During the AOS process, the immigrant is not called beneficiary anymore. The immigrant is now the Applicant and the USC spouse is the (main) Sponsor.

You're not allowed to use the non filers to get the early stimulus since you were not a resident in 2019. You're gonna have to wait until you file 2020 taxes in 2021 to receive your stimulus.

A lot of people got rejected lately, even though they said they filed everything correctly. So nobody knows why USCIS rejected them.

Just download all the forms again, fill them out and send it again.

You didn't mention 765 and 131 on your post. It's highly recommended to file this forms too. They're free with AOS, and your spouse will most likely get the combo card before the interview and will be able to work and travel.

You basically need to send the whole package submitted to IRS, unless you have a tax transcript.

Ayrton got a reaction from Wuozopo in ITIN/SSN dilemma while filing taxes
A spouse cannot be claimed as dependent. They can either file as MARRIED filing jointly or separately.

First, when did you get married? You said a couple months ago. If you got married in 2020, she will file 2019 taxes as SINGLE.

If you got married in 2019. She will file as MARRIED, either jointly or separately. If you decide to file jointly, you will attach a W7 to the paper return and send it to IRS. If she file separately, you don't need a SSN or ITIN. I believe you can just put NRA where it asks for SSN.

You need to send it back with proof of the real name and they will replace the card. The letter of approval (or the one that came with the card, not sure) tells you where to send the card to get it fixed. It happened to me back in January and it took 1.5 months to get the new card in the mail.

Ayrton got a reaction from Lemonslice in How long does it take them to schedule AOS interview?
It can take from 1 day to years. It all depends on your local office. Everything you need to bring will be on the letter you will receive when the interview is actually scheduled.

Right now, everything is closed due to COVID-19. Don't expect anything before June 4th, when they will reopen.

Yes, you're gonna have to send all the new forms, including the new I-944.
That kind of stuff is not required for AOS Application. Only the marriage certificate is required.

It seems like you underestimated the AOS process. And right now, to reapply you're gonna have to pay even more attention. The new form I-944 is required, and a lot of evidence must be sent with it.

If you didn't send the I-864, that's the reason why it was denied.

Not true. You need to have filed taxes (1040) in 2019 or 2018 with an SSN to be eligible for the advanced rebate. I'm not a green card holder and I received it.

I doubt you will receive at the same time. Her Application is in the line since November. For you it's like applying for a new one, so end of the line. She is probably getting her EAD and AP anytime soon.

I believe you're gonna have to redo all the forms since they were updated on Feb 24. And include the new I-944. Also remember to send a copy of your mom's NOA1 for her AOS.

You are already IN THE US, so AOS shouldn't be affected, for now.

Anyway, he didn't sign anything yet.

Not sending a marriage certificate won't give you a RFE, will give you a straight DENIAL.

You can send 2018 taxes. 2019 taxes were pushed back, so it shouldn't be required now. If they do require, then they will send an RFE for that.

Your package wasn't rejected because it had a pending application for you. By this email, your lawyer checked the wrong box on this question.

According to the email, you lawyer checked 2.a. The correct one for you is 2.c.

Honestly, I would fire this lawyer and get a new one or DIY.

According to this article, if the person is eligible on either 2018 or 2019 and received the money, but their income changed in 2019 (not filed yet) or 2020, they don't need to give the money back.
