    It’s been quite awhile since I’ve been on this site participating in discussions.   When my husband (now ex husband) was first denied in 2014, I took it as my mission to help others in my situation. I did that for a few years.
    Well now I’m back here trying to turn another negative into a positive and hoping my pain can again help others. After 5.5 years of marriage, I have discovered that I am a victim of a covert narcissist who (along with the enabling of his family) used me for a green card and a new life.  I am here to speak my truth and hopefully bring awareness to Covert Narcissism, a personality disorder rampant within a society plaqued by systemic poverty and survivalist mentality.  
    Yes, now looking back I see the red flags I ignored and signs of deceit but it was so subtle and not knowing anything about covert narcissism I was completely blindsided.  
    My intention is to make future posts to help point out the signs of narcissistic personality disorder so others have the knowledge that I didn’t have.  Being in a long distance relationship makes it very difficult to really know a person’s true character and intentions because of the limited time spent in person. It’s so easy for these people to hide their real self and create a fake persona of who you want them to be. I have personally heard the stories of over a dozen women that have been take advantage of by these types of people. The events and behaviors  are almost identical. 
    I encourage anyone who has experienced this to share your story. I am a safe place and you can also private message me.

    My fiancé’s interview was 6/4/2021, he received his letter regarding the ban on 6/21.  I called Andrew’s that same day at 876-920-7637, i had to call several times before I got through to someone. I was told to email a copy of the letter to usmeds@amhosp.org to initiate the random testing. That same day some one called my fiancé , explaining the process that he will be contacted by phone for random testing. He was told that once he receive a call, he has to come in first testing within 24 hours.  Since June he got called twice to come in for testing.

    Given that CR1 are taking almost two years, she might have completed the 5 years by then. 
     
    She has to answer forms truthfully. So if she is asked about working illegally, she has to say yes. It's pardoned for those marrying US citizens. But if she gives false information, then you get into serious problems. 
     
    Try talking to a lawyer, but start preparing all of the paperwork. You can submit the application because it's going to be months at USCIS and there is nothing you can do to speed that up.

    So just to put this out here, I'm not a legal expert but this is my understanding of where things are at. This is definitely not a DIY case. There is possible inadmissibility for both use and conviction of controlled substances and misrep on the ESTA forms. Not good, however waivers might be available...but it would be dependent on the hardship upon you if he wasn't able to obtain an immigrant visa. That might be hard to demonstrate given that you're living with him in Australia right now.
     
    The arrests while a minor shouldn't be too problematic...from a cursory look online conviction while a minor is a problem if the minor is tried and convicted in an adult court. However, a conviction for drug use while an adult triggers inadmissibility which must be overcome for him to be issued an immigrant visa. That's not impossible to overcome but it is a challenge for sure.
     
    His bigger problem is the misrep for ESTA. If he answered honestly on the ESTA forms, his ESTA should not have been approved, and thereby he was able to obtain admission to the United States because of that incorrect info. That's a big problem. Applying for an immigrant visa involves submitting police records to the Department of State which will indicate the conviction and they'll be able to see that he managed to obtain admission under ESTA. That'll set off alarm bells. A 212(i) wavier could be available for this too, but again he'd need to demonstrate extreme hardship to you in order to overcome the inadmissibility...and I doubt 'hating' Australia would cut it.
     
    By my casual understanding here, he needs two waivers for the drug conviction and the misrepresentation. He'll likely undergo drug testing as part of the medical because of that history. It is important at this point that it is extremely important that no further misrepresentation happens otherwise a difficult situation may be made impossible.
     
    As I mentioned originally, an attorney will be needed to help build a convincing case for the waivers if you decide to proceed.
     
    As an alternative, you might be able to consider another country. The prior drug conviction will be less of a problem for Canada and while US immigration history needs to be declared to Canada, the US misrep would not trigger Canadian inadmissibility. Family could then visit in Canada. It's a long shot, and you might not be eligible under their programs, but it is worth considering.

    Get a very good immigration attorney who is good in waivers is the summary of what I’m reading from everyone. Multiple convictions plus misrepresentation or lying on immigration forms?
     
    Time to bring in the mercenary cavalry heavy hitters.

    I have been living in Australia with him for 6 years. we have two young kids. I hate it here. all our family is back  in the states. I did not see this coming.

    unfotrunately our news is focused on the negative but reading the report from Rice University it says the following:
     
    According to Rice University research, Nigerian Americans are the most educated group in the United States.[21][22]
    According to the 2008-2012 American Community Survey conducted by the U.S. Census Bureau, 61.4% of Nigerian Americans aged 25 years or older hold a bachelor's degree or higher, compared to 28.5% of the total U.S. population.[2
     
    So,  when he comes , encourage him to excel and just love what the 2 of u an accomplish together

    Why would you NOT put this down, beyond the fact that you would be jeopardizing the success of your petition? Are you trying to hide it from your fiance? If you are, consider this -- would you rather explain it to your fiance on your terms, or have the information sprung on your him during the visa interview? This is the sort of thing they ask about -- did you know your fiancee was previously married? I mean, you have to prove the prior marriage was terminated with your divorce decree. It's part of the petition.
     
