Just wanted to update - had my green card interview yesterday, medical/vaccinations wasn't even MENTIONED - got approved 👍

Another warning to anyone in my situation - don't bother paying for another medical/civil surgeon unless you're 100% sure you need to complete the I-693, because i didn't have to.

    Please, read the USCIS website:

"If an applicant was required to obtain the flu vaccine at the time of the medical examination (the date of the civil surgeon’s certification governs) but a flu vaccine annotation is missing, the officer should only issue an RFE if it is still the same flu season and if it is reasonable to expect that the applicant will be able to obtain the flu vaccine within the time frame of the RFE.

This accounts for the fact that the flu vaccine is strain-specific and only available for a limited time each year. The officer should not issue an RFE if the applicant will not be able to obtain the strain-specific flu vaccine that had been required at the time of the medical examination because:

It is no longer the same flu season; or

It is not the flu season at all."

    https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-9

Flu shots are different every year, if it's not the same, it shouldn't be required anymore.

No that letter is mostly random. Some get it, some don't.

My interview was today. Approved and card is being produced without the need for the flu vaccine.

The flu shot can be received at the local public health department or local retailer pharmacy, but make sure you also get vaccination proof/record. Then search for local civil surgeon that can do simple transcription and sign I-693 for lowest possible price.

I had to ring around to find someone who did not want to do the full medical, got lucky and found someone who just signed it for free, it only took a couple of minutes. Guess it depends when you submit for adjustment and agree not that logical.

@peanutismint Sorry for the wrong information. That was never my intention. I sure hope you don't need to get a new medical of any sorts given how exorbitant CS try to charge around here. Good luck with your AOS interview next month 🙌

This is not accurate. If you apply for AOS within a year of the medical, it's valid. It doesn't matter how long the AOS process takes, it's the date of application that determines validity. The OP's medical was well within a year of submitting his application.

I wouldn’t do anything medical unless you are told at the AOS interview that your shots were incomplete or your medical report was not found. Then you spend the money when you know exactly what they want, if anything. You get what is needed from a Civil Surgeon and send it directly back to your interview person. You won’t be in a long queue...maybe a week after he gets what he needs to approve.

And found out today by going on USCIS.gov site and getting live chat on Emma, that my  package is being mailed back as of 8/20/20 for incomplete fees.

That's good to know they are behind; I'm not desperate for my green card but just wondered as it's the weirdest thing to put your entire life in the hands of some beaurocratic governmental department and then have them not speak to you for over a year....!

peanutismint reacted to Penguin_ie in Negative attitudes in the forum
I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.

First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered.   While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards  those fortunate to have their case dealt with quickly, or  critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!

Secondly- in the info forums, you may get bad news.  When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed.  However, the emphasis is still on being welcoming and friendly.  If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive.  No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or  illegal actions in the past- instead, encourage and explain legal options for the future.  And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.

Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums.  But if you feel that way, just scroll past- no need to criticise the OP for asking the question.

peanutismint reacted to Wuozopo in Advance Parole came but ‘parole stamp’ is blank?
Dunno. In the pre-combo days they always sent two. I got two. Maybe take a color copy and the original on your trip and ask if they will stamp the copy or what to do on next trip. Find an old bloke who would remember the old way.

peanutismint reacted to HRQX in Advance Parole came but ‘parole stamp’ is blank?
    Yes, it's normal:

INA 264(e): "Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d). Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both." Definition of registration certificate is at 8 CFR § 264.1(b):
As a realistic example, if an AOS applicant (that has been issued an EAD) travels through an internal BP checkpoint, shouldn't he carry his EAD? https://goo.gl/maps/N3iXnPCiEgHrztDw9
Darn! I wonder why they only sent me one.

peanutismint reacted to Ksenia_O in Advance Parole came but ‘parole stamp’ is blank?
When I had to re-new my combo card, for some reason my AP was sent to me also  as a separate document. I've heard once in a while this happens.
It was the same as you've described -  with a box with my photo in it, and with a blank "parole stamp" box.  If I remember correct - it was 2 identical pieces/letters.

