Chene reacted to Chancy in No 10 year green card?
If you entered the US after your 2nd wedding anniversary, your immigration status is "Lawful Permanent Resident", NOT conditional PR. Select reason: DHS error.

You spoke to tier 1 officer. They know nothing.
You will have to file I-90 to get a 10 year gc. There is no fee for this.
Before you file I-90 do the following:
* make an electronic copy of the front and back of the gc
* Go to SSA to get your green card
* Go to the state dmv to get a REAL ID drivers license
* Apply for ACA health care if you need health insurance.

As you entered the US after your second anniversary , you should have received a 10 yr GC. USCIS has made the error. As MikeE states… file an I90… no fee needed.. USCIS error.. keep copies of everything including the current GC.

100% inaccurate. The Permanent Resident Card is a Green Card. Some of these USCIS tier 1 people have no training at all?

Thx. Much clearer. I did reread your post and sorted it out in my head. 😁
Yep. As it should be. Apply for the correct card using the I90

She can use your line.
Nonetheless, I'd recommend you fly in on 5th. You do know there are different timezones so you flying in on the 3rd and trying to explain may get you nowhere and you may end up with a 2 year GC. Avoid all the hustle and fly 2 days later and everything will be 100% sure.
@Crazy Cat any input?

Just make sure she doesn't enter the US prior to Sep 3. You both can go in the same line, and you can mention it to the CBP officer, but he/she (CBP) does not make the decision regarding 2 yr or 10 yr Green Card. That will be handled by USCIS before the card is produced. Believe me, you do NOT want to do Removal of Conditions. It can be a headache.

Both. The card will not be produced until both the fee has been paid and the immigrant has entered the US. After entry, USCIS will compare the date of marriage and entry date to determine either 2 year card or 10 year card.
(Note: Most people pay the $220 fee prior to entry, but it can be paid afterwards. The plastic card will not be produced until both conditions (fee payment and entry) have been met)

That would only slow the process. It would make no difference for determining 2 year vs 10 year.

All told you the same thing, just like I did...which is, come a few days after the 3rd, just not on the 3rd. As @Crazy Cat said, you don't want ROC head aches

The financial sponsor must precede the beneficiary when entering the the USA or they must arrive together. If you go in separate lines there is risk of drama and trauma to the beneficiary.
So refuse to be separated even though there will be people at the arrivals hall who insist otherwise.
Use the non citizen live for the least amount of drama. Yes it will take longer but it is the surest way to get this done properly. Also, in the citizen line, the CBPO might not be prepared for someone with an immigration visa. Or even an LPR (for examine the finger print scanner might not be working or present)

Oooo shoop...I do apologize. I read September 3rd...
My apologies @Chene. I don't know what I was seeing this morning 😪🤣

Chene reacted to Crazy Cat in 10 year green card?
Yes. If USCIS issues the wrong card, just submit an I-90 to have a correct one sent.
-
Chene reacted to Crazy Cat in 10 year green card?
The immigration payment is not a factor for determining 2-year card vs 10-year card. The relevant factor is date of entry into US after marriage. Good Luck.

The CBP should mark the visa as IR1 if the arrival is after 3rd September /not even 1 day sooner
pay attention to expiration date of visa as it expires 6 month from medical exam
