My impression is that you still are not ready or don’t want to live in the US permanently but yet still are applying for a Green Card. If you play your cards like that you will find some bumps along the road and issues with the Physical Presence requirement for Citizenship.
-
It is possible but I personally don’t think so, that process is done by contractors that prepare the files and process payments.
In your case it will make no difference if they “see” that you have an existing case as you know you do and have receipt. I would call them and with your info they should be able to see your receipt number, explain the situation and then after verifying which of the 2 checks was cashed put a stop payment on the other one.
Do this asap, after they process the second check that money is gone for good even if you request to withdraw it.

But keep in mind that an expired passport is proof of citizenship.

She is in the process of applying for citizenship. I also have another family member before me who was not given a conditional GC. That family member is also now a Citizen.
I appreciate the advice but I think you guys are making much ado about nothing
Good luck!

it was quite the pleasant experience. I was there with my wife (we were anticipating combo interview as we also have I-751 pending) interviewer was great. Things that I noticed- he said he did not need wife for both interviews as we were both walking in. It was quick. Passed the civics, writing and then all the yes no. He took some docs but he did not even ask for any additional info except for my DL, GC and Passports. He said the only reason he cant approve on the spot is because he has to adjudicate the pending I-751 and to look for the approval in about 2 weeks....the whole process was really pleasant. Except we got this after the interview.
We transferred your application to another USCIS field office for review
You do not need to do anything at this time
View your letter on your documents tab for an explanation on why we transferred your application
He did say we will not have to make the drive back to Memphis as the oath ceremony will be in Nashville were we live)
Anyone with this experience?
Since you have to cases i751 & n400 which one are you getting that message from when checking online?

I dont know about the 2 year wait. I know that when my wife entered the US after us being married less than a year she was not given a conditional GC. We have 2 children together so we didnt really have to prove relationship... the kids were the proof. So my guess is that they waived the conditional GC and she got her 10 year.
Agree with the advice provided, take care of this error asap. 100% guaranteed it will backfire at you down the road (naturalization, green card renewal, relative petition etc.) If a mistake was made it has to be corrected to comply with the law and regulations regardless of the effect of such action.

Congrats! It’s weird how the backlog in the system can work on your benefit sometimes.

Agree, amend the 2017 taxes and fire the accountant yesterday.

The “myaccount.uscis.gov” that you are referring to doesn’t work like you are thinking for i485. It only works for Online Filled Applications like i90, n400 etc. You can only track a paper filed application but no access to documents or notices sent to you.

Im based on marriage. I have my LPR since 2/2016. I have been abroad 3 times, and total is about 10.5 months, of course never longer than 6 months at one time.
I think that you will be fine, you still qualify for the 18 months of physical presence. You should be prepared for when you give them your form at the Oath Ceremony and that long absence comes to their knowledge to have some extra scrutiny which may end up even on them rescheduling your oath until they clarify/double check that physical presence requirement, I’m not saying that’s going to happen but there is a chance. I would bring evidence of all my trips during the 3 years just im case they want deal with it right there. I believe with USCIS being over prepared is always a good practice.

Similar, but I Have traveled abroad between interview and Oath. It was For 3 months. I have stamps in my passport and airplane tickets. I don’t think it should be a problem, but I can’t seem to find anyone who has similar experience and passed the Oath.
How many days out of the country you spent during the statutory period? which will be 3 years or 5 depending if you filed based on marriage or not.

I was referring to the post from richardkorea2010 where he didn’t specified if he had the 5 years requirement at the time of filling. If you have the 5 year requirement at the time of filling probably there is chance of USCIS letting you switch that (maybe...). But not the other way around otherwise they wouldn’t deny anyone for filling “too early”.

Apparently not according to a poster above.
He didn’t specify if he/she had been an LPR for 3 or 5 years when they applied...just mentioned that they did it under the 3 years rule.

I have my interview tomorrow and I hope they ask me the same question too I filed under the 3 year rule, but the interview date falls 5 years past the first approval of residency.
It doesn’t matter, if at the time of filling you didn’t have the 5 years it will be treated under the 3 years based on marriage rule.
Good Luck!!

Congrats then, didn’t have that info when I posted. Thought you just did the N400 interview and waiting for i-751.

I-751 still pending. Just got mail that I-751 interview is scheduled for November. So will see what happens...I'll call and tell them that I'm citizen. what is the interview for.
Be extremely careful to whom you make the claim of being a Citizen. You are not a Citizen until you have your i-751 & N400 approved and have taken the Oath Of Allegiance.
They are the people that will make you a Citizen so when you are one they’ll
know.

That’s a totally normal human reaction. You should be able to get not only factual but also moral support here! Some people seem to be so focused on the facts they forget there’s a human being with a lifestory and emotions behind a post on a forum.
Give yourself some time to recover, gather your options and make a plan.
Good luck!!
Almost everyone that has answered sympathized with her situation (including myself) but I think that more than moral support this is a forum where you get very valuable and precise answers about what was done, why and how to do it better for next time. Explaining to the OP how the process work is the right answer and will be more helpful and productive in the long run. Focusing on the facts is actually key as that's how it is done by the Consular Officers, Adjudicators and the whole system in general. They analyze and weight Facts and make decisions based on that.

Yeah!!! Mine went down 2 months also, from September 2020 to July 2020.
I hope this keeps going and going....😁😁😁

Sorry but your lawyer sounds like an idiot for giving you such a wrong advise. They want to see evidence from the beginning of the marriage.
From USCIS i-751 Instructions/Initial Evidence Check List:
Evidence of the relationship
- Submit copies of documents indicating that the marriage upon which you were granted status was entered in good faith and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you can to establish this fact, to demonstrate the circumstances of the relationship from the date of the marriage to the present date.
My advise: Get rid of that lawyer.
