Ayrton got a reaction from geowrian in Stimulus payment for foreign wife of a U.S. citizen
Your husband already got his Stimulus based  on 2018, so you wouldn't get the other $1200 now if you file 2019.

You can receive it though in 2021 when you file 2020 taxes, if the combined income for 2020 is less than 150k (if filing jointly) or your income is less than 75k (if filing separately).

I suggest you reading this page from the IRS:

    https://www.irs.gov/individuals/international-taxpayers/nonresident-alien-spouse

Filing taxes has nothing to do with you having an EAD. If you want to file jointly with him for 2019, you must follow what that page says. It doesn't matter if you lived only 1 day in 2019. You will be considered a resident for the whole year by sending the statement and must report your foreign income.

They are free when you apply together or after the I-485.

    Send the forms.

    Don't forget the I-944.

What people are receiving is a tax credit for 2020 tax return.

The advanced payment of this credit is what's based on 19/18 return. If you didn't qualify with 18/19, and qualify with 2020 return, you will receive the tax credit.

According to this article, if the person is eligible on either 2018 or 2019 and received the money, but their income changed in 2019 (not filed yet) or 2020, they don't need to give the money back.

What you said doesn't make sense. I-944 is not a required form of the Affidavit of Support. It has nothing to do with it.

This form is required to be sent with the I-485.

Just send the form, even if you don't have all the evidence right now. Remember that not sending a required form is a straight denial now. Not sending an evidence still triggers a RFE.

And I'm not even comment that the USCIS customer support is often called Misinformation Line here in the forum.

That's not correct. The immigrant is the one applying for AOS. The USC is only the sponsor (main sponsor). The immigrant is the one adjusting status, so the immigrant is the applicant.

The second part is still unknown since the form just came out. But what you said is also not quite correct. For example, if a USC wants to file jointly with their spouse that arrived last year on k1, the couple must report all worldwide income, the foreigner spouse's included, even though they were not a resident last year.

I read that the instructions of the form says to send any return from any country, so better be safe than sorry and send everything you can.

Read the instructions again. What matters is the day you filed for AOS. This day can't be more than 1 year apart from the medical day.

The USC spouse is always the Main Sponsor. You need to send I-864 for any sponsor you're using, including yourself, and send all mandatory supporting documents.

Make sure you use Annual Current Income and not Adjusted Gross Income, they are two different things.

Current Income is before any tax deductions, 401k, and any other deductions. That's the sponsor salary or hourly rate * hr/week * 52. This number goes on question 7.

Adjusted Gross Income is after all those deductions mentioned before. This number goes on 24a,b,c.

You don't need a new medical if you file AOS up to 1 years after the medical in your home country.

You don't need a I-693 to file for AOS, you can bring it to the interview with the updated vaccinations.
Packages sent before Feb 24 won't be subject to the new rules. They're probably trying to avoid that

Ayrton got a reaction from SalishSea in RFE, joint sponsor doesn’t qualify can I use my petitioner (husband) [merged topics]
Your RFE was for your joint sponsor, it had nothing to do with your self employed spouse.

Like I said before, 99% of the times RFEs are sent saying the sponsor doesn't make enough, it's because a required document was not sent. Therefore, the sponsor is ineligible = the sponsor doesn't make enough.

To understand what triggered the RFE we need to know exactly what documents you sent. On a previous posto you said: "we sended them Tax Transcripts, Tax Returns and even SS Benefits stubs to show that the mom only amde like $5000 a year from their $60,000 income".

Did you send the 1099 for the joint sponsor showing his retired income? By your post, it seems like you sent it for his wife, which it won't make sense to them. You need his 1099 to show he made 55K, not hers to show she made 5k. Also, if you wrote his wife income on his form I-864, you must've sent a I-864a for her.

Also you said you sent both Tax Transcript and Tax Return, which the instructions clearly tell you not to do so.

Anyways, saying one more time: Every required document is in the instructions pdf. It's 17 pages, so it's easy to overlook.

No. But I searched here on the forum and couldn't find a single RFE about that.

Something that I learned though is that people tend to overcomplicate their packages and end up getting RFE because of some extra documents that they sent when they were not required to.

The instructions are there to be followed. If for some reason someone gets an RFE for a document that was not on the list (which I've never seen it happening), it's because something triggered the officer to ask for it.

Not really. The instructions are pretty clear on what documents they want to see when the sponsor is self employed.

If you file jointly with your spouse. You must report your income from abroad. It doesn't matter how many months you were in the US in 2019. To file jointly, you will be treated as a resident alien for the entire year.

Ayrton got a reaction from Cornflake in RFE, joint sponsor doesn’t qualify can I use my petitioner (husband) [merged topics]
99% of the time someone receives a RFE saying "they don't make enough" it's just because you didn't send all the required documents and therefore the sponsor is ineligible.

The sponsor can make 1 million dollars a year, if the applicant doesn't send the required documents, the sponsor will be automatically rejected and the applicant will receive a RFE saying the sponsor doesn't make enough money.

I suggest you to read the instructions for the affidavit of support. All the required documents are there. When you have a joint sponsor that filed jointly, more documents are required.

I think there's a difference between a translation and a transcription. The template that you mentioned is a transcription in English of a birth certificate, not a proper translation of the original document. So my suggestion still is to use the same layout and translate every single word in the original bc.

Ayrton got a reaction from Sarge21555 in Company not accepting EAD, requiring GC to get hired.
GC also have expiration date. And the first GC for most K1s is only valid for 2 years. So it makes no sense. HR probably doesn't know what an EAD is and they might think they're gonna have to sponsor op.