    If you haven't had the discussion yet, figure out how to do it soon. Communication and trust are the bedrock of any healthy marriage. Best of luck to you, and you're doing the right (and only) thing by disclosing your first marriage on the petition. If I could forget about my first, I would too!

    If the ban is over in December I wouldn’t bother applying for a waiver. The cost and hassle involved for something  unlikely to be resolved by then doesn’t seem to make sense. Not sure about 4 months, FYI official uscis times to process i601 and i212 is 4.5-6.5 months. Best case resolution is not as good as just waiting for the ban to be over.

    i had posted these same comments on this forum previously, but the naysayers didn't want to believe that all
    DRUG testing is done in all countries medical. Illegal drug is tested as part of the medical for immigration to the US, it does not mean that all indivuals are tested. It just might be someones unlucky day to get tested or questioned. The US immigration has a none discrimation policy on drug testing, therefore any indivual from any contry can be tested or questioned for illegal drugs.
    When I pointed this out, the naysayers only wanted to believe that this only happens in developing countries. As I had stated only the brave will come bak on a public foum and tell that they were denied for illegal drug testing or questions.
    Others just quitely wait out the 1 year ban.

    This is why when i write to many on here i say forget immigration during the process unless an there is vital information needed to send in like for an RFE or other communication with immigration
    This time is suppose to be for getting to know each other and the romance of it all 
    We went thru 6 years and i never let Adil know how upset i was with the whole process / i talked daily about what life would be for us here and tried to keep "his spirits up"  as he got discouraged and thought it would never happen
     
    But if going thru the K1  hassle broke you up,  the AOS,  EAD and AP process after you married would be a nightmare as you would be stuck at home and unable to work
     
    If he does decide to talk ,  you are going to have to get romance back into the relationship for the reasons you fell in love,   
    and if you get that K1 visa,  you need to understand the rest of the journey as stated above and talk about the other processes with him before you come
    it can be a nightmare and can come between 2 people when the time after marriage should be more like a honeymoon time

    I wanted to address the negative attitudes we have seen on the rise recently in the upper/ immigration forums towards those who ask beginner/ simple questions, or have unusually fast or slow VisaJourneys.

    First, there is a tone difference between the Progress forums- which are mostly for support and cheerleading, and the Info forums, which are mostly to have questions answered.   While all our forums are supposed to be welcoming to all and friendly, this is especially important in the Progress forums, which are not to discuss politics, or be negative towards  those fortunate to have their case dealt with quickly, or  critical of those who voice sadness about their own slow progress. These forums are there to uplift eachother!

    Secondly- in the info forums, you may get bad news.  When a question is asked, our members are encouraged to answer truthfully, even if this may not be what the Op wants to hear, because it is important to be informed.  However, the emphasis is still on being welcoming and friendly.  If you need to give bad news, do so gently, and stick to facts; constructive criticism of the Op's plans ARE allowed, but the emphasis is on constructive.  No need to dwell on mistakes (or tell members they should be on 90 Day Fiance- that is a personal attack and automatic suspension), or  illegal actions in the past- instead, encourage and explain legal options for the future.  And ONLY legal options- as per our TOS, VJ does not support, condone or encourage illegal (immigration) actions, and such posts will be removed.

    Ultimately, we are here to help all members, old and new, easy cases and complicated, those who write a fact filled bullet point post and those who are panicking and don't make much sense in their first post. Yes, sometimes questions can be easily googled, or answered via a search of our forums.  But if you feel that way, just scroll past- no need to criticise the OP for asking the question.

    Hi, I did not get a lawyer for any of the process for my husband's green card.  Today I received the approval of his waver.  I wrote it myself and just made sure to get others to read for me for proof reading and grammar.  I did not pay anyone a cent only the application fees. I sent all the proof that I could from my bills to tons of pictures. Letters from my children and family members, people from the community and my job.  I did not have any medical or any grave conditions.  I wrote the hardship letter from my heart and detailed everything we have been through and detailing the reason why it was not good for us to go to Ecuador and sent proof of all the corruption of the politics, the kidnappings to US citizens. I also stated health and medical insurance and the lack of it in Ecuador. Education and how bad it is for my children.  I detailed everything with facts and sent proof.  Things I googled and sent. One time sent and we got approved.
     
    Hope this helps.  Look for sample letters here of people who have been approved.  that helped me a lot.

    Maybe she did plan it, maybe she didn’t. No one here is a mind-reader so we can’t know for certain. Fact is, it had been decided in a court of law that intent alone is not enough to deny AOS but it appears (from the little pieces of information we have been given by the OP) that in this case it was used as grounds for denial. 
     
    He said she got pregnant 3 weeks after she arrived. And she arrived in February so she would definitely know by now. Not that it matters. Most married couples have sex. And most fertile people become pregnant as a result of that. It’s hardly earth-shattering that a married woman became pregnant after spending 3 weeks with her husband. How else did we all come into being?
