to read, and finally one to write down. 
     
    Finally, he went through my application, then ask about the citations. He wanted to see the payment receipts.
    I told him that I have kept no receipt, I paid them as soon as I got them. 
     
    He printed the N-652 and told me "Congratulations, you are approved, you will receive a letter for the oat ceremony convocation."
     
    And that was it! very straight forward, the officer was super friendly, so were the other officer that I saw on my way out. 
     
    I hope this help those that I am waiting for their interview dates. And thank you again for all the people who contribute to this forum and make this place an amazing resource for immigration information.
     
    Oh last note...I have never used a lawyer, just this website.

    Since he filed taxes already, he should have a copy of his tax return.  Look for the line that says "adjusted gross income."

    You find it on your actual income tax forms that you filed or your return tax transcript after you file taxes not an earnings statement (W2 or 1099).
    Gross income for employed. 
    Gross adjustable for self employed.

    I'm in the boat with many others, don't miss em. But I'm still in the process of it with my Husband.

    This is a lot of loaded paperwork more than other things I've dealt with like IRS, school but it's always different so that came to an exclusion, many other things that ask for paperwork.

    I know my Husband is more of the type of guy who don't wanna do any of the paperwork so he don't miss it either!

    Release Date  09/27/2023 We are updating guidance in the Policy Manual to increase the maximum validity period to 5 years for initial and renewal Employment Authorization Documents (EADs) for certain noncitizens who are employment authorized incident to status or circumstance, including those admitted as refugees, paroled as refugees, and granted asylum, as well as recipients of withholding of removal.
     
    What is does not say is that the wait time for ROC will be faster
     
    So,  it helps the illegals but those who pay and go thru  this legally can naturalize and don't need 5 year EAD

    Not a thing.
    Stop to reading some blogs and look on reliable sources like the USCIS website.
     
    Naturalized or born have the same rights. Nothing changes.
     
    Advice: use your time to better things than look for speculations.

    Have you signed up for informed delivery with the USPS?  It's a great way to be able to track incoming mail.  It's free.  On the day my husband's new 10 year GC was set to arrive, I was able to plan to fetch  the mail right when it was delivered.

    I'll keep my hard copy safe for a long time. In case of event that we lost some kind of ID, having a back up is nice to help settle it even many years later in case some crazy people decide to call ICE on US and we have to show proof... Where I live is questionable but I know how it all goes because I've seen enough crazy in my family that will do things like this so I rather be prepared and ready than sorry. I know it's sad but the paperwork don't take too much room.

    I remember I was searching for my Great Grandfather, came to the US from Italy, through the family tree search. Found out that he came in through Ellis Island and through NY or PA port (idr), and stayed in Chicago having a farm and several kids. Some of those cousin of mine are alive Today. But what I also found out that he Naturalized very soon, this revoke the process of the ability to get an Italian Passport - that's ok, I tried learning the process and it's great to see how the system is set up.

    Yup. I don't know about other area, but I do know in TN I've seen several schools accepting kids for education regardless of their citizenship.

    You are in the grey area, EAD allows you to work. Obtain SSN, DL etc. You are not out of status.
     
    I have never heard of age being a factor.

    For sponsoring you need proof of citizenship or permanent residency. Green card is it. After you naturalize it'll be your naturalization certificate or a US passport.
    Birth certificate is not required from the sponsor unless it's used to establish relationship (i.e. you are sponsoring a parent or a sibling).
     
    That being said, F2A (spouses of permanent residents) can't adjust after entry on ESTA/VWP. You'd need to naturalize first before she'd be eligible to adjust. I also don't recommend entering with the intent to adjust (as that's immigration fraud) or overstaying (as that's another issue runs awry of the law and this site's TOS).
     
    Get married, file I-130 for her, when you naturalize let the service center know to upgrade her to IR and have her do consular interview for an immigrant visa. Don't try to be more clever than you are, thousands before you got burnt like this and thousands after you will as well.

    You don't need to pay taxes for the money you made during the period you were still living in Japan. If you moved to the US and kept working remote, you have to pay taxes on the amount you made remote. You will still use form 2555 to exclude that income.
     
    What other people here are trying to tell you is that even though you can exclude up to 105k for living abroad, you must still file taxes (file doesn't mean paying) for the years you were living abroad.

    File 2555 like you usually do make the dates X October 2022- (day you left Japan). Report any income you make in US from October- December. Source- we did this for tax year 2022.

    Most users are able to fill the forms without experiencing too many problems, so the hiccup is probably on the side of your computer/tablet.
     
    You might want to reinstall the latest version of Adobe Reader, and make sure to open the forms in Adobe, not in your browser.

    There are more out there that you can search from Google but you'll need to find the one you like.  If needed. This is the one I liked so far, didn't do any new recent searches for PDF edit file. I use the online version. I'm using Windows OS but I don't think the web browser version do much difference on other OS but other can chime in.

    Both K1 and CR1 have their upsides and their downsides. 
    Traditionally, K1 was faster but currently
    Last 10 K1 cases out of Brazil took between 494-620 days.
    Last 10 CR1/IR1 cases out of Brazil took between 481- 762 days, 
    If you filed today for either visa your girlfriend will more than likely give birth in Brazil.
    Because you have a child on the way and the beneficiary is going to give birth overseas it is probably wiser to get married as that will make filing various other types of paperwork easier.