A "parole stamp" box will be stamped at POE upon return to the US. So, no worries here  - It has to be blank until you enter the US.

You'll be going through the secondary, which is a regular routine as well for everyone, who enters the US  with a combo (EAD) card . So, if you have another flight within US on your way back - you should make sure you have enough layover time between those flights..  You never know how long the secondary can take - usually it took about 15-40 minutes for me, but once in Detroit  - about 2 hours....

I think the second piece of AP was also taken by CBP during secondary.  So, not sure if that 'paper" AP is only for one travel - thankfully , shortly after that travel I got my green card, so didn't have to worry about AP anymore.

You cannot get any stamp at this point - I-551 stamp can be given only to an LPR. And you are not there yet, until your AOS gets approved.
Also, don't think you can re-apply at this point - you were granted both, a Work Authorization and Travel documents . They are valid, not expired and etc... Just look "different" . So, i doubt USCIS will re-issue anything at this time.

But you should be fine to travel with  the AP you were provided with - it's still I-131 Form and serves  as a travel document.  I did - no troubles, and it was the same routine as before, when I traveled with a combo card.

Good luck with your immigration journey and have a safe trip!!!!

peanutismint got a reaction from Q2018 in I THINK I’m getting my work permit expedited but confused by government wording/time-scales...
That’s annoying, hope it doesn’t take too long. This is why I was concerned, because I was already in a queue to get a work permit, now it just feels like I’ve joined another queue without really knowing how long either of them are. This  system is completely broken. Extra frustrating when I could’ve probably applied for an expedite way back in like April if I thought it was going to make the process any faster. People on this forum said it was maybe 1% effective, and maybe that went up to 20% if you file through your Congress like I did, but speaking to the Congress office they say it’s pretty much guaranteed to get approved if you submit with a letter of job offer, so now I really wish I had done this months ago. With the backlog the way it currently is, it could’ve been as long as November or even December from me submitting my form mid March, so here’s hoping it comes through earlier now... USCIS is kind of a farce!  🤷🏻‍♂️

peanutismint got a reaction from Q2018 in I THINK I’m getting my work permit expedited but confused by government wording/time-scales...
I filed for my I-765 in March and still hadn’t received it by August, so when I got a job offer to start September I applied for an expedite via my local congressman’s office.

They told me if I have a job offer it’s pretty much guaranteed to be expedited, which is good because I’d heard the chances were pretty slim unless you had a huge financial hardship. I was worried about making rent like anyone else is but unfortunately he government apparently don’t consider that ‘extreme’ enough...

Anyway, about 3-4 extra weeks since applying to expedite the response from USCIS came back and it sounds like they’re going to do it but it’s still confusingly vague, like it doesn’t give any kind of time frame, just says that I’m “in the queue”.....well wasn’t I already in the queue??! Here’s their response:

Thank you for your inquiry regarding this constituent’s immigration matter. This case will be routed for expedited processing. Once this case is reviewed, your constituent will receive a decision or notice of further action. Due to the extremely high volume of expedite requests for this case type, there are numerous cases involving exigent or humanitarian issues already in the expedite queue, and we are unable to provide a specific timeframe for the expedited review. The strict enforcement of the expedite criteria means that all cases sent for expeditious handling are urgent, and we assure you that this case will be adjudicated as soon as possible.

So should I take that to mean they are going to expedite, or it’s still dependent on them reviewing my job offer evidence etc?? And if anyone here has been successfully expedited, what was the wait between getting this notice and getting your work permit??

Just as an update to this case, I got one of my clients to write me a formal job offer   for some upcoming work they’d like to use me on and my local Congress office submitted it for me. USCIS haven’t given me an answer yet, but when I spoke to the assistant at the Congress office she said it’s pretty much guaranteed to be accepted as long as you have a job offer, which is good information to hear!
