    For the resume just write down City/Town + State (Austin, Texas). You can update when you get you permanent address. For mailing purposes, you can get a PO box, and then again, update when you get the permanent one.

    1. For questions 7-20, you write down all your forms of income before any taxes, before any deductions. 
     
    2. You're only required to show the latest tax return. Write down exactly what the Total Income line in the return is. For 2018, write a letter saying you didn't make enough to be required to file taxes.
     
    3. Current income is what they consider when comparing to the poverty line. So they should use question 20.

    Then this is the wrong part of the forum for this question, and that causes confusion. This is the AOS (Adjustment of Status) forum from K1 only. No one here calls affidavit of support/I-864 AOS to avoid confusions like this one. Next time, they can ask on the appropriate forum to get a more appropriate answer.

    This is specific to your case, there's no way we can tell how long it will take for the field office to reschedule your interview. It can be 1 week or 1 year.

    The main sponsor (spouse) must always send a 864 and send a tax return transcript even when they don't meet the threshold amount.
     
    So you must submit your latest tax return/transcript with your 864, it doesn't matter your income.

    Those are only needed at the interview. For the package, marriage certificate is enough.

    Can't track SSN. You can track the status of your GC with the case number you received after paying for the GC fee. The GC will most likely be delivered to the address you had on form. You should update your address by filling out a change of address form on the website, but unfortunately there's no guarantee that it's gonna be processed before your GC is issued.

    The marriage certificate is your name change document. You don't need to go through the court. You can start using your spouses last name from the day of marriage.
     
    If you're talking about a first name/middle name change, then yes, you would have to go to the court.

    No problem with that. You will both write a letter electing her to be treated as a resident alien for tax purposes, and use form 2555 to exempt her income. And like I said above, her country doesn't need to have a tax treaty with the US because she meets the physical presence test.

    This information is incorrect. You don't need a tax treaty to exclude foreign income. US doesn't have a tax treaty with Brazil and I was able to exempt my Brazilian income in 2019 just fine.
     
    You have to meet either the bonafide residence test or the physical presence test, and for the physical presence test you don't need a tax treaty.

    When did he get his GC? If it was in 2020 you don't need the statement electing him to be treated as a resident for the whole year.
     
    Apart from that, yes he qualifies for all the stimulus checks.

    It still doesn't name sense to me. If your husband didn't withhold enough taxes for the year of 2020, filing separately would still make him owe more taxes then filing jointly, since the standard deduction would be half of if filed jointly.
     
    Unless you have tons of investment accounts in Canada that might not be exempt (but then you wouldn't pay taxes in Canada for that because of tax treaty), it doesn't make sense how you owe more taxes by filing jointly.
     
    Did you have any US income last year? I don't think so since you just got your EAD this year. I would suggest trying to do your taxes in a free software to compare with what your accountant is doing. He might not be applying all the exemptions for foreign spouse.

    The medical is valid for 2 years if done after the AOS was submitted. 
     
    The 60 days rule is if you had done the medical before filing for AOS. You medical needs to be no more than 60 days old at the time you're filing your form 485. If your medical was done after filing for AOS, you should only think about the 2 years expiration date.

    Why would you gamble your AOS Interview like that? Withdrawing an application can raise questions to the IO and put the GC in jeopardy.
     
    By your post, it sounds like your interview was scheduled to right before your 2 years anniversary, correct? Just go and stop thinking about avoiding ROC. One step at a time. No one should play like that with immigration.

    Assuming he entered with a CR1/IR1 visa, the officer at POE stamped his passport and that serves as a temporary GC valid for 1 year.
