I may be wrong, but I believe with a CR-1/IR-1 visa the permanent residency isn't valid until one gets the I-551 stamp first at the border. The CR-1 visa just serves as a proper valid travel document to enter the US. I think this is what the "UPON ENDORSEMENT" part means. So, technically a CR-1/IR-1 visa holder doesn't have residency until they get the I-551.

Nevermind, I figured it out. When I add a household member, the prompt asks for selecting the related sponsor as the joint sponsor. Thanks for your tip Parisa_1234!

Exactly, the lawyer does not have the right to keep these info from you. Your lawyer is clearly abusing your lack of knowledge about client-attorney rights. He may also be hiding some of his mistakes in document submission that could delay your case.  Become proactive and demand your case info so you can follow up the updates yourself.

Okay this is utter BS and I am trying not to cuss. I have a friend who I swear must have your very incompetent lawyer. So much in fact their lawyer actually drafted up fake approval letters to shut them up. They been sitting for 2 dang years............ 2!!

Now here you are sitting for 3 months for something that never has happened. You can have that lawyer disbarred or at least on Bar review. Don't you even communicate with them. And on the ceac.state.gov website take off your lawyer so they get no further correspondence about your case.

How stupid are they to say your visa is waiting at the embassy. How the heck can that happen without an interview.

This is so sad but at least you know now. Don't argue with hubby seems you have it all under control. Do IT Yourself.

Get the case number and Invoice ID and log in to see if you really are just waiting for interview.  If they cant provide that, they might be lying to you!. Dont wait! Also with USCIS, didnt you get a receipt number? With that receipt number you can see online if it was sent to NVC or not! When they sent the petition, the petitioner shd have then received the receipt via mail. When it was approved, there should be also another mail recieved. When NVC got it and created a case number,  you all shld have received an email or snail mail copy. Only then you can log on to CEAC. So strange! Fire the lawyer and do it yourself. Lots of people here are helpful.

Demand all your case numbers from the lawyer. He doesn't have the right to keep any of these from you.

If you at least have your case number from uscis through noa1 - you can also contact nvc with that. If you don't, if I were you I would also demand all written correspondence came from USCIS to be sent to you as well, as they don't need it and you should at least get the copies.

That is ridiculous. You need to ask for the case ID and invoice ID and login online to your NVC account and see what is happening. I don't think the lawyer has the right to keep these information away from you. I wonder why you don't have an email address on file so you will also be contacted for any case updates.

My case was also got documentarily qualified today! So as a reference for others, I only submitted I-864 for the joint sponsor and included the tax transcripts and W-2s for the past 3 years as well as her pay stubs for the past three months. We did not submit I-864a even though she filed her taxes as "married filing jointly" because her income alone was enough.

pm_1234 got a reaction from SusieQQQ in Applying for TN visa while waiting for consular processing
Yes but they have to cancel the consular processing and always risk not being admitted because of misleading the US immigration. Also, they can always do that with a visitor visa why should they bother with a TN.

Interesting! Everyone is complaining about their lawyer delaying their case! We are in the same boat! We've been delayed at least 1 month and a half for the information that our lawyer should have provided us but did not until I read the instructions myself!

pm_1234 got a reaction from Rainbow3e in Need your advice - Income requirement
I submitted my DS-260, AOS form, and documents about 2 weeks ago and today I received the following note (with all documents showing "accepted"):

"The petitioner does not meet the minimum income requirement to sponsor the intending immigrant for this case. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p. To avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor may be submitted. "

It is true that I don't have a US-earned income since I am a graduate student in Canada. However, I uploaded proof of financial assets (money in saving and investment accounts) that is well beyond the poverty line for a family of two (more than 3 times of the poverty line) and this should have covered the insufficiency in my income.

So, I am puzzled why they have the note about my income. Also, does the message mean that I have to submit the AOS with a joint sponsor? Is my case on hold till I submit a new I-864 form with a joint sponsor?

I really appreciate it if you could share your thoughts or experiences on the same issue or similar issues.

    Thank you!

I think we should be fine. The message is probably a general one and it should be updated once the documents are reviewed by the NVC.
