    Start by filing an I-130.  Visa number availability for family visa categories cannot be expedited.  She will be F2B category.  Her priority date won't become current for several years.

    She does need to at least try a congressional inquiry.
    How was the first interview ? Any potential flags ( type of questions, inconsistent answers…)?  It is out of norm for a 2nd interview to be required …but the long delay is SOP in cases where they referred case to fraud unit.
    She is also justified in filing a WOM action

    Lots of red flags. Large age difference. Unauthorized work. Why is it unauthorized? Is she on an actual student visa (F1) or did she do a change of status from tourist visa to attend college and can't leave country without having to go to Bogota and get a real F1 issued? 
     
    Oh and USCIS does take fraud marriages seriously so think twice before going down that path.

    What are you confused about? Make an account on IRS.gov, download your tax return transcripts, print them and bring them to your interview. Took me a total of under 15 minutes to get mine the other week.

    - Sounds like it shouldn't be a problem, but it has some small risks, or even risk of delays, since you said you can't get the documentation. 
    - If the court records are not available, you will need to provide a letter from the court as such.
    - Providing your own FBI background reports will be useless and not helpful. Just wait if they send you an RFE for any additional info.
    - The FBI keeps a database of all expunged cases, and USCIS has full access to it. I think you will need the court records to prove the disposition of the case is not guilty.
     
    You could file for a CR1 instead and avoid the I-129F questions,.

    I agree with@Crazy Catbut I will do it in reverse. Essentially apply online right now to renew greencard. With online filing you should get a receipt usually within a week or less. The receipt will grant automatic 24month extension. The greencard together with the receipt should get you to board a flight with less hustle.

    The I-864 is not a blank check.  Yes, it is enforceable.  However, your obligation is not to provide 125% of poverty income, it is to provide the difference between their income and 125% poverty level.  You state that your wife works.  That means she has already demonstrated her ability to find gainful employment, and possibly a good measure of her earning capacity.  Most cases of I-864 enforcement consider the earning ability of the sponsored person, meaning if they are lounging around when they are qualified and capable of working, the judge may award them nothing.  If a working person decided to quit their job in the hopes of getting income through the I-864 during divorce, I think they will be disappointed when they find out that they need to go back to work. 
     
    The length of the marriage and age of the parties is also considered.  For such a short marriage alimony seems unlikely to me, unless her standard of living has gone down drastically, but even then, the short marriage will probably trump that.  
     
    As others have already said, nothing about the I-864 is automatic.  It must be specifically presented in a divorce case for it to apply.  It's definitely not something you want to discuss with her.

    Looks like the priority date for F2A category is 22JUN20
     
    Meaning you CANNOT adjust in the US for another few years, until they start processing cases file in December 2022.
     
     
    Also, what about I-130 for the child? Is it on file already?

    For starters, don't try to claim child as your own as that will not end well. So she shouldn't list your last name on BC. Get the father unknown BC and then K-2. 
     
    She'll have to figure out the passport for the child - hire a local lawyer knowledgeable in these things - I'm sure the lawyer can research the local laws for parentage and passport issues.

    Couple of things.
    -If they hadn't received the RFE, you would have received a denial by now. 
    -Tier 1s are useless. Glorified drive thru operators basically, so don't take anything they say as gospel, so don't waste your time on the phone. A tier 2 may be able to give a little more info, but don't bet on it. 
    -You could try an infopass, but good luck getting one of those in a timely fashion. 
    -Pay no attention to where the office is. I'm in NY, my last one was filed in phoenix, had an RFE from MO, and was adjudicated in Florida...presumably where Stevie Wonder spends his winters. 
    - If it has been lost, a denial is not the end of the world, especially if it is their error. Keep your proof of delivery safe.

    Australia has a J1, that is a coincidence.
     
    Most here would suggest you marry and file an I 130. Marry in Australia or Brazil. Well anywhere it is legal and you can meet, or go Utah online.

    A green card is for living in the U.S., for all intents and purposes you have not done that. In order to qualify for citizenship, it's like everyone else said, 4 years and one day- BUT you MUST spend the majority those 4 years here in the U.S., no more long absences. Best of luck.

    You chose your path.
     
    A re entry permit has nothing to do with this, that is about maintaining your LPR status.
     
    I must admit I thought it was 3 years and one day but USCIS have a good guide.
