Ayrton got a reaction from Chancy in SS Card: sooner vs later?

I don't think it will work for your case. Your name change document is your marriage certificate. So if you already have a SSN in your maiden name, you won't be able to change your name on your SSN because your name change document is dated before your immigration document (visa). So for you, what they consider as legal name is the name on the visa.

You can't apply one week later because you have to wait to receive the NOA1 from AOS before you send a 131 separately, and that's gonna take at least 4-6 weeks.

Your wife has being resident for tax purposes since the first year you filed jointly with her. Since she was abroad, you most likely filed with a ITIN number, that's why you haven't received the first stimulus. If she has a SSN by the time you file taxes, she will be eligible for the first two stimulus on this return, the third one will come either after this one is filed or when 2021 return is filed. You, the USC, are eligible for all 3 as well...

Yes, the online eliminates the 1-2 months wait time for the lockbox to receive, accept and send the NOA. If you file online, you can keep the card until they are ready to give a decision. They will send a RFE for you to send the card.

If you only send 1140, your package won't even be accepted and it will be returned.

Ayrton got a reaction from jackiegringa in F1 to AOS to GC before filing taxes
Receiving a GC now only makes you a resident for tax purposes for the year of 2021, not 2020. Just file married filing jointly and send the statement asking to be treated as a resident for the whole year with either a software that allows that or by paper. You will be eligible for all 3 stimulus checks.

Nothing. They filed again within the timeframe, if everything is correct, it won't be rejected again. Her status doesn't end when the card expires, she's still a PR.

I had to send my original EAD twice to get my name changed via usps. First time they denied after 1 month, second time they approved after 2 weeks. If you have an appointment, just wait for it.

ITIN is not a work authorization. Illegal immigrants using ITINs to file taxes doesn't make it legal in any ways.

An ITIN doesn't allow anybody to work. If you're allowed to work (EAD, GC, Visa) then you qualify for a SSN and should not apply for an ITIN.

To OP, some states will let you get a state ID/DL without a SSN. Call your local DMV to check their requirements.

If she's a resident alien for tax purposes based on the presence test, she can't file a 1040-NR because this form is specific for non resident aliens and like mentioned before, she's not.

If she wants to file taxes, she files a regular 1040 with an ITIN application (form W7) right in front of it.

Since she's not even working here, why do you want to file her taxes? She has no income, she's not required to file taxes.

No, you don't need to get a civil surgeon to fill out a 693 if your DS 3025 was marked completed.

That's not the case for IOE case numbers. The name on the account must match the name on the form, so OP probably received an IOE case number for his wife aos.

The officer gave you the wrong information when you first tried to change to your married name. You didn't need to wait for the Green Card to update your name on the card. The marriage certificate was the only required document to prove the name change. And to prove status, you could've sent a visa or something else that had the maiden name and was issued before the date of the marriage (as long you were still under that status).

After saying that, the same applies to your divorce. After your divorce is finalized, the divorce decree is enough to change your name back to your maiden name.

For ROC though, if you still don't have a divorce decree, you must file as married and then switch to a divorce waiver when the divorce is finalized. If you file before, your married name should be in the form. If you file after the divorce is finalized, then you use your maiden name.

You must file for ROC with a divorce waiver. You could've done that as soon as you got your devorce decree. No need to wait.

I'm assuming you filed by paper. Unfortunately there's still a huge delay for paper filers. 1040+w2 should work.

Local office is assigned according to your zip code. If you move, you have to report the change of address within 10 days, and then your case will be moved to the new office.

Just use the USCIS website to check your case.

If you want to use her income, she needs to file a second 864, not a 864a like mentioned above. She's not your relative, so she doesn't qualify as a household member.
